[00:00:01] ARE WE READY? ALL RIGHT. GOOD MORNING EVERYONE. WELCOME TO THE HISTORIC COURTHOUSE. HISTORIC COURTROOM. IT IS NOVEMBER 12TH, 2024, 9:00 AM AND THIS IS OUR REGULAR COUNTY COMMISSIONER'S COURT. I'M GONNA CALL THE MEETING TO ORDER. [A) INVOCATION] I'M GONNA ASK COMMISSIONER M**K TO LEAD US IN OUR INVOCATION AND COMMISSIONER S SEVERE TO LEAD US IN OUR PLEDGES. THANK YOU, JUDGE. WOULD YOU GUYS PRAY WITH ME? DEAR LORD, YESTERDAY, WE HONORED OUR VETERANS, THE WORTHY MEN AND WOMEN WHO GAVE THEIR BEST WHEN THEY WERE CALLED UPON TO SERVE AND PROTECT THIS COUNTRY, AND OFTEN AT THE SUPREME SACRIFICE THAT THEY ENDURED ON BEHALF OF ALL OF US, WHICH WAS TO PRESERVE OUR LIBERTY, ENSURE OUR SAFETY AND SECURITY, AND DEFEND THE WAY OF LIFE IN THIS GREAT COUNTRY. WE THANK THEM YESTERDAY AND HONORED THEM YESTERDAY, BUT I WANT TO THANK THEM EVERY DAY. AND LORD, I THANK YOU FOR THE AMAZING POWER THAT YOU DO AND YOU WORK IN OUR LIVES. YOUR ALMIGHTY HAND IS ALWAYS PRESENT, AND WE PRAY THAT YOU WILL BE MERCIFUL TO OUR COUNTRY AND THIS COMMUNITY. I PRAY FOR THOSE IN OUR COMMUNITY THAT HAVE THE AUTHORITY TO HAVE THE WISDOM AND THE HUMILITY TO BE SERVANT LEADERS LIKE CHRIST. THANK YOU THAT YOU ARE ABLE TO BRING US HOPE EVEN THROUGH THE TOUGHEST TIMES, AND YOU ARE STRENGTHENING OUR PROCESSES ALONG THE WAY. FINALLY, I PRAY FOR PRESIDENT TRUMP SO THAT HE HAS THE DISCERNMENT TO HAVE THE ENERGY TO DO THIS DIFFICULT JOB, BUT TO BE THE PERSON WHO SEEKS YOUR WILL, NOT ONLY IN HIS LIFE, BUT IN NATIONAL MOD MATTERS. THE BIBLE SAYS THAT THE HEART OF A KING IS IN THE HAND OF THE LORD, AND THEN FINALLY, HEAL THIS LAND FROM THE CHAOS IN THE DIVISION AS WE MOVE FORWARD, IT IS MY PRAYER THAT WE HAVE UNITY IN AMERICA AND FOR YOU, SO THAT YOU CAN BE GLORIFIED EVERY DAY. WE PRAY ALL OF THIS IN YOUR NAME AND THANK YOU BECAUSE YOU ARE ALONE WORTHY. IT'S IN JESUS' NAME. AMEN. AMEN. STATE THE FLAG, THE FLAG, OUR PGI TO THE FLAG OF THE UNITED STATES OF AMERICA, AND TO THE REPUBLIC FOR WHICH IT STANDS, ONE NATION UNDER GOD, INDIVISIBLE, WITH LIBERTY AND JUSTICE FOR ALL. HONOR THE TEXAS FLAG, MY PLEDGE, ALLEGIANCE TO BE TEXAS, ONE STATE UNDER GOD, ONE AND INDIVISIBLE. THANK YOU, COMMISSIONERS. [1. PUBLIC FORUM] THAT BRINGS US TO AGENDA ITEM NUMBER ONE, PUBLIC FORUM. THIS IS THE PUBLIC'S OPPORTUNITY TO ADDRESS THE COURT ABOUT ANY COUNTY MATTERS. SEVERAL PEOPLE HAVE SIGNED UP, BUT UH, AS YOU GUYS KNOW, YOU DIDN'T SIGN UP. THAT DOESN'T PREVENT YOU FROM SPEAKING. UH, BUT LET'S AT LEAST GIVE THE PEOPLE WHO SIGNED UP THE FIRST CHANCE. SO FIRST ON THE LIST IS MR. FRANK MERLINO. AND, UH, PLEASE KEEP YOUR COMMENTS TO ABOUT THREE MINUTES. I DON'T SEE THE GREEN LIGHT. AM I LIVE? ALL IIII THINK WE'RE GOOD. I THINK WE'RE GOOD. ALL RIGHT. I THINK WE'RE A LIVE MIC THERE. I WANNA MAKE SURE THIS TIME. SO, SO. GOOD MORNING COMMISSIONERS AND JUDGE N THANK YOU FOR THE TIME AND CONSIDERATION. AS I DO REALIZE, WE ARE ALL BUSY IN, IN OUR DAYS. MY NAME IS FRANK MENO AND I LIVE AT 24 10 WINDCREST DRIVE IN ROCKWALL, TEXAS. I'M CURRENTLY THE PRESIDENT OF THE HIGH POINT LAKE ESTATES, HOA, WHICH RESIDES IN PRECINCT THREE OUT OF DEEP CONCERN, OUR COMMUNITY BAND TOGETHER TO CREATE THE HIGH POINT LAKE ESTATES STOP THE OUTER LOOP COMMITTEE. WE CONTINUE TO COMMUNICATE WITH OUR RESIDENTS WITH REGARD TO THE PROPOSED OUTER LOOP AND THE DR HORTON RIVER ROCK COMMUNITY. WE ARE ADAMANTLY OPPOSED TO BOTH OF THESE, AS IT WILL HAVE A PROFOUND EFFECT ON OUR QUALITY OF LIFE. THESE TWO PROPOSED EXPANSIONS WILL BRING 6,800 HIGH DENSITY HOMES AND APPROXIMATELY 2,700 NEW RESIDENTS TO OUR AREA. AND INCLUDED IN THAT IS ABOUT 20,000 MORE VEHICLES ON OUR ROADS AND 17,000 MORE STUDENTS IN OUR SCHOOLS. THE COUNTY WILL BE LEFT WITH A $250 MILLION TAX BILL TO EXPAND THE SCHOOL DISTRICT TO ACCOMMODATE THESE PEOPLE THAT WILL BE PASSED ON TO ALL OF US. SO THAT IS A DEFINITE CONCERN FOR THE PEOPLE IN THAT COMMUNITY WHO ARE ALREADY PAYING A HIGH PROPERTY TAX. THIS AREA ALREADY HAS WATER SHORTAGE ISSUES WITH NO SOLUTION IN NEAR SIGHT. I ASK YOU ALL, HOW WILL THIS MAKE OUR QUALITY OF LIFE BETTER? THE OUTTA LOOP WILL NOT BENEFIT ROCKWALL COUNTY. IT WILL BE THE DESTRUCTION OF THE AREA WE CALL HOME. THE QUALITY OF LIFE WILL CHANGE SUBSTANTIALLY FOR THE WORSE. THERE WILL BE ELEVATED HIGHWAYS, 50 FEET OFF PROPERTY LINES AND NOISE POLLUTION THAT WILL BE DEAFENING. WITH THESE ITEMS COMES AN INCREASE IN TRAFFIC CONGESTION AND UNDOUBTEDLY CRIME. LAST MONTH, THERE WAS A SHOOTOUT THROUGH OUR NEIGHBORHOOD, WHICH WAS BOTH TERRIFYING AND SHOCKING. OF COURSE, WE ARE THINKING HOW MUCH WORSE THIS WILL GET WHEN THERE IS ACCESS TO A MAJOR HIGHWAY 50 YARDS OFF OUR PROPERTY LINES. [00:05:01] YOUR CONSTITUENTS IN PRECINCT THREE ARE VOICING THEIR OPPOSITION TO BOTH PROPOSALS. IT BECAME CLEAR LAST MONTH THAT SOME OF YOU SITTING UP THERE TODAY DO NOT CARE ABOUT WHAT THE RESIDENTS WANT AND ARE PUSHING THEIR OWN AGENDA. WHAT IS NOT CLEAR TO ME IS THE REASON FOR THAT. I ARTICULATED MY CONCERNS SUCH AS HOW I WOULD BE FORCED TO SELL MY HOUSE AND UPROOT MY FAMILY IN THE HOME, WHICH WOULD, WHICH WAS WE LOVE, UM, DEVOID OF ANY EMPATHY. ONE OF THE COMMISSIONERS STATED THE HIGHWAY AND RIVER ROCK ARE COMING, LIKE IT OR NOT, AND ENDED WHAT I HOPE WOULD BE A PRODUCTIVE CONVERSATION. OUR HOPE IS THAT THE REMAINING FOUR COMMISSIONERS LISTEN TO THE PEOPLE THAT TRUST, THAT HAVE TRUSTED YOU AND ELECTED YOU IN GOOD FAITH TO PROTECT ROCKWELL AND IRRESPONSIBLE BUILDINGS. SO I THANK YOU FOR YOUR TIME. THANK YOU, FRANK. NEXT ON THE LIST IS MR. LEE GILBERT. UH, GOOD MORNING JUDGE. AND, UH, OUR COUNTY COMMISSIONERS, LEE GILBERT. UH, FORMER COMMISSIONER. FIRST TIME I'VE BEEN IN THE COURTROOM IN TWO YEARS. GOOD. GLAD TO HAVE YOU BACK. UH, THANK YOU VERY MUCH. UH, THIS MORNING I, I'D LIKE TO SPEAK TO AGENDA ITEM NUMBER SEVEN, UH, WHICH HAS TO DO WITH, UH, DISCUSS ACT ON, UH, RETIREE BENEFITS FOR 2025. FIRST THING I'D LIKE TO DO IS TO MAKE AN APOLOGY. UH, I SERVED ON THIS COURT FOR EIGHT YEARS AND I MADE SOME ASSUMPTIONS, AND THESE ASSUMPTIONS WERE ENTIRELY WRONG. BUT ONCE YOU RETIRE AND YOU GET A LETTER THAT SAYS, DEAR RETIREE, UH, WE'RE REDUCING, I'M GONNA TALK ABOUT TWO PARTS, JUDGE. UH, FIRST IS THE STOP. THERE WAS A STIPEND PUT IN PLACE IN 2003. UH, I, I BELIEVE THAT IT WAS PUT ON THE AGENDA BY DALE TROUT, UH, COMMISSIONER AT THAT POINT IN TIME, WHO REALIZED THAT, UH, HEALTH INSURANCE COST, UH, FOR RETIREES, ONCE YOU RETIRED OFF THE COUNTY PLAN, UH, WERE A MINIMUM OF 150 UP TO $300, UH, A MONTH. AND SO THE COURT AGREED TO A STIPEND. UH, I THINK THE ORIGINAL WAS ONE 50, AND THEN IT WENT TO 200 DURING MY TERM. UH, THIS COURT APPROVED AN ADDITIONAL 100 TO INCREASE IT TO $300 A MONTH. THAT STIPEND WAS INTENDED TO BE USED FOR HEALTH INSURANCE BECAUSE AN EMPLOYEE HAS A HEALTH INSURANCE UNTIL THE DAY THEY RETIRE. ONCE THEY RETIRE AND GO ON MEDICARE, UH, IT'S $185 A MONTH. PLUS IF YOU HAVE A SUPPLEMENT THAT STARTS AT ABOUT 150. SO YOU'RE LOOKING AT ROUGHLY $300. SO THIS COURT AND, AND HAS EVERY RIGHT TO DO IT, MADE A DECISION THIS YEAR TO REDUCE IT. AND THE WORD ON THE STREET IS NEXT YEAR YOU'RE GOING TO TAKE AWAY. SO YOU'RE GOING TO GO FROM, UH, 300 TO 200, UH, TO ZERO. AND AS, AS A, UH, RETIREE, THAT AFFECTS ME. BUT IT DOESN'T AFFECT ME THE WAY IT AFFECTS MOST OF THE 84, UH, RETIRED EMPLOYEES THAT ARE COV COVERED UNDER IT. IF YOU TAKE OUT THE ELECTED OFFICIALS AND THE COUNTY ADMINISTRATORS THAT ARE ON RETIREMENT, YOU'RE PROBABLY LOOKING AT EIGHT OR $900 A MONTH IN RETIREMENT BENEFITS, PEOPLE THAT WORKED HERE FROM ANYWHERE FROM EIGHT TO 25 OR 30 YEARS. SO, UH, AS, AS YOU GO DOWN THE ROAD, I, I WOULD ENCOURAGE YOU TO THINK ABOUT RETAINING THAT $200. I, I AGREE IT SHOULD PROBABLY GO AWAY, UH, FOR THE FUTURE, BUT THOSE THAT HAVE BEEN UNDER IT, UH, TO CONTINUE TO ALLOW THEM TO, UH, HAVE HEALTH INSURANCE. SO THEN WE GO TO THE RETIREMENT BENEFITS. AND I FOUND IT QUITE INTERESTING THAT, AGAIN, I I TAKE PERSONAL RESPONSIBILITY FOR FAILING TO LOOK AT RETIREMENT BENEFITS. IN THE LAST 10 YEARS, RETIREES HAVE HAD A COST OF LIVING INCREASE OF APPROXIMATELY 3%. IN THE LAST 10 YEARS, EMPLOYEES WORKING FOR ROCKWELL COUNTY HAVE HAD COST OF LIVING INCREASES OF APPROXIMATELY 50%, 12 TIMES GREATER THAN WHAT RETIREES HAVE. YET, RETIREES ARE ON FIXED INCOMES. MOST OF THEM WILL NEVER HAVE ANOTHER SOURCE OF INCOME OTHER THAN SOCIAL SECURITY AND THE RETIREMENT HERE. SO, UH, I, I HATE TO PUT IT BACK ON THIS COURT FOR THE FAILURE OF A PREVIOUS COURT, MAYBE [00:10:01] TO ADDRESS THE ISSUES IN A WAY THAT GOES FORWARD. BUT I HOPE YOU THINK ABOUT THAT AS, AS WE DO, UH, RETIREES ARE IMPORTANT. WE SELL THOSE BENEFITS TO PEOPLE COMING TO WORK HERE, AND WE SHOULD CONTINUE TO LOOK AT THAT AND TREAT IT AS IF IT'S, IT IS AN EXPENSE, BUT IT'S AN IMPORTANT EXPENSE TO THIS COMMUNITY. THANK YOU VERY MUCH. THANK YOU, LEE. NEXT ON THE LIST IS MR. RYAN JOYCE. AND ON DECK IS TODD ARONS. UH, GOOD EVENING. UH, JUDGE COMMISSIONERS, MY NAME IS RYAN JOYCE, 7 6 7 JUSTIN ROAD, ROCKWALL, TEXAS 7 5 0 8 7. UH, I COME BEFORE YOU TODAY TO DISCUSS AGENDA ITEM NUMBER 22. UH, THIS WAS PLACED ON THE AGENDA, UH, WITH, UH, VERY LITTLE INFORMATION OR TRANSPARENCY ABOUT WHAT CHANGES ARE CURRENTLY BEING MADE, UH, TO THE ROCKWELL COUNTY SUBDIVISION AND LAND DEVELOPMENT REGULATIONS. UM, BUT ALSO TO, THERE'S A SECTION IN HERE, SECTION 3.2, 0.4 D, UH, WHICH CALLS FOR A PROPOSED DEVELOPMENT REPRESENTATIVE. PRELIMINARY PLAT DOES NOT ENDANGER PUBLIC HEALTH, SAFETY, OR WELFARE. UH, WHILE I DO AGREE THOSE THINGS ARE IMPORTANT, THERE ARE STATE LAWS IN PLACE, UH, THAT REQUIRE, UH, THESE APPROVALS TO, TO BE VERY, OR OR TO NOT BE ARBITRARY OR, OR TO BE AT, AT THE OPINION OF, OF THE, THE COURT. AND SO I WOULD HOPE AS ELECTED OFFICIALS, THAT YOU WOULD NOT BLATANTLY DO ANYTHING THAT IS IN COMPLETE DISREGARD FOR WHAT STATE LAW IS. IT WAS, IT WAS INTERESTING. WE STOOD UP AND WE PLEDGE PLEDGE ALLEGIANCE TO THE AMERICAN FLAG. WE PLEDGE ALLEGIANCE TO THE TEXAS FLAG, UH, WHICH I'M SURE ALL OF YOU DID AT YOUR, UH, UH, INAUGURATIONS AND WHEN YOU WERE SWORN IN, BUT THERE'S NO ROCKWALL FLAG THAT WOULD, THAT WE PLEDGE ALLEGIANCE TO. I LOVE ROCKWALL. I LOVE ROCKWALL COUNTY. I LOVE BEING HERE. BUT WE ARE A STATE OF LAWS. WE ARE A NATION OF LAWS. AND I WOULD HOPE AS A RESIDENT THAT YOU ALL WOULD FOLLOW THOSE. I DON'T WANT MY TAX DOLLARS BEING WRAPPED UP IN UNNECESSARY LITIGATION GOING FORWARD, WHICH FROM SOME OF YOU MAY BE OKAY, BUT I FEEL THAT'S JUST A COMPLETE WASTE OF OUR TAX DOLLARS. THANK YOU GUYS FOR YOUR TIME. THANK YOU FOR YOUR SERVICE, AND I HOPE Y'ALL HAVE A GREAT DAY. THANK YOU, RYAN. ALL RIGHT, TODD ARONS, GOOD MORNING. APPRECIATE THE OPPORTUNITY TO COME UP HERE AND SPEAK WITH YOU FOLKS. UM, TODD AARONS 1520 STERLING RIDGE COURT, HIGH POINT LAKE ESTATES. UM, I TOO AM WITH FRANK ON EVERYTHING, SO I COULD COME UP HERE AND JUST SAY DITTO, UM, BECAUSE FRANK DID A GREAT JOB. BUT WHAT WE'RE LOOKING AT, I'VE BEEN AN 11 YEAR RESIDENT OF ROCKWALL, ROCKWALL COUNTY. I MOVED HERE FROM, FROM WISCONSIN. AND THE THING THAT I'VE SEEN MORPH OVER THE LAST 11 YEARS IS HIGH DEVELOPMENT GROWTH. WITH HIGH DEVELOPMENT GROWTH CAME. LOTS OF MEGA BUILDERS CAME. LOTS AND LOTS OF HOUSES CAME, LOTS OF TRAFFIC. AND WHEN YOU READ THROUGH ROCKWALL AND WHEN YOU PAY ATTENTION TO WHAT'S HAPPENING ON FACEBOOK, AND YOU TALK TO PEOPLE AT THE COFFEE SHOPS AND DINERS AROUND ROCKWELL, THE NUMBER ONE THING IS INFRASTRUCTURE. WE HAVE A MAJOR INFRASTRUCTURE PROBLEM. IT'S AN INTER-LOCAL INFRASTRUCTURE PROBLEM WITH ROADS AND ROADWAYS. WE SIGNED A BOND IN 2021, GRANTING PERMISSION FOR YOU GUYS TO SPEND OUR TAX MONEY ON NEW ROADS, 5 48, 5 49, 5 50, MAKE 'EM BIGGER, WIDER, STRONGER. TAKE 'EM FROM FARM TO MARKET ROADS, TWO LANE ROADS THAT GET BACKED UP FOR FIVE AND SIX LIGHT CYCLES, TAKING OUR KIDS TO SPRINGER SCHOOL AND GO AHEAD AND GET IT DONE. THAT HASN'T HAPPENED. WE'RE GOING INTO FOUR YEARS LATER, AND WE HAVEN'T SEEN ANY DIRT TURNED OVER ON ANY OF THAT STUFF. AND NOW WE'RE TALKING ABOUT AN OUTER LOOP. THE OUTER LOOP IS NOT AN INTERLOCAL PROBLEM. THE OUTER LOOP IS GONNA PROVIDE SERVICES FROM THOSE TRUCKING COMPANIES THAT WANNA HIT I 30 AND I 35 CONNECTING. IT DOESN'T HELP US HERE, FOLKS. IT HELPS ALL THOSE OTHER TRUCKING COMPANIES IN THE RAIL YARD THAT'S UP NORTH OF US, UM, UP IN MURPHY IN THAT AREA. WHAT WE WANNA SEE IS WE WANNA SEE THAT INFRASTRUCTURE LOCALLY THAT WE WERE ALL ON BOARD WITH AND SIGNED FOR. 2 0 5 WAS A PROJECT THAT I WENT TO THE MEETINGS IN 2014, THAT 2 0 5 WAS GONNA BE THE SIXTH LANE GRAND BOULEVARD. AND IT HASN'T HAPPENED. AND I KNOW IT STARTED WAY UP IN LAVONNE NOW, AND IT'S HAPPENING DOWN IN TARRELL, BUT THAT WAS PROMISED TO US 2019 AND 2020 TO BE DONE, COMPLETED. LET'S CUT THE RIBBON AND LET'S DRIVE ON IT. AND WE'RE NOT EVEN CLOSE TO THAT. SO WE'RE, WE'RE IN KIND OF A DIVERSION RIGHT NOW, FOLKS. WE'RE DIVERTING ALL OUR EFFORTS TO THIS OUTER LOOP PROJECT WHEN WE'VE GOT PROBLEMS RIGHT HERE AT HOME. AND THAT THOSE PROBLEMS RIGHT HERE AT HOME HELP US HELP YOUR CONSTITUENTS THAT HAVE GOT YOU INTO OFFICE. AND YOU KNOW, THE MAJORITY DOESN'T WANT THIS. YOUR CONSTI, UH, CONSTITUENTS , PARDON ME, THEY DON'T WANT THIS OUTER LOOP. DO WE NEED AN OUTER LOOP? SURE. BUT WE NEED IT A WIDER OUTER LOOP THAN WHAT IS PROPOSED. NOT TO MENTION IT'S RUNNING THROUGH FIVE OR SIX NEIGHBORHOODS [00:15:01] OF MILLION DOLLAR HOMES THAT DOESN'T HELP OUR PROPERTY VALUES. AND TO FRANK'S MADE ALL THE POINTS ABOUT THE NOISE AND THE TRAFFIC AND THE CRIME AND WHAT HAPPENED IN OUR NEIGHBORHOOD A FEW WEEKS AGO. ALL I ASK IS THAT YOU PUT US FIRST AND NOT BIG DEVELOPERS LIKE HUFFINES OR DR. HORTON FIRST, PUT US FIRST PLEASE AND GET US OUR INFRASTRUCTURE BEFORE WE ALL DECIDE TO MOVE OUT. AND THEN WE'VE GOT ALL KINDS OF OTHER ISSUES. WE LOVE IT HERE. WE WANNA STAY HERE. BUT PLEASE PUT US FIRST. THANK YOU VERY MUCH FOR YOUR TIME. THANK YOU, TODD. ALL RIGHT. THAT'S ALL THE PEOPLE THAT SIGNED UP, BUT THAT DOES NOT PREVENT YOU, EXCUSE ME, FROM SPEAKING. SO IS THERE ANYONE ELSE THAT WOULD LIKE TO ADDRESS THE COURT ON COUNTY MATTERS? COME FORWARD. TELL US YOUR NAME AND ADDRESS. I'VE GOT A COUPLE OF NAMES. SOME PEOPLE CALL ME JERRY WIMPY. SOME PEOPLE CALL ME HACKSAW WIMPY FOR CUTTING THE FLAG POLE DOWN. NEW COURTHOUSE. UM, FIRST TIME IN 12 YEARS, I THINK I'VE BEEN HERE, HERE. UM, BUT I WANTED TO REINFORCE WHAT, UH, UH, GILBERT SAID, EXCEPT FOR ONE THING, THAT HE'S YOUNGER THAN I AM. AND, UH, THE INSURANCE STIPEND DID GO IN THE, THE FIRST BUDGET, 2003. AND IT WAS $200, WASN'T 1 51 BEFORE THAT. THERE WASN'T ANYTHING BEFORE THAT. AND WE, UH, WERE CONCERNED ABOUT PEOPLE WHO ARE GONNA LEAVE HERE AND NOT BE ABLE TO LIVE NORMALLY, NOT, NOT SOME PEOPLE, BUT A LOT OF PEOPLE. PEGGY JONES, FOR EXAMPLE, HER HUSBAND DIED, AND SHE ONLY HAS THE LITTLE PENSION SHE HAS WITH THIS. SO I WOULD, I'M NOT QUESTIONING WHAT YOU'VE DONE. UM, I WAS TOO LAZY TO COME UP HERE AND VOLUNTEER TO GIVE YOU SOME HISTORY THAT YOU MIGHT NOT HAVE KNOWN. BUT I DO THINK THAT, UH, AT LEAST THE $200 NEXT YEAR SHOULD BE DISCUSSED, UH, BASED ON, UH, JUST THE FACT THAT WE ARE A TEAM AND WE, BY THE, BY THE STATE LAW, WE'RE NOT A TEAM, WE'RE INDIVIDUAL, BUT WE TRIED TO MAKE IT. A TEAM HAD MEETINGS EVERY YEAR WHERE PEOPLE COULD COMMENT ON WHAT THEY NEED, WHAT OTHER PEOPLE NEED. SO, UH, NOT TELLING ANYBODY WHAT TO DO EXCEPT DENNIS BAILEY, BECAUSE HE, HE HAD HIS FINGERPRINTS ON MOST OF IT. SO, UH, THAT'S, THAT'S ALL I HAVE. I JUST WANTED TO BE HERE TO REINFORCE WHAT THE FORMER COMMISSIONER GILBERT HAD TO SAY. THANK YOU. THANK YOU. THANK YOU, MR. WIMPY. IS THERE ANYBODY ELSE THAT WOULD LIKE TO ADDRESS THE COURT ON ANY COUNTY MATTERS? ALL RIGHT. SEEING NO ONE, WE'LL MOVE ON [2. Discuss/Act on the Rockwall County Strategic Plan 2050 - Develop Key Indicators and Performance Targets, and all related issues; (Commissioner Macalik)] TO AGENDA ITEM NUMBER TWO, DISCUSS AN ACT ON THE ROCK WALL COUNTY STRATEGIC PLAN 2050 DEVELOPED KEY INDICATORS AND PERFORMANCE TARGETS AND ALL RELATED ISSUES. COMMISSIONER M**K, THANK YOU, JUDGE, AND COMMISSIONERS AND EVERYONE IN ATTENDANCE AND LISTENING. I JUST WANNA GIVE A QUICK OVERVIEW OF WHERE WE'RE AT AND LEAD UP TO WHERE WE'LL BE THIS AFTERNOON AT ONE 30. UM, THE STRATEGIC PLAN, WE, UM, WE HAVE COMPLETED, UM, THE THROUGH THE CONTRIBUTORS, WHICH WERE OUR COMMUNITY STEERING GROUP OF ABOUT 75 PEOPLE TO OUR, UM, COUNTY STRATEGIC PLAN LEADERSHIP COMMITTEE, UM, AS WELL AS EVERYONE HERE SITTING ON THE COURT, SUPPORTED BY OUR CONSULTANT BAKER, TILLY AND FRIES AND NICHOLS. IN THE PAST, UM, SEVERAL MONTHS, WE HAVE, WE'VE COMPLETED, AND THE COURT HAS APPROVED THE VISION, THE MISSION, AND THE VALUES, AS WELL AS THE STRATEGIC GOALS. UM, AND LAST MONTH WE, WE COMPLETED AND APPROVED THE COURT APPROVED THE OPERATING INITIATIVES. THE NEXT STEP THAT WE NEED TO DO, WELL, LET ME BACK UP. AND THAT IS SIX STRATEGIC GOALS, AND THAT IS 34 OPERATING INITIATIVES. SO NOW WHAT WE'RE GOING TO DO, STARTING TODAY, UM, AT ONE 30 IN A WORKSHOP, WE WILL BE WORKING ON THE KEY PERFORMANCE INDICATORS AND FOR IN, AND, AND YOU'VE CALLED, YOU'VE HEARD ME CALL THEM KPIS. AND WHAT THAT REFERS TO IS WE'RE GOING TO THE, WE WILL, IT'LL BE FACILITATED BY BAKER TILLY, AND WE WILL BE DISCUSSING THE INTENDED OUTCOMES, UM, FROM A HIGH LEVEL DESCRIPTOR OF THOSE OUTCOMES AND WHAT WE WISH TO REVIEW AND CREATE AS FAR AS MEASURABLE SUB COMPONENTS TO THIS, HOW WE'RE GOING TO SUPPORT THE INITIATIVES WITH THE, THE KEY PERFORMANCE INDICATORS. UM, THAT WILL BE THROUGH THE WORKSHOP TODAY, AND MOST LIKELY IT MAY GO INTO TOMORROW. SO I'M GIVING EVERYBODY HEADS UP THAT BECAUSE OF, WHEN YOU THINK ABOUT 34 INITIATIVES, WE'VE GOT SOME, WE'VE GOT A LOT OF KEY PERFORMANCE INDICATORS TO LOOK AT OF HOW WE'RE [00:20:01] GOING TO DO THOSE. UM, AND THEN UPON THAT COMPLETION, UM, HOPEFULLY TO, UM, TODAY OR TOMORROW, THEN THAT WILL HELP US TO WORK TOWARD THE END OF THE YEAR WHEN THE NEXT PART, UM, AND PRETTY CLOSE TO THE END OF THE STRATEGIC PLAN PROCESS IS THE CHANGE MANAGEMENT AND THE IMPLEMENTATION. BECAUSE AS WE GET READY TO WRITE THE, WRITE THE PRO, THE, THE FINAL BOOK, IF YOU WANNA THINK OF THE STRATEGIC PLAN, THEN WE'VE GOTTA MAKE SURE WE HAVE WHAT ARE THE STEPS FOR THE COUNTY. 'CAUSE THIS IS, WE'VE GOT A LOT OF THINGS THAT ARE AFFECTING THE COUNTY AND OUR, AND THE WHOLE WELLBEING OF THE QUALITY OF LIFE FOR OUR, OUR CITIZENS. BUT WE DO NEED TO MAKE SURE THAT WE HAVE EVERYONE ON BOARD WITH THE COUNTY. AND I, THERE'S ANOTHER AGENDA ITEM THAT'LL COME UP IN A LITTLE WHILE THAT WE'LL TALK ABOUT THE SYSTEM AND THE SOFTWARE THAT WILL HELP US WITH THAT. DO YOU GUYS HAVE ANY QUESTIONS FOR ME? I, I DON'T LOOK FORWARD TO THE WORKSHOP. THIS, I, I DON'T BELIEVE THIS REQUIRES ANY ACTION OF THE COURT. NO, IT DOESN'T AT THIS TIME. NO, SIR. IT DOES NOT. THANK YOU. THANK YOU. YOU BET. THANK YOU. ALL RIGHT. WE'LL MOVE ON TO AGENDA [3. Discuss/Act on updates and progress related to the Courthouse Courtroom additions 3rd floor project, and all related issues; (Commissioner Sevier)] ITEM NUMBER THREE, DISCUSS AND ACT ON UPDATES AND PROGRESS RELATED TO THE COURTHOUSE, COURTROOM ADDITIONS, THIRD FLOOR PROJECT, AND ALL RELATED ISSUES. COMMISSIONER S SEVERE IS QUICKLY DIVERTING TO SALVADOR. GOOD MORNING COMMISSIONERS. UH, SALVADOR SANCHEZ WITH PARK HILL. UH, THE ONLY UPDATE WE HAVE TODAY IS THAT THE BUILDING, UH, REVIEW WAS COMPLETED BY BUREAU VERITAS, UH, LAST WEEK, UH, FOR THE THIRD FLOOR. PREVIOUSLY, THE FIRE CODE REVIEW WAS COMPLETED. THAT, UH, APPROVAL IS STILL, UH, GOOD. UM, SO WE JUST NEEDED TO COMPLETE A BUILDING REVIEW. UM, AND THEN ADDITIONALLY, HELEN WILKINSON IS WORKING THROUGH A CONTRACT RIGHT NOW AS WELL. SO, UH, NO OTHER UPDATE. OTHER THAN THAT THOUGH. ALL RIGHT. THANK YOU, SALVADOR. THANK YOU. APPRECIATE IT. ALL RIGHT. WITH THAT WE'LL MOVE ON [4. Discuss/Act on updates and progress related to the American Rescue Plan monies and the planned County Annex project, and all related issues; (Judge New)] TO AGENDA ITEM NUMBER FOUR, DISCUSS AND ACT ON UPDATES AND PROGRESS RELATED TO THE AMERICAN RESCUE PLAN MONIES AND THE PLANNED COUNTY ANNEX AND ALL RELATED ISSUES. CHRISTINA AND NICO SHOULD BE WORKING OUR WAY UP HERE. THANK YOU GUYS. HOW ARE Y'ALL DOING TODAY? I AM CHRISTY. WE'VE BROUGHT US AN ASSOCIATES. WE DO HAVE SOME PCOS THAT, UM, I WOULD REQUEST THAT WE CAN BRING THOSE EARLIER, UH, BEFORE WE GO BACK DOWN. UM, I THINK WE HAVE PCO SEVEN THROUGH 12, EXCLUDING ONE, EXCLUDING ONE . SO PCO SEVEN THROUGH 12, EXCLUDING NUMBER NINE, THE CONTRACTOR DID NOT HAVE, UM, A BREAKOUT OF MATERIALS CREDITS, BEFORE WE, UH, TALK ABOUT HOW WE'RE GONNA SPEND THAT MONEY. OKAY. SO I SAW COPIES OF THAT, BUT THEY'RE NOT IN MY PACKET. THEY'RE NOT IN, OKAY. OH, THESE ARE THE ONES THAT CAME AFTER THE FACT? MM-HMM. . GOT IT. GOT IT, GOT IT, GOT IT. OKAY. ADDRESS NUMBER TWO. YEAH. UM, SO, AND, AND I THINK YOU HAD SENT THE PACKET, SENT THE CHANGE ORDERS, PULLED IT BACK, SAID WE WANNA PULL THIS ONE 'CAUSE WE'RE LIGHT ON DETAILS. AND THEN SO WE, WE INADVERTENTLY PULLED THEM ALL. OH, PULLED THEM ALL . YEAH. YEAH. WE PULLED ITEM 10 RIGHT ON THE AGENDA. AND THEN WE, AND THEN ON FRIDAY, UH, THANKS TO THE AUDITOR, SHE CAUGHT THAT AND PUT IT ALL BACK OUT THERE SO THAT IT'S ONLY, IT'S ONLY ONE CHANGE ORDER. IT'S NOT THE ENTIRE ITEM 10. OKAY. DO, DO WE HAVE THAT WHERE WE CAN SHOW THAT ON THE SCREEN? I DON'T, IS THERE ANY WAY TO, TO DO THAT? I, I'D HATE TO EVEN, YEAH. TALK ABOUT AND, AND, AND THAT'S AN AGENDA ITEM. WHAT IS IT? NINE? NO, IT'S JUST NUMBER 10. NUMBER 10. ALL THE OTHER SUPPORTING DOCUMENTS WERE THERE, EXCEPT FOR NUMBER 10. OKAY. SO WE'RE NOT GONNA TAKE ACTION ON AGENDA ITEM TWO. WE WERE PLANNING ON, SO WHEN WE INITIALLY PUT THE, PUT IT TOGETHER, WE PULLED EVERYTHING, BUT THEN AS LISA CAUGHT, IT WAS ONLY ONE CHANGE ORDER THAT IS THE ISSUE. GOT IT. SO, YOU KNOW, WE COULD LOOK AT THAT. UM, THAT, OKAY. ALRIGHT. ALRIGHT. SORRY, I DIDN'T MEAN TO DIVERT YOU. OH, THAT'S OKAY. CONTINUE, CONTINUE ON. WE'LL, WE'LL GET TO THIS LATER. I KNOW SHE DIDN'T HAVE PCO OH OH SEVEN UP THERE, BUT WE DID HAVE PC OH OH SEVEN PCO OH SEVEN AND THE COST OF $14,719 RELATED TO DRAWING PERMITS, SET CHANGES. AND SO, UM, THAT WASN'T ON NICO'S LIST RIGHT NOW. UM, PCO OH OH EIGHT, WHEN WE WERE GOING THROUGH THE, UH, FURNITURE PLANNING, WE REALIZED WE NEEDED ADDITIONAL POWER. I'M SORRY, WE NEEDED TO DO REVISIONS TO THE BOXES TO INCORPORATE ALL THE ADDITIONAL CABLES AND, UH, AV AND DATA THAT GET STUFF INTO THE BOX. , THE PC OH OH NINE IS, THIS IS A ONE UNDER REVIEW. WE'VE GOT SOME LIGHTING CHANGES THAT DIDN'T APPEAR TO HAVE THE CORRECT CREDIT, SO WE'LL BRING THAT BACK. UM, PCO 10, THE COST IS, UH, $2,687. THIS WILL BE, UH, FUNDED OUT OF BUYOUT SAVINGS. UM, WE HAD, UM, SOME OPEN CABLE TRAYS IN THE CORRIDORS, AND SINCE WE DON'T HAVE FINISHED CEILINGS IN THE CORRIDORS, WE THOUGHT THEY WERE PRETTY UGLY . [00:25:01] SO WE MOVED THEM OUT OF THE CORRIDORS OVER CLOSED CEILING AREAS. SO YOU WON'T SEE THOSE, UH, WIRE CAGES ALL THROUGHOUT THE CORRIDORS. UM, PCO 11, THIS IS A ZERO COST. UH, THIS IS JUST TRANSFERRING BUDGET ITEMS FROM THE, UM, ALLOWANCE BUDGET FOR MOCKUPS, UH, TO THE COST OF WORK ITEM. AND PCO 12 COSTS, UH, $4,343 AND 60 CENTS FROM BUYOUT SAVINGS, ELECTION STORAGE IN THE MULTIPURPOSE ROOMS NEEDS FOUR ADDITIONAL OUTLETS AND POWER AND DATA. AND THEN WHAT I DIDN'T SEE IS OUR PCO NUMBER 13, WE'VE GOT BUYOUT SAVINGS THAT WE ARE READY TO RETURN BACK TO THE COUNTY IN THE AMOUNT OF $437,000, $484 AND 28 CENTS. I WANTED TO BE THE ONE TO SAY THAT . SO WE'VE GOT MONEY THAT, UH, WE SAVED DURING OUR, UH, BUYOUT PROCESS. AND, UM, SO, UH, WE WANTED TO REPORT THAT TO YOU ALL. UM, I DID CHECK WITH SAL JUST TO MAKE SURE WE, WITH, WE'RE WITHIN BUDGET ON THE FURNITURE AND IT LOOKS LIKE WE ARE. SO, UM, THIS IS MONEY THAT CAN GO BACK INTO ONE OF YOUR OTHER ARPA PROJECTS. WONDERFUL, WONDERFUL. OTHERWISE, WE ARE ON SCHEDULED ON BUDGET , AND I'M GONNA TURN THIS OVER TO NICO TO TALK ABOUT, UM, THE CONSTRUCTION ACTIVITY. THANK YOU. GOOD MORNING, JUDGE. NEW AND COMMISSIONERS AND EVERYONE PRESENT TODAY. MY NAME IS NICO PARKS WITH BROAD ASSOCIATES, AND I'LL BE PROVIDING A CONSTRUCTION UPDATE. UH, YESTERDAY WAS VETERAN'S DAY. SO FIRST AND FOREMOST, I JUST WANNA EXPRESS MY GRATITUDE TO THOSE WHO HAVE SERVED OUR COUNTRY. I KNOW WITHIN BROADUS AND ASSOCIATES, WE HAVE SEVERAL EMPLOYEES WHO HAVE SERVED AND WE ARE PROUD OF THEM. AND, UH, WE TAKE THE HOLIDAY, UH, NEAR AND DEAR TO OUR HEARTS. UM, SO AGAIN, I JUST WANTED TO SAY THANK YOU TO ALL THOSE WHO HAVE SERVED. UH, WE'LL START OFF WITH SAFETY. UH, THERE HAVE BEEN NO INCIDENTS ON SITE. SAFETY CONTINUES TO BE PRIORITIZED EVERY DAY. WE'RE HOLDING REGULAR SAFETY MEETINGS, AS WELL AS, AS ENFORCING REGULAR, UH, SAFETY SUBMITTALS FROM OUR SUBCONTRACTORS. UH, WE ARE PERFORMING ON BUDGET AND AHEAD OF SCHEDULE WITH NO NEW DELAYS TO REPORT ON. AS OF RIGHT NOW, THE PAST FEW WEEKS, WE'VE BEEN WORKING ON POURING THE REMAINING PIER CAPS WITHIN THE BUILDING FOOTPRINT. I BELIEVE I HAVE A PICTURE THAT SHOWS THAT. SO THERE WAS ONE LINE OF P CAPS THAT, UH, WERE REMAINING TO GET POURED OVER HERE ON THIS SIDE OF THE BUILDING. UM, SO THOSE SINCE HAVE BEEN POURED. UM, WE'VE PULLED THE BRACES FROM THE EXTERIOR PANELS AND STARTED TO HAUL OFF THE TEMPORARY CONCRETE FOOTINGS THAT WERE THERE FOR THE BRACES. UM, WE'VE BEGAN FRAMING OUT THE CLEAR STORY. AS YOU CAN SEE, UH, THEY STARTED TO PUT THE COLD FORM FRAMING ALL AROUND THE ROOF. UM, WE'VE ALSO COMPLETED THE LIFT STATION PARTIALLY. UM, THEY'VE SET IT IN PLACE AND HAVE BACKFILLED FOR IT. OH, DID I NOT HAVE A PHOTO FOR THAT ONE? YES, NOT, I GUESS NOT. UM, THEY PASSED THE BUREAU OF VERITAS INSPECTION. UH, AND SO THEY'LL BE LOOKING TO MAKE THE FINAL, FINAL TURN UP AND THEN GET ANOTHER, UH, FINAL APPROVAL, UH, FROM BUREAU OF VERITAS. BUT IT'S GOING WELL IN TERMS OF THE INSTALLATION. UM, THEY'VE CONTINUED INSTALLING THE WATERPROOFING AND BACKER ROD ON THE EXTERIOR WHERE THE PANEL JOINTS, UH, CONNECT AND THEY'VE CONTINUED SITE UTILITY WORK. UM, SO AGAIN, HERE'S A FEW PHOTOS. YOU CAN SEE THIS IS, UH, THE MAIN WATER VALVES COMING INTO THE BUILDING IN PLACE. MORE PHOTOS OF THE CLEAR STORY BEING FRAMED OUT. YOU CAN, YOU CAN SEE THE SAFETY, UH, BARRICADES ARE IN PLACE. UH, HILL AND WILKINSON HAS BEEN DONE A GREAT JOB OF KEEPING UP WITH SAFETY. UM, HERE YOU CAN ACTUALLY SEE THE CONCRETE TRUCK IS STARTING TO POUR THE, UH, COLUMNS FOR THE CANOPIES, THE EXTERIOR CANOPIES. UM, SO THE NEXT FEW WEEKS, UH, THE TEAM WILL BE FOCUSED ON INSTALLING THE TPO ROOF MEMBRANE. UH, THAT'S, THAT'S THE, THE MAIN TICKET ITEM COMING UP, AS WELL AS CONTINUING TO INSTALL THE MEP [00:30:01] UNDERGROUND RUPIN. AND THE STORM VOIDS AND TERMITE PROTECTION GOES AROUND THE SAME TIME AS THOSE, UH, MEP UNDERGROUND. UM, AND THEN ALSO THE CANOPY STEEL ERECTION IS COMING UP. AND WE WILL BE, UH, WRAPPING UP THE SITE UTILITY WORK AS WELL. IN TERMS OF PROCUREMENT. UH, THE SHEATHING, THE EXTERIOR SHEATHING WAS DELIVERED TO THE JOB SITE IN THE PAST COUPLE OF WEEKS, UH, AS WELL AS THE TPL MEMBRANE. UH, THE RTUS ARE STILL, UH, HAVE A ARRIVAL DATE OF END OF NOVEMBER, SO WE'LL BE EXPECTING THAT SOON. UM, ALSO THE GENERATOR AND AUTOMATIC TRANSFER SWITCH, ESTIMATED SHIP DATE REMAINS, UH, JANUARY 8TH. UH, WE ARE COORDINATING WITH ROCKWALL IT ACTIVELY TO ORDER THE NETWORK EQUIPMENT. UH, WE HAVE A COUPLE OF COORDINATION MEETINGS SCHEDULED THIS WEEK, UM, TO GO AHEAD AND GET THAT ORDER PLACED, AS WELL AS COORDINATING THE FURNITURE PACKAGE, AS CHRISTIE HAD MENTIONED, UH, TO GET THAT ORDER PLACED BEFORE THE ARPA DEADLINE. UH, IN TERMS OF QUALITY CONTROL, UH, WALL SHEATHING AND FRAMING WAS ADDED TO THE MOCK-UP ON SITE. UH, THE NEXT UP FOR THAT WILL BE THE WINDOWS AND THEN THE STICKY BRICK. SO THAT'S COMING ALONG WELL. UM, THE BUILDING ENVELOPE AND WEATHER BARRIER COORDINATION IS UNDERWAY. UM, THE PROTECTION OF THE POLISHED CONCRETE ON SITE HAS BEEN EMPHASIZED TO ALL THE TRADE PARTNERS SO THAT ONCE IT'S IN PLACE, WE'RE NOT WORRYING ABOUT HAVING ANY STAINS ON IT, ANY CHALK, CHALK LINES, OR ANY DAMAGE TO IT. UM, SO WE'RE COVERING OUR BASES IN TERMS OF THAT. UM, AND CMJ ENGINEERING HAS BEEN ON SITE REGULARLY, UH, CONTINUING WITH THEIR, THEIR CORE SAMPLES, UM, FOR THE CONCRETE AS WELL AS, UH, BACKFILL COMPACTION TESTING, AND, UH, THEY'VE BEEN GOOD AS WELL. UM, THAT WRAPS UP MY UPDATE. UH, I'LL OPEN IT UP FOR ANY, ANY QUESTIONS. DOES ANYBODY HAVE ANY QUESTIONS? I, I HAVE JUST AN ODDITY QUESTION. I'VE NOTICED A DRONE OUT THERE SEVERAL TIMES THAT IS JUST LIKE HOVERING. DO WE KNOW, IS THAT ONE OF OURS? WE KNOW IF THAT BELONGS TO A SUBCONTRACTOR, WHAT IT'S DOING. YES, SIR. THAT'S, UH, THAT'S HILL WILKINSON. UH, THAT'S THEIR DRONE. I BELIEVE THEY'VE GIVEN, THEY FILLED OUT THE PAPERWORK, UH, PRIOR TO, UH, FLYING THAT DRONE AND REQUESTED PERMISSION. SO, OKAY. I THINK WE'RE GOOD. BUT YEAH, THAT'S, THAT'S, AND AND IS IT JUST, UH, IT'S JUST PHOTOS? YEAH. JUST KEEPING TRACK OF PROGRESS? THAT, THAT'S CORRECT. YEAH. AND WE ACTUALLY WERE JUST GIVEN ACCESS TO THEIR WEBSITE THAT KEEPS THOSE PHOTOS. SO, UH, IF YOU'RE INTERESTED, WE CAN DEFINITELY INCORPORATE SOME OF THOSE INTO THIS, THIS PRESENTATION. YEAH, THAT MIGHT BE, MIGHT BE NICE TO HAVE. MM-HMM, . ALL RIGHT. ANY QUESTIONS FOR, ALL RIGHT. THANK YOU GUYS. THANK YOU. DON'T GO TOO FAR, DO WE, DO I NEED TO STICK UP HERE FOR THE SHERIFF'S REMODEL? UM, SURE, SURE, SURE, SURE. HANG, HANG, HOLD YOUR, HOLD YOUR, HOLD YOUR POSITION, SIR. ALL RIGHT. AND THERE'S NOTHING REQUIRING ACTION ON THE ANNEX RIGHT NOW. THIS IS JUST INFORMATIVE. CORRECT. ALL THE ACTION ITEMS ARE IN THE AGENDA. GOT IT. GOT IT, GOT IT, GOT IT. ALL RIGHT. THAT BRINGS [5. Discuss/Act on the Sheriff's remodel project, and all related issues; (Commissioner Sevier -Commissioner Stacy)] US TO AGENDA ITEM NUMBER FIVE, DISCUSS AND ACT ON THE SHERIFF'S REMODEL PROJECT AND ALL RELATED ISSUES. COMMISSIONER SEVER AND STACY, WHICH I'M GONNA GO AHEAD AND JUST REDIRECT. UH, YEAH, ABSOLUTELY. I DON'T, I'M NOT SURE THAT THERE'S A WHOLE LOT TO UPDATE HERE OTHER THAN, UH, LAST WEEK WE HAD A PRE-PROPOSAL, UH, SITE VISIT ON SITE, UH, WITH SOME OF THE GENERAL CONTRACTORS THAT WILL BE BIDDING THE PROJECT. UH, SO THEY WERE ABLE TO GET EYES ON, ON THE JOB. AND, UH, PROPOSALS ARE ACTUALLY DUE THIS WEEK, UH, THIS THURSDAY. SO WE'LL START LOOKING AT THE BID PROPOSALS. AND THEN, UH, A QUICK UPDATE IS ON THE 26TH. WE SHOULD HAVE THE BIDS FOR US TO HAVE, WE SHOULD ALSO HAVE THE MOU, WHICH IS AN ARPA REQUIREMENT. WE'RE PRETTY WELL DONE WITH THAT. UM, AND THEN I TALKED TO GRANT WORKS, AND WE SHOULD HAVE THE OFFICIAL JUSTIFICATION, UM, WRITTEN SO THAT WE CAN HAVE THAT ON FILE. SO THE SHERIFF'S PROJECT IS SLOWLY COMING THROUGH, BUT COME 1126, WE'LL HAVE THE OFFICIAL ACTION OF THE CMAR, THE JUSTIFICATION, AND THE MOU, WHICH, WHICH WILL SECURE THE FUNDS, UM, INTO THE PROJECT AND GET US ARPA COMPLIANT AS WELL. ALL RIGHT. ANY OTHER QUESTIONS, COMMISSIONERS? NO. ALL RIGHT. THANK YOU. STILL DON'T GO FAR STILL. ALL RIGHT. THAT [6. Discuss/Act on sewer line crossings forCrenshaw Road, and all related issues; (CommissionerStacy)] BRINGS US TO AGENDA ITEM NUMBER SIX. DISCUSS AN ACT ON SEWER LINE CROSSINGS FOR CRENSHAW ROAD AND ALL RELATED ISSUES. COMMISSIONER STACY? YEAH. SO, UH, IN, IN THE PACKET, [00:35:01] UM, I CREATED A SMALL SUMMARY THAT JUST KIND OF BREAKS DOWN WHAT'S HAPPENING. AND I INCLUDED THE MAPS. UM, WHAT'S GOING ON IS THAT THERE ARE TWO SEWER LINES THAT ARE GONNA BE CROSSING, I'M GONNA CALL IT OLD CRENSHAW ROAD, BECAUSE EVENTUALLY IT WILL HOPEFULLY BE OLD CRENSHAW ROAD. UM, AND THAT IS THE CALICHE ROAD THAT CURRENTLY EXISTS. AND SO THERE'S GONNA BE TWO CROSSINGS OF SEWER LINES. THE CONTRACTOR ON THAT IS THE CITY OF ROYCE CITY. THEY'RE ASKING TO OPEN, CUT THOSE LINES, UM, ACROSS THE ROAD THAT WE'RE GOING TO BE ABANDONING. UM, THE PRICE TO BORE THEM IS OVER A HUNDRED THOUSAND DOLLARS. UM, IF YOU REMEMBER IN THE ANNEX, THE CITY OF ROCKWELL ALLOWED US TO OPEN CUT FOR SUBSTANTIAL SAVINGS ACROSS YELLOW JACKET. UM, THEY WILL OBVIOUSLY WORK WITH ROAD AND BRIDGE AND THE SCHEDULING WITH THE SCHOOL BECAUSE IF THEY SHUT THAT ROAD DOWN WITH SCHOOL, THEY'RE ON THE LIST TO BE CALLED TO COMPLAIN. SO, UM, THAT NATURALLY WORKS ITSELF OUT. SO WHAT I'M ASKING IS FOR US TO ALLOW THEM, UM, TO DO THE OPEN CUTS ON THE ROADWAY THAT IS GOING TO BE ABANDONED, AND THAT'S THE ASK. AND SO OUR CURRENT POLICY WITH ROAD AND BRIDGE IS TO NEVER ALLOW AN OPEN CUT. UM, BUT I THINK THAT THIS IS A SPECIAL CIRCUMSTANCE THAT IS ALLOWING US, THAT'S MY ASK OF THE COURT. UM, I DON'T KNOW IF Y'ALL HAVE ANY QUESTIONS. UM, BUT THAT'S, THAT'S WHAT'S BEING PROPOSED. ANY QUESTIONS? YEAH. WOULD YOU SAY ABANDONED? SO WE'RE NOT GONNA USE THAT ROAD ANYMORE. IF WE COULD EVER BUILD THE OTHER CRENSHAW ROAD, THIS, THIS ROADWAY IS, WILL BE ABANDONED. NOT IF WE EVER CAN. WE'LL BE BUILDING. YES, WE WILL BE BUILDING, YES, NEXT YEAR. THAT'S THE HOPE. IT'S GONNA BE BUILT VERY QUICKLY. BUT YES, THIS ROAD WOULD BE ABANDONED. COMMISSIONER, IS THERE ANY EXPENSE TO THE COUNTY? THERE IS NO EXPENSE TO THE COUNTY. IT'S JUST ALLOWING THE CONTRACTOR TO DO THE TWO OPEN CUTS. AND THE CONTRACTOR IS THE CITY OF CITY. IT MIGHT NOT BE THE CITY, BUT THEY'RE DEFINITELY OVERSEEING THE PROJECT. BUT THEY WILL BE OVERSEEING, YES. IT, YES. THESE ARE CITY SEWER LINES. MM-HMM. GOT IT. WELL, I'M GONNA GO AHEAD AND MAKE A MOTION THAT WE ALLOW THE CITY OF ROYCE CITY TO, UH, CUT SEWER LINE CROSSINGS ACROSS CRENSHAW ROAD. AND I'LL SECOND THAT. SO WE'VE GOT MY MOTION. GOT A SECOND BY COMMISSIONER STACEY. IS THERE ANY FURTHER QUESTIONS OR COMMENTS? MAN, I ALMOST JUST SAID, ALL IN FAVOR SAY AYE. BUT LET'S, UH, LET'S YOU REGISTER OUR VOTES. ALL RIGHT. STEAL, STEAL, PUSH IT HARD. THERE YOU GO. THERE WE GO. OKAY. OKAY. GOOD. ALL RIGHT. THAT'S FIVE IN FAVOR. ALL RIGHT. SO THANK YOU. BRINGS US TO [7. Discuss/Act on the Rockwall County's FY2025 retirement benefits, and all related issues; (Commissioner Stacy/Commissioner Sevier)] AGENDA ITEM SEVEN, DISCUSS AN ACT ON ROCKWALL COUNTY'S FY 2025, RETIREMENT BENEFITS AND ALL RELATED ISSUES, COMMISSIONER STACY AND S SEVERE. UM, IF Y'ALL RECALL, DURING BUDGET TIME, UH, IT WAS THE RECOMMENDATION OF THE BENEFITS COMMITTEE TO DO A REDUCTION, UM, FROM 300 TO 200, AND ALSO TO DO A RECOMMENDED COLA OF 2%. UM, IN THE BUDGET, WE INCREASED THE FUNDING OF THE RETIREMENT PROGRAM FROM 9% TO 10%, UM, WITH THE IDEA THAT WE WOULD BE DOING SOME COLA INCREASES WHILE WE WERE, WHILE WE COULD POTENTIALLY BE DOING THESE DECREASES TO THE STIPEND. SO, UM, OTHER THAN THAT, UH, I, I STILL BELIEVE IT'S THE BENEFIT COMMITTEE'S RECOMMENDATION TO DO THE, THE 2% COLA THAT WOULD PUT US AT, UM, I'M GONNA PUT ON MY GLASSES. LAST TIME I READ A NUMBER WITHOUT MY GLASSES ON, I GOT IN TROUBLE. UM, IT WOULD PUT US AT 9.65 REQUIRED FUNDING, AND WE'RE CURRENTLY FUNDING IT AT 10. SO WE WOULDN'T HAVE, IT WOULDN'T HAVE ANY BUDGET CONSIDERATIONS, UH, DIRECTLY TO THIS CURRENT BUDGET IF WE DID THE, UH, COLA INCREASE. SO THE ASK FROM THE BENEFITS COMMITTEE COMMITTEE IS TO HAVE A 2% COLA INCREASE? YES. OKAY. I DON'T KNOW IF CAMMY HAS ANYTHING TO ADD. UM, BUT THAT WAS PRETTY MUCH THE, THE VOTE OF THE COMMITTEE. AND THEN, UM, HR, UH, PUT TOGETHER THIS CHART TO JUST SHOW KIND OF WHAT THE, WHAT'S ALLOWABLE. UM, WE WE'RE NOT ALLOWED TO JUST DO WHATEVER WE WANT WITH THE RETIREMENT PLAN. SO YOU CAN GO FROM A ONE, OBVIOUSLY 0 1 2 OR 3% FLAT. AND THEN ALSO THEY HAVE THE CPI ONES INCLUDED IN HERE AND WHAT THOSE FUNDING MECHANISMS WOULD BE. UM, BUT IN THE CURRENT BUDGET, IT IS 10, UM, PERCENT IS WHAT WE ARE CURRENTLY FUNDING IN THIS BUDGET. SO AS LONG AS WE STAY UNDER THAT 10%, WE, IT WOULDN'T HAVE ANY DIRECT BUDGET IMPLICATIONS. UM, NOW IT COULD POTENTIALLY HAVE BUDGET IMPLICATIONS IN THE FUTURE IF WE WANTED TO DO MORE COLAS OR, OR THOSE SORTS OF THIS, BUT THE EXACT IMMEDIATE FY [00:40:01] BUDGET WE'RE UNDER IT WOULDN'T HAVE ANY DIRECT, UM, BECAUSE WE ARE ALREADY FUNDING IT AT 10%. DOES ANYBODY HAVE ANY QUESTIONS? YEAH. E EXPLAIN TO ME WHAT THE BENEFIT TO THE RETIREES WOULD BE. SO THE AVERAGE MONTHLY INCREASE, UM, IS RIGHT AROUND $40. AND THAT'S JUST AN AVERAGE ACROSS THE BOARD, BUT IT WOULD BE A 2% FLAT INCREASE TO WHATEVER THEIR PENSION IS. THAT WOULD BE THE BENEFIT TO THE RETIREES. OKAY. GOT HERE THAT THE AVERAGE MONTHLY, UM, RETIREE BENEFIT AT THE 2% FLAT IS AROUND $1,670. IS THAT CORRECT? YES. AND IT IS CURRENTLY AT 1,638 AVERAGE. OKAY. SO LET'S NOW ACTION IS NOT REQUIRED UNTIL DECEMBER 15TH. UM, WE HAVE TO TELL T-C-D-R-S BY DECEMBER 15TH WHAT WE'RE GOING TO DO FOR THE NEXT YEAR. OBVIOUSLY, WE, WE TELL THEM NOTHING, WE DO NOTHING. UM, SO IT WAS, UH, OUR GOAL AS THE BENEFITS COMMITTEE TO PUT THIS ON COURT IN NOVEMBER, UM, TO VOTE UP OR DOWN ON THE RECOMMENDATION OF THE 2% OR ANY VARIATION OF A COLA OR NO COLA, OR JUST GET TO GET SOME COURT ACTION SO THAT IT'S CLEAR MM-HMM. AND, AND IT'S NOT ALL THE WAY UP TO THE 10TH. RIGHT. UM, I, IS THERE A REASON WHY WE CAN'T TALK ABOUT THE COLA INCREASES DURING THE BUDGET? AT BUDGET TIME? WE DID. UM, AND THAT'S THE REASON WE MOVED TO THE 10%. SO, SO WE, WE TALKED ABOUT IT, BUT IT WAS JUST THE COURT COULDN'T COME TO A CONSENSUS WITH EVERYTHING ELSE THAT WAS GOING ON IN THE BUDGET TO JUST GO AHEAD AND MAKE FORMAL ACTION. GOT IT, GOT IT, GOT IT, GOT IT. AND I THINK I RECALL, AND I MAY BE WRONG, BUT THIS, THIS, THIS PRESENTATION IS FOR ABOUT 182 PAY, UM, UM, RETIREES. IS THAT CORRECT? THAT IS CORRECT. BUT WHEN WE WERE TALKING ABOUT IT IN THE BUDGET, I THINK WE WERE LOOKING AT WHAT THE NEXT FEW YEARS WERE GOING TO LOOK LIKE FROM THAT STANDPOINT TOO. IS THAT, AND, AND THE IMP AND THE BUDGET IMPLICATIONS, I THINK, AND THAT, AND THAT WAS GEARED MORE TOWARDS THE STIPEND. UM, THE, THE, THE CONTINUING OFF OFFERING OF THE STIPEND COULD HAVE ROLLED IT INTO ALMOST A MILLION DOLLARS A YEAR JUST BASED UPON WHAT WE WERE SEEING FROM A RETIREE STANDPOINT. UM, BUT WE WENT AHEAD AND ALREADY PASSED THE POLICY SO THAT NO FUTURE RETIREE CAN GET TO THE STIPEND AS OF OCTOBER 1ST. SO, UM, THE STIPEND IS NOW JUST LOCATED TO THE PEOPLE THAT ALREADY HAVE IT, UM, SO THAT THAT FUTURE SNOWBALL, UM, ISN'T GOING TO AFFECT THE COUNTY BUDGET. AND SO GOING FORWARD, YOU'LL DISCUSS THIS DURING THE BUDGET? I, I TRIED REALLY HARD, BUT, YOU KNOW, AND THAT'S WHY WE GOT TO THE 10%, UM, IS TO MAKE SURE THAT WE WOULD HAVE THE ABILITY TO DO COLA IF WE WANTED TO. OKAY. EXCUSE ME. AND EVERY YEAR THE DISCUSSION WOULD COME UP WHETHER COLA MM-HMM, , AND IT WOULD NOT BE LESS THAN, YEAH. IF, IF, IF, IF WE DON'T INCREASE THE RATE TO OFFER A COLA, IT BECOMES A MOOT POINT. UH, SO COMMISSIONER STACY IS RIGHT. WE INCREASED OUR, OUR, UH, OUR PERCENTAGE, UH, UP TO 10%, WHICH NOW GIVES US THE OPPORTUNITY BECAUSE THE BENEFITS COMMITTEE, WE LOOK AT THIS IN LIKE MAY. UM, SO, SO WE START RUNNING THE NUMBERS AND, AND GIVING RECOMMENDATIONS, UM, WITH THE FIRST DRAFT OF THE BUDGET. CORRECT. SO, SO THERE WA BUT, BUT WHAT HAPPENED WAS IS BECAUSE OF THE STIPEND, BECAUSE OF, UH, A THREE, TWO BUDGET THERE, THERE WASN'T THERE. THIS JUST KIND OF GOT LOST IN EVERYTHING THAT THIS COURT WAS DISCUSSING AND DELIBERATING ON AT THE TIME. BUT THE 10% DIDN'T. SO WE DID, WE DID INCREASE THE FUNDING AND WE DID LOWER THE STIPEND, AND WE DID MAKE IT SO THAT FUTURE RETIREES, UM, WOULDN'T HAVE THE OPTION OF GETTING THE STIPEND. SO ALL THAT DID HAPPEN, BUT IT WAS THE IDEA OF THE BENEFITS COMMITTEE IF THE STIPEND WERE TO BE REDUCED, TO MAKE SURE THAT WE SCHEDULE IN COLAS AT THE SAME TIME. SO THAT WAS THE, THE, THE IDEA WAS TO SHIFT THE ACTUARIAL, UM, RISK INTO THE PENSION FUND AND NOT, AND OUT OF THE GENERAL FUND SO THAT WE COULD START FUNDING THE RETIREE AND PROTECT THE RETIREES BENEFITS AT T-C-D-R-S AND NOT HAVE IT IN THE GENERAL FUND OF THE COUNTY. SO THAT IT, BECAUSE WE SAW THIS SNOWBALL OF FUTURE RETIREES WITH THE COUNTY GROWING WITH THE NUMBER OF EMPLOYEES AND HOW, AND IF YOU HAVE THAT BOTTOM LINE, [00:45:01] IT COULD JUST DISAPPEAR INSTANTANEOUSLY WHEN THAT GOT TO A MILLION AND A HALF DOLLARS OR, OR WHATEVER IN THE GENERAL LINE OF THE BUDGET. ALL RIGHT. SO I'M GONNA GO AHEAD AND CAN, CAN I ASK ONE OTHER? YEAH. PLEASE. HELLO. PLEASE, PLEASE, PLEASE. UM, YOU'RE GOOD. NOW, DO THE OTHER MEMBERS OF THE, UM, COMMITTEE AGREE, UM, CAMMY AND, UH, THE TREASURER ? HEY, HE'S ASKING WELL, WELL PLAYED DAVID PEAK WELL PLAYED. SIR , HE POINTED TO THE MICROPHONE JUDGMENT. MAY YES, PLEASE. YES, PLEASE, JUDGE. COMMISSIONERS, GOOD MORNING. DAVID PEAK ROCKWELL COUNTY TREASURER. I DO NOT HAVE A COMPLETE, UM, PHOTOGRAPHIC MEMORY OF ALL THAT TRANSPIRED, BUT AS COMMISSIONER STACEY DESCRIBED, THAT'S PRETTY MUCH HOW I REMEMBER THINGS. THE FACT THAT IF, UM, THE REQUIRED RATE FOR THE T-C-D-R-S FOR THE UPCOMING CALENDAR YEAR WAS, UH, NINE AND CHANGE, AND WE ELECTED AT 10, THAT DEFINITELY PROVIDES FOR SOME, UH, OPPORTUNITY TO ABSORB ANY OF THIS COLA THAT THE COURT, UM, SEEKS TO APPROVE FOR OUR RETIREES. UH, WE DISCUSSED THAT IN THE BENEFITS COMMITTEE, AND AGAIN, IT WAS, UM, YOU KNOW, I, I WAS IN, IN TOTAL SUPPORT OF TAKING CARE OF THOSE RETIREES. THAT'S THE REASON WE HAVE THE T-C-D-R-S, AND THAT'S HOW WE, THE REASON WE ALL PAY INTO THAT. AGAIN, AS COMMISSIONER STACEY MENTIONED, AND I THINK, UH, CAMIA CORRECT ME IF, IF I HAVE IT WRONG, THE, THE ABSOLUTE DROP DEAD DEADLINE IS NOT TILL DECEMBER. BUT, YOU KNOW, IF THE COURT CHOOSES TO GO AHEAD AND VOTE THIS IN NOW, UM, YOU KNOW, THAT'LL TAKE CARE OF IT. AND WE'LL DEFINITELY TAKE THE RECOMMENDATION OF THE COMMISSIONERS TO, UH, UH, FOR THE BENEFITS COMMITTEE TO, TO BE EVEN MORE DELIBERATE DURING THE NEXT BUDGET CYCLE TO MAKE SURE THAT THIS IS CLEAR AND CONCISE AND THE COURT KNOWS, UH, WHERE THIS IS GOING. PART OF THE CHALLENGE IS THE T-C-D-R-S YEAR, IT IS NOT, IS A CALENDAR YEAR. IT DOESN'T REALLY MATCH THE FISCAL YEAR. SO IT'S DEFINITELY SOMETHING THAT CAN BE PUNTED BECAUSE Y'ALL CAN TAKE CARE OF IT A MONTH OR TWO AFTER THE BUDGET YEAR STARTS. SO, UM, MY TAKEAWAY IS, WELL BIRD DOG THIS A LITTLE BIT EARLIER AND MAKE SURE EVERYBODY'S ON THE SAME SHEET, AND THERE'S NO SURPRISES NEXT YEAR. BUT AS COMMISSIONER, COMMISSIONER STACY, UM, THE WAY HE DESCRIBED IT, I, YOU KNOW, I SUPPORT THAT IF THAT'S THE WAY THE COURT WANTS TO GO. ABSOLUTELY. AND, AND I CONCUR, UH, WITH THE, UH, RECOMMENDATION. GO AHEAD, CAMMY. YOU MAKE YOUR COMMENTS. THANK YOU. I JUST WANTED TO REMIND THE COURT THAT A-T-C-D-R-S COLA NOT ONLY IMPACTS THE RETIREES, BUT IT'S THE RETIREE AND OR THEIR SURVIVING BENEFICIARY. YEAH. SO, UM, THE COURT VERY SMARTLY APPROVED THAT 10% ELECTED RATE IN THE, IN THE BUDGET TO SUPPORT A COLA, WHICH WOULD IMPACT EVERYONE WHO RECEIVES A T CCB T-C-D-R-S BENEFIT FROM THROUGH ROCKWALL COUNTY. OKAY, THANK YOU. SURE. UM, AND SO MY, MY LAST COMMENT WOULD BE THAT I CERTAINLY WON'T BE HERE DURING THE BUDGET, UH, FOR THE 25 26, BUT I WOULD STRONGLY SUGGEST THAT WE CONTINUE THE COMMITMENT, UH, TO THE, UH, STIPEND GOING FORWARD FOR THE, UH, EMPLOYEES THAT WERE LISTED AS OF THIS PARTICULAR DATE. OKAY. ANY OTHER QUESTIONS OR COMMENTS? I'M GONNA, I'M GONNA GO AHEAD AND, UM, SEE WHERE WE GET AND MAKE A MOTION THAT WE APPROVE THE 2% FLAT COST OF LIVING ADJUSTMENT, EFFECTIVE JANUARY 1ST, 2025. OKAY. I'LL SECOND. OKAY. A VERY SLOW SECOND THERE, BUT A SECOND. IT WAS, YEAH. SO WAITING FOR COMMITTEE MEMBERS. YEAH. ALL RIGHT. SO WE HAVE MY MOTION, WE HAVE A SECOND BY COMMISSIONER STATES. ARE THERE ANY FURTHER QUESTIONS OR COMMENTS? UH, LET'S SEE IF WE CAN DO THIS. PLEASE REGISTER YOUR VOTES AND IT PASSES FIVE ZERO. ALL RIGHT. THANK YOU. AND THAT [8. Discuss/Act on a contract to film at the Historic Courthouse, Sheriff Office, and main Courthouse, and all related issues; (CommissionerStacy)] BRINGS US TO AGENDA ITEM NUMBER EIGHT, DISCUSS AND ACT ON A CONTRACT TO FILM AT THE HISTORIC COURTHOUSE SHERIFF OFFICE IN MAINE COURTHOUSE IN ALL RELATED ISSUES. COMMISSIONER STACY? YEAH, SO WE WERE APPROACHED BY A PRODUCTION COMPANY TO DO SOME, UH, FILMING ON COUNTY PROPERTY. UH, I, UH, IT WAS FUNNY, THEY SAID THAT THEY SAW OUR HISTORIC JAIL ON SOME SORT OF WEBSITE AND, UM, AND HE SAID HE WANTED TO SHOOT A, UH, A FIGHT SCENE IN OUR JAIL. [00:50:01] AND I SAID, WELL, I REFUSE TO EVEN START THE CONTRACT UNTIL YOU ACTUALLY COME SEE IT, BECAUSE I'M NOT SURE THAT YOU'RE LOOKING AT THE CORRECT JAIL, UM, . AND SO, UM, THEY CAME A COUPLE DAYS LATER, THEY WALKED AROUND THE FOURTH FLOOR AND THEY SAID, THIS IS EXACTLY WHAT THE PICTURES WERE, AND, AND THIS IS EXACTLY WHAT WE WANNA DO. AND SO, UM, SO THEN THAT KIND OF EXPANDED, UM, FOR THEM TO DO THE, UH, SHERIFF'S OFFICE, WHICH I GOT THEM IN TOUCH WITH, UH, WITH, UH, THE SHERIFF. I REMINDED HIM THAT I'M NOT IN ANY WAY REMOTELY IN CHARGE OF BEING ABLE TO TELL YOU IF YOU CAN FILM AT THE SHERIFF'S OFFICE. UM, AND THEN THEY WANTED TO SHOOT A SCENE AT THE NEW COURTHOUSE, WHICH WILL MAINLY BE DONE OVERNIGHT. WHAT DANIEL WAS ABLE TO PUT TOGETHER, UM, TALKING TO THEM IS, UH, THEM COVERING ALL OF THE COSTS. SO THERE'S NO COST TO THE COUNTY. UM, THEY WILL BE ACCOMPANIED BY A DEPUTY THE ENTIRE TIME THEY'RE ON SITE. UM, THERE WILL BE SECURITY AND THEY'LL BE PAYING FOR ALL OF THAT SECURITY. UM, IT'S, IT'S ABOUT $4,000, UM, WORTH OF, AND, AND DANIEL IS OUR GENERAL COUNSEL. I'M SORRY, DANIEL IS OUR GENERAL COUNSEL. THANK YOU. UM, , UH, AND, AND SO THAT'S WHAT THIS CONTRACT IS. THEY WOULD BE FILMING, UM, IN THE HISTORIC COURTHOUSE ON THE FOURTH FLOOR ON 1211, FILMING AT THE SHERIFF'S OFFICE ON 1212 AND FILMING AT THE NEW COURTHOUSE ON 1213. SO THAT'S WHAT THIS CONTRACT IS. UM, THAT IS BEFORE YOU, UH, JUST A REMINDER TO THE COURT, UH, JUDGE KNEW THE DESK THAT YOU SIT AT WAS GIVEN TO US BY ANOTHER PRODUCTION COMPANY THAT FILMED HERE. UH, THEY USED THAT DESK IN THE FILMING BUT DIDN'T NEED IT AFTERWARDS AND GAVE IT TO THE COUNTY. UH, THAT'S THE DESK YOU HAVE. SO THEY HAVE FILMED IN THAT JAIL UPSTAIRS IN THIS GROUND. THE ONLY QUESTION I HAD, AND AND YOU'VE CLEARED IT THROUGH THE SHERIFFS, IS TAKING PICTURES OF THE JAIL FROM THE OUTSIDE. DOES THAT, UH, IN ANY WAY PUT THE JAIL IN ANY KIND OF JEOPARDY AS FAR AS BEING ABLE TO SEE SECURITY AND THINGS LIKE THAT? THEY ARE OWN, THEY, THEY ARE USING THE EMPLOYEE PARKING LOT AS AN IMPOUND. OKAY. THAT'S WHAT THEY'RE FILMING. THAT'S GOOD. SO, SO, SO JUST JUST SO YOU KNOW, I'LL GIVE YOU, SO WHAT HAPPENS IS, IS THAT THE MAIN CHARACTER OF THE MOVIE KIND OF BUSTS OUT OF JAIL AND USES THAT IMPOUND LOT AND DRIVES AWAY IN A 69 CORVETTE. IT'S ALL I KNOW. OH, , YOU'RE GONNA LEAVE THE CORVETTE WHEN YOU'RE DOING, THEY, THEY NEED TO LEAVE THE CORVETTE. THAT'S, THAT'S EXACTLY TRUE. SO WHO GETS IT? YEAH. YEAH. COURT. MY, MY COMMENT THE JUDGE, I GOT YOU GOT THE DESK. THERE'S, THERE'S NO NEED TO CHANGE THE PRECEDENT. WE, THAT MY, MY COMMENTS WOULD BE THERE IS NO FEE FOR THE USE OF THE FACILITIES. AND I RECALL THAT WE HAD SOME FEES ASSOCIATED WHEN THESE PRODUCTION TEAMS CAME IN BEFORE, SO THERE NEEDS TO BE A FEE IN THIS. OKAY. WE CAN'T CREATE WHAT WE HAVE TO OFFER. I, I AGREE. UM, AND, AND SO WE, WE, WE NEED TO, WE NEED TO COME IN WITH SOME KIND OF A FEE. OKAY, WELL THEN WE CAN JUST POSTPONE THIS AND, AND BRING IT BACK ON 1126 WITH SOME, WITH, WITH SOME FEES. SO, UH, MAYBE THE APPROPRIATE TIME FOR ME TO SAY I'M, AND I'M OKAY WITH THIS UNDER THE SPECIFIC INSTANCE, BUT EXCUSE ME, I'M, UH, AND JUST KIND OF HAVE A, MY, MY ONE INTERACTION WITH THE PRODUCTION COMPANY HERE HAS LEFT A BAD TASTE IN MY MOUTH. UM, YEAH. NO, NOT, I DON'T KNOW. THIS ONE, THE LAST ONE, YOU KNOW, WE HAD WHAT FELICIA, A DOZEN PEOPLE COME IN AND JUST SWARM THE COURTHOUSE, TAKE OVER. BO DIDN'T TELL ANYBODY THEY WERE COMING COME IN. I HAD TO RUN 'EM OUT OF THE SERVER ROOM. THEY'RE, THEY'RE BACK HERE. UH, JUST THE, THE, THEY WERE OUTTA CONTROL. YEAH. AND, AND JUST THOUGHT THEY WERE ENTITLED, UH, TO, TO BE HERE AND, AND, UH, TOOK FELICIA AND I A LITTLE BIT TO, TO RUN 'EM OUT AND, UH, SHOO 'EM ON DOWN THE ROAD. SO IT, IT IS INCREDIBLY DISRUPTIVE. AND, AND THAT'S WHAT I KEPT TELLING THEM, YES, PEOPLE ARE WORKING HERE, PEOPLE ARE, THEY HAVE A JOB, THEY'RE ACTUALLY DOING STUFF, AND YOU GUYS ARE, UH, JUST RUNNING OVER THE TOP OF US. SO ANY SITUATIONS LIKE THAT I'LL RESIST. BUT SPECIFIC INSTANCES, AND, AND THAT'S MY ONLY FEAR. IF WE SET UP A FEE SCHEDULE, THEN IT BECOMES A, A WAY OF MAKING MONEY. AND THEN THAT, THAT, THAT CHAOS IS, IS ACTUALLY, UH, INDUCED. THEY'RE ENTITLED. YEAH. THEY, THEY'RE VERY ENTITLED. NO, I, I, I THINK YOU CAN SCRIPT THAT IN THE USE OF THE FACILITIES AND, AND BE VERY CAREFUL IN THE, IN THE WRITING OF THAT, SO THAT THEY HAVE TO BE, UM, RESPONSIBLE FOR THE ACTIVITIES THAT THEY CAUSE, UH, WITHIN THE [00:55:01] COMMUNITY, BUT ARE WITHIN OUR FACILITIES. SO THAT'S, THAT'S SOMETHING THAT, THAT CAN BE ACCOMPLISHED. YEAH. I, I, I WOULD, I WOULD THINK WE WOULD HAVE TO, 'CAUSE THEY, THEY'RE GONNA, WHATEVER THE FEE IS, AND HE SAID SOME OF IT IS GOING TO BE DURING THE NIGHTTIME ALSO. OKAY. SOME OF THE FILMING. IS THAT CORRECT? YES. COMES IN CORRECT. OKAY. SO DO WE WANT TO, UH, I, I, I'M GOOD WITH NEGOTIATING SOME FEES, PUTTING IT IN, BRINGING IT BACK. THAT, THAT DOESN'T GIVE ME ANY HEARTBURN. I'M, I'M GOOD WITH THAT. ALL RIGHT. WELL, UH, WE WON'T TAKE ACTION ON AGENDA ITEM EIGHT AND [9. Discuss/Act Proposed Change Orders No. 07 and 08 to the agreement with Hill & Wilkinson Construction Group for the Rockwall County Annex project, and all related issues; (Commissioner Stacy)] WE'LL MOVE ON TO AGENDA ITEM NUMBER NINE, DISCUSS AND ACT ON PROPOSED CHANGE ORDERS NUMBER SEVEN AND EIGHT TO THE AGREEMENT WITH HILL AND WILKINSON CONSTRUCTION GROUP FOR THE ROCKWALL COUNTY ANNEX PROJECT AND ALL RELATED ISSUES. COMMISSIONER STACY, WHO'S GOING TO KICK THIS OVER TO BROADUS. HEY, HELLO AGAIN. I'M CHRISTIE WITH BROADUS. CHRISTY JONES. UM, SO WE DO HAVE A PCO, UH, NUMBER SEVEN. AND THIS IS, UH, CHANGES RELATED TO THE PERMIT DRAWINGS AND $14,718. THIS WILL COME OUTTA CONTRACTOR'S CONTINGENCY. CURRENTLY FOR CONTRACTORS' CONTINGENCY, WE HAVE, UH, $492,000 AND 600 490 $2,605. AND THIS IS FOR SEVEN AND EIGHT. UH, SEVEN AND EIGHT IS THE CHANGES FOR NUMBER EIGHT ARE DUE TO ADDITIONAL CAPACITY IN THE FOUR BOXES FOR ADDITIONAL POWER. YEAH. AND AV AND DATA AND THE ORIGINAL BOXES WERE TOO SMALL FOR ALL THE DEVICES, AND WE FOUND THAT OUT WORKING WITH OUR, UM, OUR AV CONSULTANT. AND THAT'S FOR $6,635, ALSO AT A CONTRACTOR'S CONTINGENCY. ALL RIGHT. SO, UM, I'LL JUST GO AHEAD AND MAKE A MOTION THAT WE APPROVE CHANGE ORDERS NUMBER SEVEN AND EIGHT. GOT A MOTION BY COMMISSIONER STACY SECOND. SECOND BY COMMISSIONER. SEVER. ANY FURTHER QUESTIONS OR COMMENTS? IF YOU'LL REGISTER YOUR VOTES? IT PASSES FIVE TO ZERO. ALL RIGHT. THAT BRINGS [10. Discuss/Act on Proposed Change Orders No. 9 through 12 to the agreement with Hill & Wilkinson Construction Group for the Rockwall County Annex project, and all related issues; (Commissioner Stacy)] US TO AGENDA ITEM NUMBER 10. ARE WE PULLING THAT OR ARE WE, THIS IS THE ONE THAT WAS INITIALLY PULLED, BUT THERE'S ONLY ONE CHANGE ORDER THAT ISN'T READY. AND IT, AND IT WENT OUT ON FRIDAY. SO IF, IF THE COURT WOULD LIKE TO SEE THIS COME BACK, WE CAN, WE CAN HAVE IT COME BACK. UM, AND ITS CHANGE ORDER IS NINE THROUGH 12, BUT IT'S ONLY CHANGE ORDER NINE THAT IS CURRENTLY BEING PULLED. OKAY. UM, WELL, I'M GONNA SAY, LET'S GO AHEAD AND, AND TALK ABOUT, UH, CHANGE ORDERS 10 THROUGH 12 AND WE'LL BRING NINE BACK. UH, SO I'M GONNA MOVE US TO AGENDA ITEM 10, DISCUSS AND ACT ON PROPOSED CHANGE ORDERS NUMBER NINE THROUGH 12 TO THE AGREEMENT WITH HILL AND WILKINSON CONSTRUCTION GROUP FOR THE ROCKWALL COUNTY ANNEX PROJECT AND ALL RELATED ISSUES, COMMISSIONER STACY. OKAY, SO FOR PCO 10, IT'S UH, FOR $2,687. AND THESE ARE, UH, MOVING THE CABLE TRAYS OUTTA THE PUBLIC CORRIDORS. SO THEY'RE, YOU KNOW, ABOVE FIXED CEILINGS. SO WHEN YOU WALK IN THE BUILDING, YOU'RE GOING, OH, LOOK, WIRE CABLE, TRACE . WE MET WITH, UH, UH, BARRY AND BRIAN CRENSHAW, AND THEY ARE IN SUPPORT OF MOVING THESE. SO IT'S $2,687 AND IT'LL COME OUT OF BUYOUT SAVINGS INSTEAD OF OWNER'S CONTINGENCY. MM-HMM, . AND THEN WHAT IS NUMBER 11? 11 IS A $0 CHANGE ORDER FROM THE MOCK-UP BUDGET ALLOWANCE TO THE ACTUAL COST OF WORK. UM, AND IT IS JUST A $0 CHANGE. IT'S JUST A, UH, THE, THE ACTUAL COST, AND I BELIEVE IT'S THE ACTUAL, OH, YEAH, THE ACTUAL COST IS PCO O 11. LET ME GO TO PCO 11. THE ACTUAL COST IS, UH, $7,805, BUT WE ARE, WE'RE JUST DOING A CHANGE. IT'S JUST AN ACCOUNTING CHANGE. UM, PCO O 12 IS, UH, $4,343 AND 60 CENTS ADDED BUYOUT SAVINGS. THIS, UH, WHEN WE WERE MEETING WITH, UH, DURING THE FURNITURE PROCESS, UH, ELECTION STORAGE IN THE MULTIPURPOSE ROOM NEEDED ADDITIONAL POWER FLOOR BOXES WITH ASSOCIATED WIRING AND TWO ADDITIONAL PHONE LINES. AND, UH, THAT'S ALL I HAVE FOR 10, 11, AND 12. ALL RIGHT, WELL, I'LL GO AHEAD AND MAKE A MOTION THAT WE APPROVE CHANGE ORDER. 10, 11, AND 12. ALL RIGHT. GOT A MOTION BY COMMISSIONER STACY. I'LL SECOND THAT MOTION. GOT A SECOND BY COMMISSIONER M**K. ANY FURTHER QUESTIONS OR COMMENTS? IF YOU'LL REGISTER YOUR VOTES? IT PASSES FIVE TO ZERO. [01:00:02] ALL RIGHT. [11. Discuss/Act Proposed Change Orders No. 13 to the agreement with Hill & Wilkinson Constructbn Group for the Rockwall County Annex project, and all related issues; (Commissioner Stacy)] THAT BRINGS US TO MY FAVORITE ONE, AGENDA ITEM NUMBER 11, DISCUSS AND ACT ON PROPOSED CHANGE ORDERS. NUMBER 13 TO THE AGREEMENT WITH HILL AND WILKINSON CONSTRUCTION GROUP FOR THE ROCKWALL COUNTY ANNEX PROJECT AND ALL RELATED ISSUES. COMMISSIONER STACY? YES. SO TELL US WHAT HAPPENED WHEN WE BOUGHT OUT THE CONTRACTORS? SO, UH, WHEN WE BOUGHT OUT THE CONTRACTORS, UM, WHEN THE CONTRACTOR DID THE ORIGINAL BUDGET, THEY ACTUALLY DID SOME ACTIVE COMMUNITY OUTREACH AND WE WERE ABLE TO SAVE $437,484 FOR THE COUNTY. AND THAT WILL GO BACK TO THE COUNTY, UH, TO BE USED ON ANOTHER ARPA PROJECT. MM-HMM, . AND ARE THEY, ARE THERE ANY MORE SUBCONTRACTORS THAT NEED TO BE BOUGHT OUT ON THIS? NO, WE ARE DONE. UH, WE HAD HOUSEKEEPING. WE HAD TROUBLE FINDING A, A CLEANER, A FINAL CLEANER, AND WE'VE DECIDED WE'RE JUST GONNA PAY THAT OUT OF GENERAL CONDITIONS. OKAY. ALL RIGHT. SO I'LL MAKE A MOTION THAT WE APPROVE, UM, CHANGE ORDER NUMBER 13. GOT A MOTION BY COMMISSIONER STACY. SECOND. SECOND BY COMMISSIONER. SEVER. ANY FURTHER QUESTIONS OR COMMENTS? IF YOU'LL REGISTER YOUR VOTES NOW, PLEASE. IT PASSES FIVE TO ZERO. ALL RIGHT. THANK YOU EVERYONE. [12. Discuss/Act on approving a formal estimate agreement from CMJ Engineering for providing Cold Formed Metal Framing Inspection services for the Rockwall County Annex Project, and all related issues; (Commissioner Stacy)] THIS BRINGS US TO AGENDA ITEM NUMBER 12, DISCUSS AND ACT ON APPROVING A FORMAL ESTIMATE AGREEMENT FROM CMJ ENGINEERING FOR PROVIDING COLD FORM METAL FRAMING INSPECTION SERVICES FOR THE ROCKWALL COUNTY ANNEX PROJECT AND ALL RELATED ISSUES. COMMISSIONER STACY, AND, UH, YOU PRETTY MUCH SAID WHAT IT IS. IT'S MORE CMJ, UM, INSPECTIONS, AND IT'S GOING TO BE $1,906 AND 50 CENTS. IT'S AN, IT'S AN EXTENSION TO THEIR CONTRACT. UM, IT HAS BEEN APPROVED BY OUR, OUR LEGAL, UM, AND IT'S A PRETTY NECESSARY THING, JUST KIND OF BASED UPON WHERE WE ARE IN THE PROCESS. SO, UH, I HAVE A QUICK QUESTION AND I'M NOT SURE WHO TO DIRECT THIS TO. SO, NOTE NUMBER TWO, IN THEIR CONTRACT TALKS ABOUT OVERTIME RATES. THE REGULAR RATE WILL BE CHARGED FOR HOURS WORKED AND SERVICES PERFORMED OVER EIGHT HOURS PER DAY, OR BEFORE 7:00 AM OR AFTER 5:00 PM I KNOW WE HAD LITTLE ISSUES OF CALLING IN FOR INSPECTIONS AND THEY WOULD START THE CLOCK FROM FORT WORTH OR SOME OTHER PLACE RIGHT. WHERE THEY WOULD HIT US FOR OVERTIME. CORRECT. AND WE'VE TRIED TO MITIGATE THAT BY, UM, CALLING IN OUR INSPECTIONS LATER IN THE DAY, OKAY. AND MAKING THEM SIGN IN AND NOT KEEPING THEM, UM, PAST A CERTAIN TIME IN THE AFTERNOON AND MAKING THEM SIGN OUT. SO IF WE DO HAVE OVERTIME, UH, THIS PARTICULAR, UH, CHANGE ORDER WILL BE FUNDED OUT OF THE CONSTRUCTION BUDGET. AND SO, UM, HILL AND WILKINSON WILL BE ISSUING A CHECK, UH, DIRECTLY TO CMJ FOR THIS WORK. GOT IT. GOT IT, GOT IT, GOT IT. OKAY. I JUST WANNA MAKE SURE THAT, THAT THE POTENTIAL IS STILL THERE. IT'S STILL THERE, YEAH. MAKES THE CALL AND, MM-HMM. AND THEY START THE CLOCK TICKING AND, AND WE END UP PAYING OVERTIME FOR WHAT WE WANTED DONE DURING BUSINESS HOURS, CORRECT. ? UM, SO EVERY, AS LONG AS EVERYBODY'S AWARE, AND IT SOUNDS LIKE WE ARE. ALL RIGHT, I'LL, I'LL ENTERTAIN A MOTION. I'LL MAKE A MOTION THAT WE APPROVE THE FORMAL ESTIMATE, UM, AN AGREEMENT FROM CMJ ENGINEERING FOR PROVIDING THE COLD FORMED METAL FRAMING INSPECTION SERVICES. GOT A MOTION BY COMMISSIONER M**K. I'LL SECOND. SECOND BY COMMISSIONER. STACY, ARE THERE ANY FURTHER QUESTIONS OR COMMENTS IF YOU'LL REGISTER YOUR VOTE? IT PASSES FIVE TO ZERO. THANK YOU. ALL RIGHT. THANK YOU. UH, LET'S SEE. I THINK WE'RE GONNA DO ONE MORE, THEN TAKE A QUICK RESTROOM BREAK, IF THAT'S OKAY WITH EVERYBODY. BUT LET'S [13. Discuss/Act on approving a Resolution nominating Commissioner Dana Macalik to the Texas Conferenceof Urban Counties Board of Directors and Policy Committee to fill theremainderof the current board term which ends December 2025, and all related issues; (Commissioner Bailey)] GET TO AGENDA ITEM NUMBER 13, DISCUSS AND ACT ON APPROVING A RESOLUTION. NOMINATING COMMISSIONER DANA, M**K TO THE TEXAS CONFERENCE OF URBAN COUNTY'S BOARD OF DIRECTORS AND POLICY COMMITTEE TO FILL THE REMAINDER OF THE CURRENT BOARD TERM, WHICH ENDS DECEMBER, 2025, AND ALL RELATED ISSUES, COMMISSIONER BAILEY. AND SO I, I SUPPORT, UH, THE RESOLUTION AND, UH, I MAKE A MOTION THAT WE RESOLUTION, I'LL SECOND IT. TURN YOUR MIC ON. PUSH THAT. SAY ALL THAT AGAIN. I'LL SAY ALL THAT AGAIN. OKAY. I, I'M GOING TO, UH, APPROVE OR, OR MAKE A MOTION THAT WE APPROVE THE RESOLUTION IN SUPPORT, UH, OF, UH, DANA, M**K TO, UH, GO ON THE, UH, CUC BOARD. GOT A MOTION BY COMMISSIONER BAILEY. I PULLED MY FIRST YES. AND I AND I SUPPORT THIS. AND I SECOND IT GOT A SECOND BY COMMISSIONER S SEVERE. SO, UNDER QUESTIONS OR COMMENTS, I, I NEED TO ASK. DO YOU WANT I DO. OKAY. ALL RIGHT. THAT'S RIGHT. I DIDN'T WANT MAKE SURE WE WEREN'T FORCING SOMETHING ON YOU. NO. SO I, I SUPPORT THIS AS WELL. UH, SO IF EVERYONE WILL REGISTER YOUR VOTES. YEAH. ALL RIGHT. SO IT PASSES FIVE TO ZERO. ALL RIGHT. THANK YOU EVERYONE. LET'S, LET'S [01:05:01] TAKE A 10 MINUTE BATHROOM BREAK. IT IS, WHAT TIME IS IT? IT IS 10 0 5. SWITCH IT BACK. ALL RIGHT. IT IS 10 16. WE'RE GONNA RECONVENE INTO OUR REGULAR COMMISSIONER'S COURT MEETING ON NOVEMBER 12TH, 2024. [14. Discuss/Act on omnibus Resolution regarding County Transportation, Development, Open space, and all related issues; (Commissioner Bailey)] WE ARE ON AGENDA ITEM NUMBER 14, DISCUSS AND ACT ON THE OMNIBUS RESOLUTION REGARDING COUNTY TRANSPORTATION DEVELOPMENT, OPEN SPACE IN ALL RELATED ISSUES. COMMISSIONER BAILEY. AND SO I'M GOING HAND THIS BACK TO YOU, JUDGE, IF I CAN HIT, HIT YOUR MIC THERE. I'M GONNA HAND THIS BACK TO, UH, YOU. THERE IT IS. OKAY. NOW I'M ON, UM, FOR, UH, A, I, I HAD, UH, RECEIVED SOME INPUT, UH, FROM A, UH, CITIZEN THAT, UH, WANTED TO ENHANCE THE, THE WORDING ON THAT. AND SO I'D, I'D LIKE TO YOU TO, UH, READ, READ IT INTO RECORD. READ IT IN INTO THE RECORD IF YOU WOULD PLEASE. YEP. WOULD, WOULD BE HAPPY TO. UM, BUT I'M GONNA ELEVATE HIS STATUS A LITTLE BIT. HE'S MORE THAN A, A CITIZEN. MR. LAUREN LI DIDN'T WANNA CALL, IS OUR COMMISSIONER ELECT IS WHAT HE IS. AND, AND, AND IT'S OKAY TO CLAP. IT'S OKAY TO CLAP. YEAH. UM, AND, AND THANK YOU LAUREN. I, I, AND COMMISSIONER BAILEY AS WELL AGREE WITH YOUR, YOUR, SO I'M JUST GONNA GO AHEAD AND READ THE WHOLE RESOLUTION, PLEASE. AND THEN I'M GOING TO ADD LAUREN'S EDIT AT THE BOTTOM, SO THE RESOLUTION OH, OKAY. RESOLUTION READS. WHEREAS ROCKWALL COUNTY IS A RAPID GROWTH AREA OF RESIDENTIAL AND NON-RESIDENTIAL DEVELOPMENT WITHIN UNINCORPORATED AREAS, ROCKWALL COUNTY WOULD LIKE TO HAVE A GREATER PREDICTABILITY AND PLAN FOR LANDS AND OPEN SPACE PRESERVATION WITH THE GOAL THAT GROWTH IS HAPPENING IN A COORDINATED MANNER. AND WHEREAS RESIDENT'S ABILITY TO SAFELY MOVE TO AND AROUND ROCKWALL COUNTY DIRECTLY IMPACTS RESIDENTIAL QUALITY OF LIFE AND COMMERCIAL VIABILITY. RESIDENTS WANT TO MINIMIZE THE TRAFFIC IMPACTS OF NEW DEVELOPMENT BY IMPROVING LOCAL COUNTY AND STATE ROADS. TEXAS LOCAL GOVERNMENT CODE SHOULD REQUIRE PROPORTIONALITY FROM DEVELOPERS TO FUND THE MAINTENANCE OF LOCAL SUBDIVISION ROADS BY REQUIRING MUNICIPAL UTILITY DISTRICTS, SPECIAL DISTRICTS, OR SPECIAL TAXING DISTRICTS TO MAINTAIN AND OPERATE LOCAL ROADS IN THE UNINCORPORATED AREAS. AND WHEREAS ROCKWALL COUNTY HIRED A STRATEGIC PLANNING CONSULTANT TO IDENTIFY AND PRIORITIZE ITS STRATEGIC GOALS, DURING THE DISCOVERY PHASE, OVER 11,000 CITIZENS PROVIDED FEEDBACK HIGHLIGHTING THE QUALITY OF LIFE AS A CRUCIAL FACTOR FOR PROMOTING LIVABILITY AND INNOVATIVE GROWTH IN THE COUNTY. AND EXPRESSED CONCERNS, AND EXPRESSED CONCERNS WERE THAT OVERDEVELOPMENT AND THE LACK OF OPEN SPACES ARE DETRIMENTAL AND POSE A THREAT TO OUR UNIQUE LOCAL CHARACTER. SO HERE'S WHERE LAUREN'S EDIT COMES IN. NOW, THEREFORE, BE IT RESOLVED THAT THE ROCKWALL COUNTY COMMISSIONER'S COURT HEREBY DETERMINES AND RESOLVES ALL REAL PROPERTY DEVELOPMENT IN THE UNINCORPORATED AREAS OF THE COUNTY, SHOULD BE COORDINATED TO HAPPEN IN A SAFE, ORDERLY, AND HEALTHFUL MANNER, WHICH WILL PROTECT AND PROMOTE THE HEALTH, SAFETY, MORALS, AND GENERAL WELFARE OF ROCKWALL COUNTY AND ITS CURRENT AND FUTURE RESIDENTS. AND THEN IT HAS OUR SIGNATURES THERE. SO, I, I AGREE WHOLEHEARTEDLY WITH THAT EDIT. SO, SO I'M GONNA MOVE THAT WE APPROVE THE RESOLUTION AS PRESENTED. I'LL SECOND THAT MOTION. ALL RIGHT. GOT A MOTION BY COMMISSIONER BAILEY, A SECOND BY COMMISSIONER. M**K, ARE THERE ANY FURTHER QUESTIONS OR COMMENTS? YES, SIR. I HAVE, I HAVE A QUESTION. OKAY. UH, WE TALK ABOUT THE SAFE SAFETY OF THE PEOPLE. WE TALK ABOUT DENSITY, AND WE ALSO TALK ABOUT ROADS AND BEING ABLE TO GET FROM POINT A TO POINT B, BUT YET WE GET A LOT OF OPPOSITION WHEN YOU PRESENT ROADS TO GET FROM POINT A TO POINT B. SO I'M CONFUSED ON HOW IS THIS RESOLUTION GOING TO AFFECT THOSE THINGS THAT WE'VE TALKED ABOUT IN A COORDINATED EFFORT COORDINATED WITH THE CITY, THAT THIS AFFECTS, THAT, THAT DEVELOPERS TURN THE MICROPHONE ON, THAT DEVELOPERS WILL INCORPORATE THEIR PROPORTIONALITY INTO THE DEVELOPMENT OF THESE ROADS. SO IT'S ONLY THE NEW PORTIONS OF THE SUBDIVISION PORTION TOWARDS THE ROADS TO GET 'EM IN AND OUTTA THE SUBDIVISION OR AROUND THE SUBDIVISION, IS WHAT THIS IS PERTAINING TO. CORRECT. [01:10:01] OKAY. ALL RIGHT. ANY FURTHER QUESTIONS OR COMMENTS? ALL RIGHT. LET'S START THIS VOTE AGAIN. IF EVERYBODY WILL PLEASE REGISTER YOUR VOTE. IT PASSES FIVE TO ZERO. THANK YOU, EVERYONE. AND THEN I'LL, I'LL GET, UH, I'LL GET THIS TO FELICIA AND SHE'LL, SHE'LL UPDATE IT AND GET US SOMETHING PRETTY TO SIGN LATER TODAY. [15. Discuss/Act on authorizing Innovative Transportation Solutions ("ITS") to begin negotiations with pre-qualified firm Pape Dawson for the FM1141 project from SH 66 to FM 552, and all related issues; (Commissioner Bailey)] [16. Discuss/Act on authorizing Innovative Transportation Solutions ("ITS") to begin negotiations with pre-qualified firm Othon for the SH 66 Interim Intersection Improvements Project, and all related issues; (Commissioner Bailey)] UH, THIS BRINGS US TO AGENDA ITEM 15, DISCUSS AN ACT ON AUTHORIZING INNOVATIVE TRANSPORTATION SOLUTIONS ITS TO BEGIN NEGOTIATIONS WITH PRE-QUALIFIED FIRM PAP DAWSON FOR THE FM 1141 PROJECT FROM SH 66 TO FM 5 52, AND ALL RELATED ISSUES, COMMISSIONER BY BAILEY. AND SO I TURN THAT BUTTON ON. I'M GONNA CALL JOHN POLLSTER, UH, TO COME FORWARD AND, UH, GIVE SOME EXPLANATION ON THESE TWO AGENDA ITEMS. UH, 15 AND 16 , JUDGE COMMISSIONER, THANK Y'ALL FOR LETTING ME BE HERE. UM, HOPE THE DAY FINDS YOU WELL, UH, ON BOTH THIS ITEM AND THE NEXT ITEM. THEY WERE PLACED ON THE AGENDA WITH THE ASSUMPTION THAT THE COURT WOULD, IN THIS, UH, SAME DAY, AUTHORIZE ISSUANCE OF THE ROAD BOND PROGRAM. SO, UNTIL THAT GETS RESOLVED, I THINK YOU NEED TO TABLE BOTH OF THESE ITEMS. THAT WOULD BE MY RECOMMENDATION. OKAY. SO I'M, I'M GOING TO MOVE THAT WE, UH, WE CAN TALK ABOUT 15, YEAH. 15 AND 16 THAT WE REMOVE 15 AND 16 FROM THE AGENDA. SO ARE YOU REMOVING FROM THE AGENDA OR TABLING, UM, YOUR, NO, WE WE'RE JUST GONNA, UH, REMOVE THEM FROM THE AGENDA, AND WE, WE'LL BE PUTTING THEM BACK ON ONCE THE COURT DECIDES WHAT THEY WANT TO DO WITH THE ISSUANCE, THEN WE'LL COME BACK TO THOSE. YES. SO I, I DO HAVE SOME QUESTIONS ABOUT YES, SIR. 15 AND 16. WE, WE HAVE A MOTION, THOUGH, UH, BY, BY COMMISSIONER BAILEY TO ESSENTIALLY TABLE THIS. IF YOU TABLE IT, DON'T YOU HAVE TO TABLE IT TO A DATE CERTAIN. SO WOULD IT BE BETTER TO, TO HAVE NO ACTION, OR THAT'S WHAT YOU NEED TO DO? IF YOU WOULD POSTPONE IT, YOU'D NEED TO POSTPONE TO A SPECIFIC DATE. OKAY. UM, TABLING I DON'T THINK IS WHAT YOU MEAN, THOUGH. I, I THINK WHAT THEN YOU'RE TALKING ABOUT IS REMOVING IT FROM ACTION. I WOULD, I WOULD REVISE MY MOTION TO TABLE THIS ITEMS 15 AND 16 TO, UM, THE NOVEMBER THE, THE, THE FOURTH, 26TH TUESDAY OF NOVEMBER 26TH. THAT'D BE THE 26TH. THE 26TH, CORRECT. I THINK WHAT YOU MEAN IS POSTPONE THERE. UH, IF YOU NEED TO POSTPONE IT TO, UH, TO THAT MEETING. OKAY. YES, SIR. I'LL, I'LL POSTPONE IT. OKAY. WE GOT A MOTION BY, BY COMMISSIONER BAILEY TO POSTPONE ITEMS 15 AND 16 SECOND. AND WE GOT A SECOND BY COMMISSIONER. SEVER QUESTIONS OR COMMENTS? I, I, I, I DO HAVE SOME COMMENTS AND, AND I THINK, UM, UH, EVERYBODY KNOWS THESE COMMENTS ARE COMING. UM, THESE PROJECTS AREN'T ON THE TRIP. 21 LIST THAT WE WENT AND SOLD TO THE CITIZENS. HERE'S THE PROJECTS THAT WE'RE DOING. AND, UH, IF, IF YOU'LL REMEMBER, I, I WAS THE POOR LITTLE COUNCILMAN IN HEATH THAT STOOD UP AND CALLED THE TRIP 21 A LIE, AND WAS JUST, UH, JUST ABOUT, HAD TO FIGHT MY WAY OUT OF THIS ROOM, UH, DURING A MEETING. UH, AND HERE, HERE WE ARE TRYING TO ISSUE OUR FIRST ISSUANCE AND LOOKING AT THREE PROJECTS THAT AREN'T ANYWHERE ON, ON THE TRIP 21 LIST THE LIST THAT WE SOLD TO THE VOTERS. HERE'S WHAT WE'RE GONNA DO, HERE'S THE PROJECTS. AND YET NOW WE'RE THROWING THAT AWAY AND, AND WE'RE DOING SOMETHING THAT IF THESE ITEMS WERE ON THE TRIP 21 LIST, IT'S MY OPINION THAT IT NEVER WOULD'VE PASSED. UH, SO WHAT, WHAT I, WHAT I BELIEVE WE'RE DOING, I, I IS WRONG. AND THAT'S, THESE ARE SIMPLEST WAYS, SORRY. THESE ARE YOUR FARM TO MARKET ROADS. OH, NO, I UNDERSTAND. BUT WE'RE TRYING TO ISSUE TRIP 21 DEBT THAT I'VE GOT A, I'VE GOT A SLIDE THAT CAN, CAN EXPLAIN THIS. IF I CAN JUST MOVE TO THE NEXT ONE, YOU'RE READY? SURE. AND, AND ESSENTIALLY, I WANTED TO SAY MY PIECE, WE, WE'VE GOT A MOTION AND A SECOND TO POSTPONE IT. I WOULD LOVE FOR YOU TO ANSWER THAT QUESTION IF YOU WANT TO, BUT I'M GONNA TELL YOU YOU'RE NOT REQUIRED TO, UH, BECAUSE I'M FAIRLY CONFIDENT THAT IT IS GOING TO BE POSTPONED. [01:15:01] BUT, UH, SO I'LL, I'LL LEAVE IT UP TO YOU. UH, I'VE GOT IT UP. SO I JUST GOT, YEAH. FI FIRE, FIRE AWAY. THAT'S TO THE NEXT FIRE. IT'S ON THE BACK END OF THIS PRESENTATION. SO I'LL JUST JUMP FAST. OKAY. SO WHAT YOU'RE LOOKING AT HERE IS YOUR TRIP OH EIGHT BOND PROGRAM. AND YOU'LL NOTE THAT THE FIRST FIVE PROJECTS HAVE ORIGINAL BOND COMMITMENT. THOSE ARE THE FIVE PROJECTS THAT THE, UH, PUBLIC VOTED ON. BUT WHEN WE WENT OUT TO THE, UM, UH, ELECTORATE, WHEN WE, EVERY TIME WE SAY WE HAD A LIST, WE'D CALL IT AN ANTICIPATED LIST AND ANTICIPATED AMOUNTS, AND THAT, UH, BOND COVENANTS ALLOW US, IF WE SEE HAVE UNFORESEEN SITUATIONS, WE'RE ABLE TO MODERATE THAT BOND PROGRAM. SO THE NEXT 13 PROJECTS, UH, ON THIS LIST, UH, WERE PROJECTS THAT WERE ADDED AND USED ON THE TRIPLE EIGHT BOND PROGRAM, MOSTLY COMING FROM SH 66 WHEN WE COULDN'T GET AN AGREEMENT, UH, FROM ROY CITY TO DO A COUPLE, WHEN WE WERE DOING THE ULTIMATE IMPROVEMENTS FOR, UH, 66, THE COURT AT THAT TIME DECIDED TO PUT THAT ON THE BACK BURNER AND, UH, FOCUS ON I 30. AND SO THEN YOU'LL SEE I 30 IS ONE OF THOSE PROJECTS THERE. AND SO THE BOND PROGRAM, UH, GOES OUT AND SAYS, THIS IS WHAT WE THINK IS GONNA HAPPEN. BUT YOU HAVE TO HAVE FLEXIBILITY BECAUSE FIVE MINUTES AFTER YOU VOTE THE BOND PROGRAM, SOMETHING HAPPENS. SO YOU LEGALLY CAN, AND WHAT WE'VE, THIS IS HISTORICALLY WHAT Y'ALL HAVE DONE IS WHEN SITUATIONS COME UP, YOU ADAPT TO IT. YEAH. NOPE. I SAID I GOT ONE MORE. OKAY. UH, THIS IS THE 66 I WAS TALKING TO YOU ABOUT. IT STARTED WITH $30 MILLION. I'M SORRY IT'S SMALL, I COULDN'T GET IT ANY BIGGER. BUT ESSENTIALLY ALL THOSE ARE TRANSFERS OUT THAT 30 MILLION OUTTA 66 FOR ALL THOSE PROJECTS LISTED THAT WEREN'T ON THE BOND PROGRAM, OR IF THEY WERE ON THE BOND PROGRAM AND NEEDED A ADDITIONAL FUNDS BECAUSE OF A COST OVERRUN. SO WE JUST USE THAT MONEY TO FUND OTHER PROJECTS THROUGHOUT THE LENGTH OF THE TIME OF THE BOND PROGRAM. AND, AND MR. POLLSTER, YOU'RE REFERRING TO THE 2008 BOND PROGRAM RIGHT. NOW, WHAT'D I SAY? BUT YOU DID. I YES, YOU DID. I WANNA CONFIRM THAT. OH, SO THE IN THE POINT IS, IS THAT YOUR TRIP 21, UH, CAMPAIGN MATERIAL IS, IS IDENTICAL. IT SAYS ANTICIPATE THE LIST SET, ANTICIPATE, UH, AND THEN YOUR BOND COVENANTS ALLOW YOU THE FLEXIBILITY TO, UH, ADJUST AS THINGS CHANGE. WELL, AND JUST TO ADD TOO, NOT, UH, THAT WE'VE DONE SOME OF THE TRIP 21 PROJECTS. WE'VE USED 2008 MONEY TO PAY FOR IT BECAUSE WE HAD AVAILABLE FUNDING. SO WE'VE FLEXED THE MONEY IN THE PAST. I MEAN, WE'VE USED 20, WE USED 20, 21 PROJECTS AND FUNDED THEM WITH 2008 FUNDS. I, I, I AGREE. WHAT I DON'T AGREE WITH, AND WHAT I WILL NOT AGREE WITH, IS THAT YOU CAN TELL PEOPLE YOU'RE GOING TO DO SOME SETS OF ROAD KNOWING THAT YOU'RE NOT GOING TO DO THOSE ROADS, THAT YOU'RE GOING TO USE THAT TO DO ANOTHER ROAD. THAT IF YOU BROUGHT IT TO THE FOREFRONT, IF OUTER LOOP, SOUTHERN PART OF THE OUTER LOOP WAS ON THE TRIP 21, IT WOULD'VE FAILED THAT THAT BOND WOULD'VE FAILED. SO NOW WE DON'T PUT IT ON THERE. WE PUT THIS LIST ON HERE KNOWING THAT WE'RE NOT GONNA DO SOME OF THOSE THINGS, BUT, BUT WE'RE LEADING WITH THE LIST, AND I HAVE THE LIST THERE. AND I THINK IT'S A LITTLE BIT DIFFERENT THAN, THAN, THAN THIS LIST. THERE'S MONEY TUCKED AWAY EVERYWHERE THAT NOW WE'RE TRYING TO USE FOR AN OUTER LOOP THAT THE CITIZENS DON'T WANT. WE, WE'VE ESSENTIALLY DECEIVED THEM WITH, HEY, LOOK AT THIS, KNOWING THAT WE'RE GONNA SPEND IT ELSEWHERE. I, WE, WE CAN TALK ABOUT HOW ROADS WORKS, HOW BONDS WORK, HOW EVERYTHING WORKS. FUNDAMENTALLY, WE CAN'T LIE TO THE VOTERS TO GET 'EM TO APPROVE SOMETHING KNOWING WE'RE GOING TO DEVIATE. WE CAN'T DO THAT. I'M, I'M AGAINST THAT. IT, IT, IT WAS A LIE. TELL ME, SO COMMISSIONER BAILEY AND I HAD THIS CONVERSATION, JUDGE, FINISH TALKING ABOUT, LEMME FINISH, AND THEN, THEN YOU CAN FINISH. WE HAD THIS CONVERSATION WHEN I WAS A, JUST A, A LITTLE COUNCILMAN IN HEATH AND, AND COMMISSIONER BAILEY WHO GAVE ME THIS PLAN, SAID, STOP CALLING IT A LIE. AND MY QUESTION WAS, IT IS DESIGNED TO DECEIVE, WHAT SHOULD I CALL IT? GIVE ME A MORE APPROPRIATE WORD. SO, GO AHEAD, MR. POLLSTER. I WAS JUST GONNA REMIND YOU THAT WE'RE TALKING ABOUT 15 AND 16, WHICH ARE THE TWO FARM TO MARKET PROJECTS RIGHT NOW. I'M JUST SAYING WE NEED YES, SIR. YES, SIR. I, THE NEXT ITEM IS YOU CAN I AGREE? CAN WE GO AHEAD? YEAH, YEAH, WE CAN. WE CAN. SO, UM, NO FURTHER COMMENTS. LET'S GO AHEAD AND, AND SO THE VOTE IS TO TABLE 15 OR POSTPONE 15 AND 16. SO IF YOU'LL REGISTER YOUR VOTES, UH, DO Y'ALL NEED TO MOVE THAT? YEAH, SORRY. [01:20:01] ALL RIGHT. SO IT PASSES FOUR TO ONE. SO 15 AND 16 ARE NOW OFF THE TABLE. NOW WE'RE ON 17 DISCUSSION OF A CONTRACT FOR ENGINEERING SERVICES, SUPPLEMENTAL AGREEMENT NUMBER ONE WITH HALF AND ASSOCIATES FOR ROCKWALL COUNTY OUTER LOOP, PHASE TWO, SEGMENT OF THE PROJECT, AND ALL RELATED ISSUES. COMMISSIONER BAILEY. OKAY. NOW, AGAIN, REFER TO THE POLLSTER AGAIN. THANK YOU. I'LL AGAIN REFER TO MR. POLLSTER. OKAY. THANK YOU FOR YOUR TIME. UH, I'VE GOT A POWERPOINT, UH, THOSE ALONG WITH MY COMMENTS. AND THE INTENT OF THESE COMMENTS ARE TO PROVIDE YOU WITH THE INFORMATION SO THAT WHEN YOU DISCUSS WHAT YOU WANT TO DO ON THE OUTER LOOP, YOU'LL HAVE THE FACTS. SO, UH, ONE OF THE FIRST, UH, SPEAKERS SAID, WHY ARE WE HAVING TO MESS WITH THE OUTER LOOP? AND SO I'M GONNA, STARTING WITH THIS CHART. THIS IS YOUR DEMOGRAPHICS. GOES ALL THE WAY FROM 9 18 19, I MEAN 1920S, ALL THE WAY TO 2024. AND YOU'LL SEE ABOUT 2000 THE, UM, GROWTH IN ROCKWELL COUNTY SPIKED. WE WERE, I'LL GO BACK TO THAT IN A SECOND. SO, THE POPULATION OF ROCKWELL COUNTY AND IN, UH, 2024 IS ESTIMATED TO BE 139,000 AND SOME CHANGE RESIDENTS. AND IT'S 147% INCREASE FROM THROUGH THE 56,000 RESIDENTS WHO LIVED IN ROCKWELL COUNTY IN 2004. AND JUST FOR COMPARISON, THE COUNTRY GREW AT 13% IN STATE GRID 34. SO YOU'VE GOT A LOT OF ISSUES THAT ARE GONNA BE, UH, IMPACTING YOU. AND I WANNA GO BACK TO THIS ONE. IF YOU'LL NOTE AT THE BOTTOM, YOU'LL SEE THAT THEY HOLD AFTER, AFTER 23. THEY HOLD IT AT 7, 9 6 5, 7, 9, 6 5, ALL THE WAY UP TO 2029. AND THAT'S A UNDERESTIMATE BASED ON CURRENT, UH, DATA FOR 2024. WHAT THAT MEANS IS IN FIVE YEARS, YOU'RE GONNA HAVE A CITY OF 40,000 PEOPLE MOVE TO YOUR COUNTY, UH, WITHOUT YOUR CONSENT. BUT THEY'RE GONNA COME. AND SO I DON'T KNOW WHERE YOU'RE GONNA PUT A 40,000 CITY POPULATED CITY IN YOUR, IN YOUR COUNTY, AND THEN PUT 'EM ON THE ROAD. SO THAT'S, THAT'S, THAT'S THE FACTS. THE COUNCIL OF GOVERNMENTS HAS DONE THE, UH, 2050 MOBILITY, AND THE REGION IS PROJECTED TO GROW FROM 8.5 MILLION TO EITHER 12.5 TO 14.5. AND WHAT YOU'RE SEEING ON THE RIGHT OR THE LEFT ARE THE, IN THE INTENSITY SECTORS, RURAL, SUBURBAN, URBAN, OUTER BUSINESS, CENTRAL BUSINESS IN 2019. AND YOU CAN SEE IN ROCKWALL, YOU LOOK AT CLOSE UP, I'D SAY ABOUT 40%. AND 2019 WAS COVERED BY URBAN AND SUBURBAN QUADRANTS. IN 2050, YOUR PROJECTION IS GONNA BE, PROBABLY 80% OF YOUR COUNTY IS GONNA GO EITHER SUBURBAN OR URBAN, UH, AND TRY TO CONTROL THE GROWTH ALL YOU CAN. BUT, UH, THAT'S, THAT'S YOUR FUTURE. AND SO WHAT I WOULD, WHAT I ALSO WANNA TALK TO YOU IS WE'VE GOT A LOT OF PROJECTS. WE GOT, UH, IMPROVED WITH OUR BOND PROGRAM, UM, OVER THE LAST TWO BOND PROGRAMS WE'VE DONE. AND WE'VE DONE, UH, A SIGNIFICANT INCREASE IN INFRASTRUCTURE DURING THOSE, THAT 20 YEAR PERIOD. UH, AND IF, IF THE ROCKWELL COUNTY WANTS TO STAY AHEAD OF THAT CONGESTION, THAT'S COMING, UH, UM, PROJECTS LIKE 2 0 5 66, 5 52, 11 41, 5 48 FM 35 FM 5 51, 2 76, AND 39 7, ALL NEED TO BE INCREASED TO THEIR ULTIMATE CAPACITY HAS DEPICTED ON YOUR THIRD FAIR PLANS. AND IF YOU PULL THE OUTER LOOP, WHICH IS Y'S CHOICE TO DO ALL THAT TRAFFIC, THAT'S, THAT'S CUT THROUGH, WHICH CUT THROUGH COMMUTER TRAFFIC IS GONNA GO ON THOSE ARTERIALS THAT ARE ALREADY GONNA BE MAXED OUT BY 2050. AND KEEP IN MIND, ON THE PARTNERSHIP SIDE, THE REGION IS BUILDING A REGIONAL LOOP IN FIVE COUNTIES. AND THEY, UH, BACK IN, I THINK IT WAS 2021, UH, THE COUNTY PARTNERED WITH THE REGION TO ENVIRONMENTALLY CLEAR THE OUTER LOOP, NOT BUILD IT CLEAR IT JUST TO PRESERVE THE CORRIDOR FOR THE FUTURE. AND BASED ON THAT COMMITMENT, THE REGION FUNDED $256 MILLION WORTH OF PROJECTS, 51 MILLION ON 5 49, 67 0.9 MILLION ON 2 0 5 MIDDLE. IT'S GONNA GO LET NEXT YEAR AND 137 MILLION WITH SOUTHERN PART OF 2 0 5. THAT'S IN ROCKWELL COUNTY. [01:25:01] ROCKWELL COUNTY WOULD BE HARD PRESSED TO, TO GET ANY OF THOSE PROJECTS THAT I JUST MENTIONED DONE IF THEY TURN THEIR BACK ON THAT PARTNERSHIP THAT THEY MADE WITH THE REGION. SO ONE OF THE THINGS I WANTED TO TALK TO YOU ABOUT IS I'M HERE TO JUST GIVE YOU THE FACTS. AND, AND ALL OF Y'ALL HAVE BEEN, UH, MET WITH, UH, THE, AT THE RTC AND THE, UH, TEXTILE DISEASE PROJECTS. AND YOU KNOW THAT THE PROJECT IS CRITICAL TO THE REGION. BUT BEFORE YOU DECIDE TO ABANDON THE CLEARANCE OF THE REMAINDER OF THE OUTER LOOP, I THINK YOU SHOULD CONSIDER THAT. THE SECOND WHY ON WHY WE NEEDED THIS PROJECT IS, UH, IT'S IN THE 2045 MOBILITY, AND IT'S GONNA BE IN THE 2050 MOBILITY, WHICH MEANS THE RTC, THE, THE, AND, UH, TECH STOCK FEDERALLY HAVE TO PURSUE THAT PROJECT AND GET IT CLEARED. AND AT SOME POINT WHEN IT'S NEEDED BUILT, SO OPPOSITION TO THIS ALIGNMENT WHERE THIS PROJECT ONLY DELAYS IT, IT DOESN'T STOP IT. AND AT THE END OF THAT PROCESS, ALL YOU'LL END UP WITH IS THE OUTER LOOP CLEARED AND YOUR PARTNERSHIP WITH YOUR FUNDING PARTNERS BROKEN. AND THAT'S IT. PUT IT IN DOWN. DO, DO, UH, DO WE HAVE ANY QUESTIONS? YOU NOW GO GO AHEAD, COMMISSIONER. NOW'S THE TIME TO ASK QUESTIONS. WELL, I DON'T KNOW THAT I'D NECESSARILY, MY QUESTION, UM, IS, YOU, YOU, YOU SAID THAT THIS HAS ALREADY BEEN ON THE WORKS, AND I HAVE IN MY OFFICE, A A BIG POSTER THAT WAS EITHER DONE FROM THE, FROM THE COG OR FROM OUR GIS DEPARTMENT THAT'S DATED 2000 AND MARCH OF 2008, AND IT HAS THE OUTER LOOP ALREADY PLANNED IN 2008. THIS IS NOT SOMETHING THAT HAS JUST HAPPENED. AND I KNOW, I KNOW, UM, MR. POLLSTER, YOU SAID THAT WE APPROVED IT, I THINK IN 20, UM, THE CONTRACT, RIGHT? FOR THE FIRST HALF. FOR THE FIRST HALF. BUT I MEAN, THIS HAS BEEN IN THE WORKS SINCE 2003 OR, OR SEVEN OR EIGHT. IF THAT'S NOT, THAT'S MY UNDERSTANDING. AND I HAVE A BIG POSTER THAT KIND OF ACTUALLY SHOWS IT DESIGNED AND IT SHOWS PRETTY MUCH, IT'S VERY, IT HASN'T, VE VEERED A WHOLE LOT FROM WHAT I'M SEEING. SO WHAT DROVE IT TO BE INITIATED, AND IT'S BEING DONE IN DENTON, CALLING ROCKWELL KAUFMAN AND ELLIS COUNTY ALL ARE ACTIVELY ENVIRONMENTALLY CLEARING THEIR ALIGNMENTS. WHAT SPURRED THAT ON IN 21 WAS COVID IN 20 PEOPLE SPREAD AND THEY WENT OUT. AND SO WHAT COG IS SEEING IS THE PERIMETER COUNTIES ARE GOING FASTER THAN THE CORE COUNTIES. AND SO COG NOTICED THAT AND SAID, WE GOTTA GET MOVING ON THE OUTER LOOP. AND SO EACH OF THE COUNTIES WERE ASKED TO MOVE FORWARD WITH IT. AND THE REGION SAID, IF YOU TAKE THE LEAD, WE WILL FUND PROJECTS AT A FASTER PACE THAN WE OTHERWISE WOULD BECAUSE WE KNOW THE DEVELOPMENT'S COMING. SO, UM, THAT'S WHAT EVERYBODY DID. AND THEN THE ONLY OTHER THING I'M GOING TO COMMENT ON IS THAT YOU, YOU'VE HEARD ME SPEAK ABOUT THE, THE STRATEGIC PLAN FOR 2050 FOR ROCKWALL COUNTY. AND, UM, WE DID A INTENSIVE EN ENGAGEMENT WITH OUR COMMUNITY, AND WE RECEIVED NOT JUST A LITTLE SHY OF 12,000 COMMENTS FROM OUR CITIZENS, WHETHER THEY WERE ON THE SURVEY OR THEY ATTENDED SOME OF THE, THE, UM, THE ACTUAL EVENTS THAT WE HAD. AND AS WE'VE ALL SAID, THE NUMBER ONE AND NUMBER TWO COMMENTS WERE DENSITY AND THE EFFECTS OF IT ON THEIR QUALITY OF LIFE. BUT THEN THE TRANSPORTATION, THE INFRASTRUCTURE OF OUR ROADS, THOSE WERE THE TWO TOP THINGS. THIS, FROM WHAT I'M HEARING, THIS IS GOING TO BE COR COMPLETED SOMETIME AROUND 2047, WHETHER ROCKWELL'S IN IT OR NOT. IS THAT, THAT'S KIND OF THE TIMELINE I'VE, I'VE BEEN TOLD. YEAH. SO WHAT THEY DO IS IN THE, IN THE 2050 MOBILITY, THEY, WHEN IT SAYS BASELINE, WHAT THAT MEANS IS BY 2050, EVERYTHING THAT'S IN THE PLAN IS BUILT. MM-HMM. . AND THEY PUT 'EM IN THE YEARS. 'CAUSE WE ARE IN A NON-ATTAINMENT, UH, REGION, AND YOU HAVE TO PUT THOSE IN A YEAR AND YOU CAN'T OPEN THEM BEFORE THAT YEAR. OKAY. UH, BECAUSE OF THE AIR QUALITY ISSUES. AND SO THAT'S WHY IT'S OUT THAT FAR. BUT IF YOU WAIT UNTIL 20, 40, 40 TO START WORKING ON IT, WE'VE GOT A 1213 MILE LONG CORRIDOR WITH LESS THAN ONE DISPLACEMENT PER MILE. MM-HMM. , YOU GO TO COLLIN COUNTY WHERE THEY WAITED TO THE LAST MINUTE TO DO THEIR OUTOF LOOP, THEY'VE GOT 300 DISPLACEMENT FOR ABOUT THE SAME LENGTH OF, OF THAT DISTANCE. AND THAT'S AWESOME. SO WHAT WE'RE DOING IS WE'RE DOING IT AT THE RIGHT TIME. MM-HMM. . AND THEN IT'LL LAY FALLOW THERE. MM-HMM. FOR 10, 12 YEARS. BUT IT'LL BE AVAILABLE WHEN EVERYBODY THAT'S COMING IN AFTER THE PEOPLE ARE HERE. MM-HMM. . AND THEN THE CONGESTION GETS REALLY BAD AND WE GO, WE WISH WE HAD A WAY TO SOLVE IT. IT'LL BE THERE WAITING FOR YOU. CORRECT. AND I SUPPORT YOUR, YOUR POPULATION NUMBERS. I HAD DONE SOME HISTORY [01:30:01] MYSELF AND, UM, IN 2007 AND EIGHT, WHEN THAT POSTER I WAS JUST TALKING ABOUT, WE HAD A POPULATION OF ABOUT 70,000 IN THE COUNTY. UM, YOUR NUMBERS ARE RIGHT ON WITH WHAT YOU, YOU'RE SHOWING. AND 2047 THROUGH THE, THROUGH THE, UM, THE DEMOGRAPHERS FOR ROCKWELL COUNTY, WE WILL BE RIGHT AT ABOUT 250,000. SO THAT SHOWS THE GROWTH AND THE ROADS WE ARE REPAIRING OR THAT ARE ON THE TRIP OH EIGHT OR, OR THE 2008 BOND OR THE TRIP 21. THOSE ARE GOING TO NEED MORE IMPROVEMENTS AT THAT TIME ALSO. SO WE'RE TRYING TO, WE'RE TRYING TO STAY AHEAD OF IT AND NOT BE REACTING WHEN THIS, WHEN WHEN WE HAVE NEARLY 250,000 PEOPLE, WHICH BY THEN WE WON'T, WE WON'T BE ABLE TO. SO ONE FINAL NOTE ON, AND THEN I Y'ALL CAN, Y'ALL ARE GONNA FIGURE OUT WHAT YOU'RE GONNA DO IS EACH OF Y'ALL, EACH COMMISSIONER AND JUDGE HAD A STRATEGIC, UH, FUNDING IN 2021 THAT THE VOTERS SAW ON THE LIST AND APPROVED. BECAUSE THAT'S FOR THINGS THAT ARE UNFORESEEN, UH, THAT YOU NEED TO DEAL WITH QUICKLY IN YOUR PRECINCT. WHETHER IT'S A SIGNAL IF SOMEBODY GETS KILLED OR A TURN LANE OR ARE A WIDENING OF A ROAD BECAUSE THE SCHOOL'S COMING IN, THAT'S WHAT THAT'S FOR. BUT IN THE ACTUAL LIST, THE VOTERS SAW BEFORE THEY VOTED IN PRECINCT THREE, THERE WAS A PROJECT CALLED TO BE DETERMINED, AND IT HAD $9 MILLION IN THAT ACCOUNT. SO THE 61.2% PEOPLE THAT VOTED FOR THAT BOND PROGRAM SAW THE 9 MILLION TO BE DETERMINED. AND THAT'S FOR Y'ALL TO DETERMINE, OH, JOHN, UH, IF YOU HAD WROTE THE WORDS OUTER LOOP ON THAT, Y I'M TELLING YOU THAT THAT BOND WOULD'VE FAILED. SO IF YOU REMEMBER, WHAT HAPPENED WAS THERE WAS A ROAD THAT HEATH STAFF PROVIDED US. THERE WAS A BA IT WAS GONNA BE A REROUTE OF SEVEN 40 AND IT WAS GONNA COST ABOUT 9 MILLION. OUR PART WAS GONNA BE ABOUT $9 MILLION ON THAT. HEATH CAME TO US AND SAID, WE DON'T WANT THAT ROAD. SO INSTEAD OF TAKING THE MONEY OFF THE BOND PROGRAM, WE SIMPLY TOOK THE, THE, THE BACK ROAD, THE REALIGNMENT OFF, AND LEFT THE MONEY THERE AND FREED THE COURT TO DECIDE WHAT THEY WANTED TO DO IN THE FUTURE. I I, I'M JUST TELLING YOU, IF WE TAKE TO THE VOTERS, DO YOU WANT THE OUTER LOOP? IT, IT IS NOT GONNA BE CLOSE. AND I MEAN, I I GET IT, JUDGE. BUT JUST ONE LAST THING. Y'ALL ARE HERE TO, TO BE STATESMEN. AND IF YOU, THEY HAVE THE INFORMATION THAT YOU HAVE ON ALL THIS INFORMATION THAT YOU'VE SEEN, IT'S COMING. IF YOU DON'T WORK, IF YOU DON'T DEAL WITH IT, IT'S, IT'S, IT'S, IT'S JUST AS BAD. I, IF, IF THEY HAD THE INFORMATION I HAVE, THEY WOULD BE RIGHT HERE WITH ME WANTING TO RETIRE THIS DEBT BECAUSE IT'S DISHONEST AND, AND PUT AN HONEST BALLOT OUT TO THE PEOPLE AND LET THEM VOTE ON ACTUALLY WHAT WE'RE GONNA DO WITH THE MONEY. THAT, THAT'S WHAT I WOULD DO. SO I HAVE A COUPLE QUESTIONS, AND THEN I KNOW YOU HAVE SOME QUESTIONS AND I DON'T KNOW IF COMMISSIONER STACY HAS QUESTIONS OR NOT. UM, NOW DON'T RUN OFF. JOHN, THESE ARE QUESTIONS FOR YOU, JOHN. I GOTTA GET MY WATER. OKAY, I'LL, I'LL, I'LL, I'LL ASK IT. CUT NOW. SLOWLY. UM, SO 2008, YOU KNOW, UH, COMMISSIONER M**K REFERENCED THAT, YOU'VE REFERENCED THAT. AND, AND I'VE ASKED, THIS'LL BE THE THIRD TIME I'VE ASKED THIS QUESTION, UH, ONCE VERBALLY, ONCE IN WRITING, WHO WAS IN THAT ROOM NEGOTIATING ON BEHALF OF ROCKWALL COUNTY IN 2008? WHAT COUNTY WHAT WHAT NEGOTIATION. SO WHERE, WHERE THE OUTER LOOP'S GONNA GO? THE, THE, ALL THE COUNTIES ARE GETTING TOGETHER. WHO WAS OUR PERSON IN THE ROOM NEGOTIATING? SO WHEN WE DID THE, UH, Y'ALL HAD, UM, SOMEBODY DO YOUR ORIGINAL THOROUGHFARE PLAN. AND THEN WE BROUGHT IN FREEZE NICHOLS, I THINK. I THINK YOU STILL HAVE 'EM. YEAH. FREEZING. AND THEY PUT THAT IN AND THEN THE COURT APPROVED IT. SO EVERYBODY WAS IN THE NEGOTIATIONS AND WE GOT INFORMATION. AT ONE POINT, THE OUTER LOOP WAS HALF IN FATE AND HALF IN ROY CITY AT THAT TIME. FATE SAID WE'D RATHER IT NOT BE IN OUR CITY LIMIT. SO WE MOVED IT FROM WHATEVER THAT ROAD WAS THAT WAS GONNA BE AN I 30 TO FLOYD, WHICH WAS THE ROAD THAT ROY SAID THEY WANTED TO HIT. AND WHEN WE WE'RE DOING I 30 RIGHT NOW, THERE WILL BE A, UH, DIRECT CONNECT FOR THE OUTER LOOP AT I 30 THEY'RE BUILDING TODAY. 'CAUSE THAT WAS A NEGOTIATION BETWEEN THE COUNTY FATE. AND ROY CITY, TXDOT ACKNOWLEDGED IT AND THEN MOVED THE DIRECT CONNECTS FROM WHERE IT WAS TO FLOYD ROAD. SO EVERYBODY'S BEEN INVOLVED. SO, UH, FREEZE AND NICKEL WAS THE ONE NEGOTIATING FOR THE COUNTY. I DON'T KNOW WHAT WELL, SO WHEN, WHENEVER WE TALK ABOUT WHERE, WHERE'S A, AN OUTER LOOP GONNA GO AND, AND WE'VE GOT THIS COLLECTIVE OF, OF COUNTIES, EACH COUNTY HAS TO HAVE A SAY IN THAT, UH, THE COUNTY, WHEN YOU DO A THOROUGHFARE PLAN, THE COUNTY GOES OUT TO EACH CITY IN YOUR JURISDICTION AND SAYS, GIMME YOUR THOROUGHFARE PLAN. LET, YOU CAN DO WHAT YOU WANT ON YOUR THOROUGHFARE PLAN, BUT WE GOTTA MAKE SURE THE UN UNINCORPORATED AREAS TIE IN TO EACH OTHER. AND SO, FREEZE NICHOLS WENT TO ALL THE CITIES, AND THEN THE CONSORTIUM, WE WOULD TALK ABOUT [01:35:01] ISSUES. AND FIVE MINUTES AFTER Y'ALL, UH, ADOPTED THE THOROUGHFARE PLAN, ROCKWALL DECIDED TO REDUCE 5 49 FROM SIX LANES OF FOUR, WHICH THEY CAN DO. AND UH, THEN THERE WAS A WHOLE NEGOTIATION CONVERSATION WITH COMMISSIONER MAGNUS ABOUT, YOU KNOW, BEFORE YOU GO MAKE, MAKING CHANGES UNILATERALLY TO SOME OF YOUR FER PLANS, YOU GOTTA BRING IT TO THE CONSORTIUM SO WE CAN TALK ABOUT IT. BUT THE, A LOOP'S BEEN ON FOREVER. IT WAS, IT WAS CLEARLY DISCUSSED IN THE CONSORTIUM MEETING. SO I, ALL OF THE CITIES, I, I, I'M STILL YES. PROPOSED, CORRECT. STILL, STILL NOT GETTING THE, THE ANSWER WHO NEGOTIATED OUR BEHALF. SO, UM, I I THINK HE JUST SAID A NAME DID, BUT WASN'T, WASN'T COMMISSIONER MAGNUS KIND OF HEADING THAT UP AT THAT TIME TOO? I'M NOT SAYING HE NEGOTIATED, HE'S NOT HERE TO TO, BUT BUT HE WAS INVOLVED IN THAT, WASN'T HE? OKAY. SO I'LL GO AHEAD. SO MY, MY NEXT QUESTION, UH, HOW MANY OF OUR CITIES HAVE BEEN THREATENED BY THE RTC RECENTLY? I DON'T THINK ANY OF THEM HAVE BEEN THREATENED. I MEAN, IF YOU KNOW SOME, YOU CAN LET ME KNOW. OKAY. AND, AND, AND SO I THINK WHAT YOU'RE ALLUDING TO IS, IS THAT IN 20, IN 21, THIS COURT, THIS COUNTY MADE A COMMITMENT TO THE REGION THAT IF THEY CLEARED THE ENVI OUTER ENVIRONMENTALLY, NOT BUILDING, JUST CLEAR IT THEN RTC AND TECHSTAR, BUT FRONT LOAD PROJECTS IN THE COUNTY FASTER THAN THEY WOULD'VE. AND THAT'S PART OF, IT'S THAT 256 MILLION THAT I JUST REFERENCED. SO THAT WAS A NEGOTIATION THAT, THAT ROCKWELL COUNTY HAD WITH ITS FUNDING PARTNERS. AND SO THAT'S HOW THAT WORKED. AND SO WHAT MICHAEL MORRIS, WHO'S THE EXECUTIVE DIRECTOR FOR THE REGIONAL TRANSPORTATION COUNCIL, AND HE'S TOLD THAT TO EACH ONE OF Y'ALL, SO YOU DON'T HAVE TO TRUST ME ON IT, THAT IF YOU HAVE A DEAL AND ONE PARTY CHANGES THE DEAL, THE OTHER PARTY HAS THE RIGHT TO REACT TO IT. AND I'M SAYING WHETHER THEY TAKE THE 2 56 BACK, I WOULD SAY THAT'S PROBABLY HIGHLY DOUBTFUL. 'CAUSE THOSE PROJECTS ARE IN THE PIPELINE FOR NEXT YEAR. BUT ALL THOSE OTHER PROJECTS I LISTED, DO YOU, THEY WON'T PARTNER WITH YOU. SO THAT'S NOT A THREAT. THAT'S SAYING IF YOU'RE GONNA BREAK A DEAL, I CAN'T MAKE DEALS WITH YOU. THAT'S THAT SIMPLE. OKAY. DO YOU HAVE QUESTIONS? NO. COMMISSIONER BIDEN? NO. ANY, ANY, ANY FOR YOU COMMISSIONER STACY? NOT AT THIS TIME. COMMISSIONER. SEVERE. ANYTHING FURTHER? COMMISSIONER M**K? NO. THANK YOU. MR. POLLSTER? YES, SIR. [18. Discuss/Act on approving a discretionary exemption permitted by Local Government Code §262.024 for software and services associated with Strategic Planning and approve quote and statement of work with Envisio Solutions Inc., and all related issues; (Commissioner Macalik) (Part 1 of 2)] ALL RIGHT. THAT TAKES US TO AGENDA ITEM NUMBER 18. WE'RE GONNA DISCUSS AND ACT ON APPROVING A DISCRETIONARY EXEMPTION PERMITTED BY LOCAL GOVERNMENT CODE 2 6 2 0.024 FOR SOFTWARE AND SERVICES ASSOCIATED WITH STRATEGIC PLANNING AND APPROVE QUOTE AND STATEMENT OF WORK WITH INVISIO SOLUTIONS INCORPORATED AND ALL RELATED ISSUES. COMMISSIONER M**K, WHY, WHY, WHY DID WE, DID YOU GO AND TALK ABOUT ITEM 17? DID WE TALK ABOUT IT? WE MOVED INTO IT, BUT I DUNNO IF WE CALLED. YEAH, WE, WE, WE, WE DID. WE DIDN'T REALLY CALL. WE AGREED. YOU, YOU, YOU DIDN'T, YOU DIDN'T IDENTIFY, DID I? NOT TO ITEM NUMBER 17. WE JUST MOVED RIGHT INTO IT. DO IT ALL OVER AGAIN. NO, LET, BUT I DO WANT TO READ IT FOR THE RECORD THOUGH, IF I DIDN'T. THANK YOU FOR [17. Discussion of a Contract for Engineering Services Supplemental Agreement No. 1 with Halff Associates forthe Rockwall County Outer Loop Phase 2 segment of the project, and all related issues; (Commissioner Bailey) (Part 1 of 2)] THE OVERSIGHT. SO WE HAD JUST DISCUSSED, UH, A CONTRACT FOR ENGINEERING SERVICES SUPPLEMENTAL AGREEMENT NUMBER ONE WITH HALF AN ASSOCIATES FOR THE ROCKWALL COUNTY OUTER LOOP, PHASE TWO SEGMENT OF THE PROJECT AND ALL RELATED ISSUES. OKAY. SO WAS AGENDA 17. SO MY, MY QUESTION TO YOU IS, WHY DID YOU CHANGE WHAT I HAD PLACED ON THE AGENDA TO DISCUSS AND ACT TO DISCUSSION ONLY? SO MY REASON FOR THAT HAS NOT CHANGED WHAT YOU WERE TRYING TO DO AS IMMORAL AND QUITE PROBABLY ILLEGAL. YOU CAN'T TELL THE CITIZENS YOU'RE DOING ONE THING WITH THE KNOWLEDGE THAT YOU'RE GONNA DO SOMETHING ELSE. AND, AND THIS IS VINDICATION THAT THE INTENTION WAS AND IS TO DO SOMETHING OTHER THAN WHAT YOU TOLD THE CITIZENS. I BELIEVE THAT TO BE ILLEGAL. AND, AND, AND AT THE VERY LEAST, IF IT'S NOT ILLEGAL, IT'S IMMORAL. AND, AND SO WE HAVE OUR BOND COUNSEL HERE TODAY TO STATE HOW THE WORDING WAS ISSUED, NOT ONLY IN THE 2008 BOND, BUT ALSO IN THE 2021 BOND. SO, SO I, I UNDERSTAND THAT THERE'S BALLOT LANGUAGE AND THEN THERE IS THIS LIST OF ALL THE ITEMS THAT WE SAID, HERE'S THE $150 MILLION ON THE BALLOT. HERE'S HOW WE GOT TO THAT AMOUNT. HERE'S WHAT WE'RE GONNA DO WITH $150 MILLION. OKAY? AND WILL YOU NOW [01:40:01] AGREE WITH ME, AS I SAID, WHEN I WAS THE COUNCILMAN IN HEATH THAT THIS IS A LIE? WILL YOU AGREE WITH THAT? OH, WILL YOU? ABSOLUTELY NOT. IT, IT, IT, IT IS A DECEPTION. 'CAUSE THE BOND COUNCIL WROTE THE COVENANTS TO SAY WHAT WE CAN AND CAN'T DO WITH THE MONIES. MM-HMM. THAT ARE AUTHORIZED BY THAT BOND ON, ON THE BALLOT. THE LANGUAGE IS CORRECT, BUT THE DOLLAR AMOUNT THAT IS ON THAT BALLOT WAS ARRIVED AT DISHONESTLY . THERE, THERE IS THE LIST. YOU CAN LAUGH ALL YOU WANT, BUT WHAT WHAT WE'RE SEEING RIGHT NOW IS THE VERY RARE OCCURRENCE WHERE A A A YOUNG COUNCILMAN WITH NO AUTHORITY STANDS UP AND CALLS SOMETHING OUT AND SENDS BUREAUCRATS INTO A CHAOTIC TORNADO OF, OF JUST SCREECHING. AND WHAT RARELY, IF EVER HAPPENS IS THAT LITTLE COUNCILMAN GETS ELECTED TO JUDGE AND NOW HAS AUTHORITY TO SIT AND CALL IT FOR WHAT IT IS WITH A GREATER PLATFORM. I HAVEN'T CHANGED. THIS IS DISHONEST. IT'S IMMORAL AND IT'S MOST LIKELY ILLEGAL. YOU CAN'T TELL PEOPLE, HERE'S WHAT WE'RE GOING TO DO. GIVE US $150 MILLION AND THEN YOU GET THE $150 MILLION. AND I AGREE, THE BALLOT LANGUAGE IS FINE, BUT HOW YOU GOT TO THE 150 IS DECEPTION. NOW WE'VE GOT THE 150 APPROVED, SO WE CAN THROW THAT AWAY. NOW WE'RE GONNA DO WHAT WE WANT AND WE KNOW YOU DON'T WANT IT. AND HOW I KNOW YOU DON'T WANT IT. AND HOW I KNOW THE COURT KNEW YOU DIDN'T WANT IT 'CAUSE THEY DIDN'T PUT IT ON THE LIST. IF THEY'D PUT IT ON THE LIST, THE THING WOULDN'T HAVE PASSED. AND IT'S IMMORAL AND VERY LIKELY ILLEGAL. SO I'LL ASK OUR GENERAL COUNSEL. CAN I MAKE ONE STATEMENT FIRST? YEAH. IF YOU LOOK AT THE LIST, JOHN POLLSTER, ITS IF YOU LOOK AT THE LIST, UH, ROY CITY SUBMITTED A PROJECT FOR THE OUT LOOP, CERTAIN, I THINK IT'S 20 SOMETHING MILLION BUCKS TO BUILD THE FRONTAGE ROADS IN THEIR PART OF THE CITY. SO THERE, THE OUTER LOOP IS ON THAT LIST. AND THE VOTERS LOOKED AT IT WHERE THEY KNEW WHAT THEY WERE TALKING ABOUT OR UNDERSTOOD IT. I DON'T KNOW. BUT IT WAS ON THE LIST. THE THE NORTH SECTION IS ON THE LIST. YES. YES, SIR. IIII WOULD TELL YOU NORTH SECTION IS ON THE LIST. SOUTH SECTION IS NOWHERE TO BE FOUND. CORRECT. BUT, BUT THE REALITY IS, BUT WE'RE TRYING TO SPEND IT ON THE SOUTH SECTION. WE DIDN'T HAVE NO, WHAT? THE ONLY REASON WE DIDN'T DO IT ON THE SOUTH, HE'S GOT 9 MILLION THAT HE, THAT'S TO BE DETERMINED. SO YOU CAN DO THAT WHATEVER YOU WANT. BUT, UM, PUT IT BACK. WHAT HAPPENED ON THE BUMP ROAD? THE ORIGINALLY WE DIDN'T DO ALL OF IT, IS BECAUSE WE DIDN'T HAVE ENOUGH MONEY IN THE BOND PROGRAM TO DO IT ALL AT THE TIME. 'CAUSE ORIGINALLY THIS WAS GONNA BE A BACKAGE ROPE IN HEATH. AND THEN AFTER WE DID GOT THROUGH ALL THAT STUFF, THE UH, DOLLAR AMOUNT WAS CHANGED TO 9 MILLION. SO THERE IS ER LOOP IS ON THE LIST. YES. THE, THE NORTH SECTION. YES. THE SOUTH SECTION DOESN'T, THERE'S NO MENTION OF IT. DOESN'T MATTER. NO MENTION OF IT. SO C CONTINUE, I BELIEVE YOU'VE GOT THE, YOU'VE GOT THE FLOOR. DID I ANSWER YOUR QUESTION AS TO WHY? THAT'S WHY THAT'S NOT ON THERE. I BELIEVE YOU CAN'T COMPEL ME TO VIOLATE THE LAW. NO. WHAT I'M IS, WHAT I BELIEVE, WHAT I'M ASKING OUR GENERAL COUNSEL IS TO EXPLAIN TO ME HOW YOU, THE JUDGE CAN CHANGE THE WORDING THAT WAS SUBMITTED ON AGENDA ITEM NUMBER 17 FROM IN 18, DISCUSS AND ACT TO DISCUSS. I CAN PROVIDE LEGAL ADVICE ON THAT, BUT I WOULD PREFER TO DO IT IN EXECUTIVE SESSION. OKAY. LET'S, LET'S HAVE IT, YOU MUST DO IT IN Z SESSION. YEAH. YEAH. I, I'M, I'M OKAY WITH THAT. UH, MATTER OF FACT, WE GOT SEVERAL THINGS TO TALK ABOUT IN EXECUTIVE SESSION. CAN CAN I ASK A QUESTION BEFORE WE GO IN EXECUTIVE SEC? CAN WE GO IN AND AND BACK OUT IN THAT SAME TIME FRAME? OR CAN YOU, CAN YOU CALL AN EXECUTIVE SESSION JUST ON THIS AGENDA ITEM? YES. AND THEN, AND THEN COME BACK AND READDRESS AN EXECUTIVE SESSION. THAT'S, UH, YES. THAT KID IS DOABLE. THAT'S UP TO THE JUDGE. OKAY. LET'S SEE WHAT ALL WE GOT DISCUSSED TODAY. YEAH, LET'S DO THAT. 'CAUSE WE GOT SOME TAX STUFF AND, AND EMPLOYMENT STUFF. SO COMMISSIONER'S, COURT OF ROCKWALL COUNTY RESERVES THE RIGHT TO ADJOURN INTO EXECUTIVE SESSION AT ANY TIME DURING THE COURSE OF THIS MEETING TO DISCUSS ANY OF THE MATTERS LISTED IN THE AGENDA ITEM IN THE ORDER DEEMED APPROPRIATE AS AUTHORIZED BY CHAPTER 5 5 1 OPEN MEETING, SUB CHAPTER DEED, TEXAS GOVERNMENT CODE, OR SEEK TO ADVISE OF ITS COUNSEL AT 10 56. WE'RE AN EXECUTIVE SESSION. WE ARE GOING TO MEET YOU GUYS. GO TO MY OFFICE. OH, OKAY. UH, BEAR WITH [01:45:01] ME. UH, PURSUANT TO OPEN MEETINGS ACT, CHAPTER 5 5 1, TEXAS GOVERNMENT CODE SECTION 5 5 1 0 0 1. COURT WILL RECONVENE AN OPEN SESSION TO TAKE ANY ACTION NECESSARY IN MATTERS DISCUSSED IN EXECUTIVE SESSION. AND I WILL TELL YOU, NO ACTION TAKEN. [18. Discuss/Act on approving a discretionary exemption permitted by Local Government Code §262.024 for software and services associated with Strategic Planning and approve quote and statement of work with Envisio Solutions Inc., and all related issues; (Commissioner Macalik) (Part 2 of 2)] WE ARE GOING TO AGENDA ITEM NUMBER 18, THE DISCUSSION ACT ON APPROVING A DISCRETIONARY EXEMPTION PERMITTED BY LOCAL GOVERNMENT CODE 2 6 2 0 2 4 FOR SOFTWARE AND SERVICES ASSOCIATED WITH STRATEGIC PLANNING AND APPROVED QUOTE AND A STATEMENT OF WORK WITH INVISIO SOLUTIONS INCORPORATED AND ALL RELATED ISSUES. COMMISSIONER MACKLEY. THANK YOU, COMMISSIONER. UM, I THINK BRIAN CRENSHAW IS GOING TO COME UP. I, I KNOW THAT WE HAVE APPROVED THE, THE, UM, SOFTWARE, UM, SERVICES. AND I KNOW THAT THE AUDITOR AND I HAVE TALKED ABOUT IT. BUT ONE OF THE THINGS THAT WAS, UM, ASKED IS THAT WE MADE SURE THAT OUR IT DIRECTOR, UM, HAD AN OPPORTUNITY TO REVIEW THE SOFTWARE AND ASK ANY QUESTIONS. AND HE AND I PARTICIPATED LAST WEEK ON A, UM, ON A ZOOM CALL OR A TEAMS CALL. AND SO BRIAN, IF YOU WOULD ADDRESS THE COURT PLEASE. UM, SURE. THIS IS A PIECE OF SOFTWARE CALLED INVISIO THAT WILL ALLOW US TO TRACK GOALS WITHIN THE COUNTY AND THEN HAVE A PUBLIC FACING PART ON OUR WEBSITE TO SHOW THE PUBLIC, UH, OUR PROGRESS. IT'S ALL FULLY WEB-BASED AND HOSTED OUTSIDE OF THE COUNTY. UM, IT WILL INTEGRATE INTO OUR EXISTING USER DATABASE AND IT'LL USE EMAIL AND TEAMS TO NOTIFY PEOPLE INTERNALLY OF THINGS. SO THERE'S VERY LITTLE ARCHITECTURAL IT IMPACT FROM THIS. AND THEN, UH, AS FAR AS DURING IMPLEMENTATION, THEY WILL TRAIN THE COUNTY STAFF ON HOW TO USE IT. UH, THEY WILL MAIN, UH, SET UP ALL THE USER, UH, ACCESS ROLES AND RULES FOR WHAT, UH, INTERNALLY PEOPLE CAN SEE. THE COUNTY STAFF WILL WORK WITH THEM INITIALLY TO BUILD DASHBOARDS FOR EACH AREA THAT WE WANT TO PRESENT. AND, AND THEN ONGOING, UM, THERE WILL BE, UH, ONE PERSON OR ONE OR TWO PEOPLE FROM EACH DEPARTMENT THAT WILL MAINTAIN THE DASHBOARD AND KEEP IT UPDATED. AND THEN, UH, YET TO BE DETERMINED SOME OTHER GROUP THAT WILL BE LIKE A GATEKEEPER THAT AS THOSE EDITS COME IN, WE, UH, THEY WOULD PUSH 'EM OUT. IT'D PROBABLY BE, IT. IT'S, IT'LL BE VERY SIMILAR TO WHAT WE ALREADY DO WITH, UH, THE WEBSITE. UM, ANY SUPPORT FOR IT WOULD GO DIRECTLY TO INVISIO AND I DON'T SEE ANY TECHNICAL REASON TO NOT DO IT. SO IF Y'ALL HAVE ANY QUESTIONS, LET ME KNOW. I HAVE A QUESTION. OKAY. UH, SO ON, ON THE DRAFT, UNDER KEY DELIVERABLES, IT SAYS UP TO 10 PROJECTS AND CORRESPONDING SETS OF TASKS BUILT IN. UM, I I, IS THAT WHERE WE KEEP TRACK OF OUR KPIS? MM-HMM. ? YES. OKAY. AND, AND WHAT, WHAT HAPPENS IF WE HAVE MORE THAN 10? IS THAT A, A BILLABLE EVENT FROM THEM OR DO YOU KNOW? I WOULD ASSUME SO. OKAY. I I, I DON'T THINK IT'S A BILLABLE BECAUSE SOME OF THE EXAMPLES OF SOME OF THE OTHER, UM, STRATEGIC PLANS OF COUNTIES OR CITIES THAT THEY'VE DONE, THEY HAVE THE SAME NUMBER OF INITIATIVES THAT, OF WHAT WE'VE HAD AS WELL. AND SO IT'S, IT'S, IT CAN BE ADDED ON. OKAY. SO, AND BECAUSE IT LOOKS AS THOUGH WE ARE GOING TO BE IN EXCESS OF OH YEAH. WELL, I MEAN, OF 10. YEAH. MM-HMM. . SO LISA, I HAD A QUESTION REAL QUICK. IN THE, IN THE BUDGET, ALL OF OUR DOCUMENTATION SAID 39 5 FOR THIS SOFTWARE. IS THAT, WHAT HAS, IS THAT WHAT WE BUDGETED INTO THE STRATEGIC PLAN LINE ITEM? WE DID BUDGET, SORRY. WE DID BUDGET, UH, FOR THE SOFTWARE. UH, THIS, UH, WAS IS ONLY FOR SIX MONTHS. I BELIEVE WE PROBABLY BUDGETED YY YEAH. BUT I'M SAYING, BUT YEAH. SO THIS ONE IS AROUND 22, RIGHT? 2 29. BUT WE, WELL, WE DID A PRO PRORATED AMOUNT, BUT, BUT WHAT I'M SAYING IS, IS THAT WHAT ARE WE, I'M, I'M JUST, BECAUSE LIKE, SO, SO WE BUDGETED 39.5, THAT'S THE NUMBER THAT SHOWED UP ON ALL OF OUR, UH, AUDITOR SPREADSHEETS THROUGHOUT THE WHOLE BUDGET PROCESS. RIGHT. BUT IT HAD SOME PRORATION BECAUSE THERE'S SOME IMPLEMENTATION COSTS. CORRECT. ARE, ARE THEY, IS DOES THIS HAVE ALL THAT IN CLICK LABEL? YES, IT DOES. WHAT DO WE, SO HOW DID IT GO FROM 39 5 TO 22,000? THE, THE NEXT, THE NEXT YEAR? BECAUSE THERE'S, THERE'S A STARTUP COST INVOLVED WITH THAT, AND THEN THE NEXT YEAR, THE, IT WILL JUST GO BACK DOWN TO THE 22,000 OR 22 5, WHATEVER THAT WAS. THEY'RE NOT, THEY'RE NOT MENTIONING THE STARTUP COSTS. OKAY. SO THIS WAS, THAT WAS KINDA A, WELL, I WOULD HAVE TO GO BACK TO OUR PRESENTATION 'CAUSE THEY DID GIVE US THAT INFORMATION AND I, I'M SORRY, I DON'T HAVE THAT HERE WITH ME TODAY. YEAH. BUT IT WAS IN THAT PRESENTATION THAT WE MADE WHEN WE WERE WORKING ON THE BUDGET. SO, UM, I'LL HAVE TO GET THAT TO YOU. YEAH, BECAUSE I, I CAN DO THAT. I MEAN, I KNOW WE [01:50:01] BUDGETED THE MONEY AND THIS IS SIGNING A CONTRACT, RIGHT. BUT THE, THE NUMBERS ARE OFF BY, UH, YOU KNOW, $17,000, WHICH I'M ASSUMING IS STARTUP COSTS, BUT I'M NOT SEEING THAT LAID OUT IN FRONT OF US. WELL, YEAH. THAT, THAT'S NOT PART OF THIS AGREEMENT. YEAH. OKAY. OKAY. I'LL GET, I, IF WE CAN JUST PA WE CAN, I MEAN FOR THE PURPOSES OF, OF, OF WHAT I HAD ASKED, UM, UM, BRIAN TO DO, BUT I CAN GET THAT INFORMA, I'VE GOT THE CONTRACT DOWNSTAIRS. I MEAN, I'VE GOT THE, THE, THE BACK, THE BACK STUFF THAT THEY GAVE ME, BUT I DON'T HAVE IT HERE WITH ME. I'M SORRY. AND, AND NO, AND, AND THAT'S FINE. I MEAN, WE, WE BUDGETED IT. I HAVE NO ISSUE WITH, WITH THE SOFTWARE. IT'S IN THE BUDGET AND MM-HMM. , AND WE'RE TRYING TO GET A STRATEGIC PLAN. I I WAS JUST CURIOUS, DID WE GET A DISCOUNT OR, BECAUSE EVERY NUMBER WE HAD WAS ABOUT BASICALLY 40,000 MM-HMM. . AND SO WHEN I ORIGINALLY LOOKED AT THIS, I JUST REMEMBER IT BEING ABOUT 40, AND I SAW THIS AROUND 20, AND I SAID, YOU KNOW, WHAT, WHAT HAPPENED? AND, AND, AND WHAT IS THE DIFFERENCE? OKAY. SO, UM, YEAH, I THINK, BUT I HAVE NO ISSUES WITH, WITH, WITH DOING IT BECAUSE WE PUT IT IN THE BUDGET AND, AND THE BUDGET PASSED AND FINE. AND I DO BELIEVE THAT, UM, AS I RECALL FROM MY NOTES, IS THAT TYPICALLY WHEN YOU ENTER INTO SOMETHING LIKE THIS, IT'S FOR A MINIMUM OF FIVE YEARS. I DO KNOW THAT. UM, BUT, UM, I, I CAN I, I, SORRY, I JUST DON'T HAVE THE, THE DATA HERE WITH ME. UM, WE DID HAVE THIS REVIEWED BY LEGAL, UH, GENERAL COUNSEL REVIEWED IT. UM, AND, UH, THE COMPANY ITSELF IS CLAIMING THAT THEY ARE THE SOLE SOURCE FOR THIS TYPE OF SOFTWARE. UM, THEY ARE, IT IS UNDER, UH, THE $50,000 AMOUNT, BUT SINCE IT'S OVER A FIVE YEAR PERIOD, I, I WENT AHEAD AND, AND PRESENTED IT TO YOU AS TO GO AHEAD AND REQUEST THE DISCRETIONARY EXEMPTION, WHICH IS YOU ARE PERMITTED TO DO, WHICH MAKES YOU SAY THAT THEY ARE A SOLE SOURCE AND THAT YOU DON'T HAVE TO GO OUT TO BID FOR THEIR PRODUCT. SO, UM, YOU'RE CORRECT, THERE ARE, THERE IS ANOTHER COMPANY THAT WE DID INTERVIEW, AND WE DID LOOK AT THEIR, THEIR PROGRAM, BUT WE DID NOT THINK IT, IT, IT WAS NOT AS, UM, INTUITIVE AND AS SIMPLE, AND I DON'T MEAN SIMPLE IN, BUT IN A WAY THAT OUR, OUR EMPLOYEES CAN, CAN, CAN WORK WITH THE SOFTWARE. AND, AND IN THE MANNER THAT BRIAN WAS TALKING ABOUT THE OTHER ONE, I WAS JUST A LOT MORE DIFFICULT. OKAY. SO I DON'T KNOW IF WE JUST NEED TO, UH, I'LL ENTERTAIN A MOTION IF SOMEBODY'S SO INCLINED. WELL, I'LL MAKE THE MOTION THAT WE APPROVE THE DISCRETIONARY EXEMPTION PERMITTED BY LOCAL GOVERNMENT CODE 2 6 2 0.024 FOR THE SOFTWARE AND THE SERVICES ASSOCIATED WITH A STRATEGIC PLAN, UM, AND WORK WITH THE INVISIO SOLUTIONS INCORPORATED. GOT A MOTION BY COMMISSIONER MLU. I'LL SECOND. SECOND BY COMMISSIONER. STACY, ANY FURTHER QUESTIONS OR COMMENTS IF EVERYBODY WILL REGISTER YOUR VOTE? IT PASSES FIVE TO ZERO. [19. Discuss/Act on approving out of state travel for District Attorney Kenda Culpepperto attend the National District Attorneys Association Board and Committee meetings in San Diego, California on November 14-16, 2024, and all related issues; (Judge New - DA)] ALL RIGHT. SO IT TAKES US TO AGENDA ITEM 19, DISCUSS AN ACT. THANK YOU, BRIAN. DISCUSS AND ACT ON APPROVING OUT-OF-STATE TRAVEL FOR DISTRICT ATTORNEY KEN CULPEPPER TO ATTEND THE NATIONAL DISTRICT ATTORNEY'S ASSOCIATION BOARD AND COMMITTEE MEETINGS IN SAN DIEGO, CALIFORNIA ON NOVEMBER 14TH THROUGH 16 20 24 IN ALL RELATED ISSUES. MS. CULPEPPER, YOU WANT, WELL, I'LL MAKE A MOTION WE APPROVE FOR OUTTA STATE TRIBAL. I'LL SECOND GOT A MOTION. YOU HAVE STAND DOWN. GOT A MOTION AND A SECOND ALREADY. UM, EVERY YEAR. ANY FURTHER COMMENTS? OKAY. IF YOU'LL REGISTER YOUR VOTES, IT'S SLOWLY COMING IN. IT PASSES FIVE TO ZERO. ALL RIGHT. [20. Discuss/Act on approving an Order of the Rockwall County Commissioners Court regulating the time, place, manner, and number of political signs (Electioneering), and all related issues; (Judge New)] THAT TAKES US TO AGENDA ITEM 20. DISCUSS AND ACT ON APPROVING AN ORDER OF THE ROCKWALL COUNTY COMMISSIONER'S COURT REGULATING THE TIME, PLACE MANNER, AND NUMBER OF POLITICAL SIGNS, UH, PARENTHETICAL, ELECTIONEERING, AND ALL RELATED ISSUES. THIS IS, AND THANK YOU COMMISSIONER STACY, FOR BRINGING THIS FORWARD. WE, WE, UM, WE LIMITED THE NUMBER OF SIGNS. WE LIMITED THE QUANTITY, NOT THE CONTENT OF POLITICAL SIGNS, UH, ON COUNTY PROPERTIES, POLLING LOCATIONS WHERE EACH PERSON CAN HAVE ONE SIGN. AND IT'S MADE A A, A PRETTY SIGNIFICANT IMPACT AS TO THE VISIBILITY AND, AND THE SAFETY AND JUST THE OVERALL COSMETICS OF THE POLLING LOCATIONS. WHAT WE FAILED TO DO IS ONE THING THAT, UH, I AM ALWAYS CHASTISING OUR STATE LEGISLATURE FOR. WE DIDN'T TAKE IT TO WHAT IF, WHAT IF SOMEBODY DOES? WE JUST SAID YOU CAN'T. AND WE DIDN'T TAKE THAT STEP OF SAYING, WELL, WHAT IF YOU DO? AND SO NOW WE, WE'VE CLOSED UP THAT LOOP OF WHAT HAPPENS IF SOMEBODY DOES, UM, WHAT, WHAT'S OUR PROCESS FOR REMOVING THE SIGNS? WHAT'S THE PROCESS FOR CONTACTING THEM SO THEY CAN RECLAIM THEIR SIGN? UH, AND, AND [01:55:01] WE'VE, WE'VE DONE THAT NOW. SO, UM, BEAR WITH ME AND I'LL, I WILL GET TO THAT INFORMATION. SO WHAT WE'VE DONE IS JUST ADDED, UM, ANY SIGN FOUND TO BE OUTSIDE OF THIS ORDER WILL BE SUBJECT TO REMOVAL. UH, THIS IS IN SECTION THREE, SECTION 3.02. THE ELECTIONS ADMINISTRATOR OR DESIGNEE WILL REACH OUT IN WRITING TO THE CANDIDATE WHO HAS THE SIGN TO BE REMOVED. A COPY OF THIS ORDER WILL BE SENT IN THE EMAIL SECTION 3.03. AFTER THREE HOURS OF NO ACTION FROM THE CANDIDATE, THE ELECTIONS ADMINISTRATOR OR DESIGNEE WILL NOTIFY COUNTY MAINTENANCE TO REMOVE THE SIGN AND STORE IT TO BE RETURNED TO THE CANDIDATE. SECTION 3.04. THE ELECTIONS ADMINISTRATOR OR DESIGNEE WILL SEND A NOTICE OF CONFISCATED SIGN TO THE CANDIDATE AND TREASURER ON RECORD, GIVING THEM 60 DAYS NOTICE TO RETRIEVE THE SIGN AFTER 60 DAYS NOTICE, THE COUNTY WILL DISPOSE OF THE SIGN. SO WE'VE CLOSED THE LOOP ON WHAT HAPPENS IF THEY DO. AND MOST IMPORTANTLY, WE GAVE GUIDANCE TO THE PEOPLE THAT WOULD HAVE TO DISCUSS THIS WITH THE PARTIES, UM, THAT WISH NOT TO FOLLOW THE SIGNAGE. GOT IT. SO, UH, DO WE HAVE ANY FURTHER QUESTIONS OR DO COMMENTS? COMMISSIONERS? SO IF NOT, I'M GONNA GO AHEAD AND MAKE A MOTION THAT WE APPROVE THE, UH, ORDER OF THE ROCKWELL COUNTY'S COMMISSIONER'S COURT REGULATING TIME, PLACE, MANNER NUMBER, POLITICAL SIGNS, UH, AND ALL RELATED ISSUES, ADDING OR EDITED VERSION IN SECTION THREE. SECOND. GOT MY MOTION. GOT A SECOND BY COMMISSIONER BAILEY. ANY FURTHER QUESTIONS OR COMMENTS? IF YOU'LL REGISTER YOUR VOTES, IT PASSES FIVE TO ZERO. [21. Discuss/Act on amending the Rules of Procedure, Conduct and Decorum at Meetings of the Commissioners Court, and all related issues; (Judge New)] AND THAT BRINGS US TO AGENDA ITEM 21, DISCUSS AND ACT ON AMENDING THE RULES OF PROCEDURE, CONDUCT AND DECORUM AT MEETINGS OF THE COMMISSIONER'S COURT IN ALL RELATED ISSUES, I HANDED OUT COPIES, UH, TO THE COMMISSIONERS EARLIER, UH, AND EVEN GAVE ONE TO LEGAL COUNSEL AND AUDITOR. AND, AND AGAIN, LET ME APOLOGIZE ON THE RECORD. WHEN I SENT OUT, UM, THE, UM, THE COMMISSIONER'S COURT, UH, RULES OF PROCEDURE CONDUCT AND A QUORUM, I THOUGHT MY NOTES WERE ATTACHED TO IT. IT'S, IT'S A WORKING DOCUMENT THAT INSERTS A LITTLE BUBBLE, AND THEN YOU HAVE YOUR NOTES ON THE SIDEBAR. UH, WHEN I SENT THAT OUT THREE WEEKS AGO, I THOUGHT YOU GUYS GOT IT ALL. SO WHAT YOU HAVE HERE IS THE COPY OF MY LITTLE NOTES ON THE SIDEBAR THAT WOULD BE INSERTED, UH, INTO SECTION THREE. AND LEMME READ SECTION THREE FOR YOU RIGHT NOW. AS, AS IT'S WRITTEN, THIS IS, AS IT STANDS, THE ROCKWELL COUNTY COMMISSIONER'S COURT MEETS IN REGULAR SESSION ON THE SECOND AND FOUR TUESDAYS OF EACH MONTH. IN ORDER FOR A MATTER OR ISSUE TO APPEAR AS AGENDA ITEM ON THE AGENDA OF ANY REGULAR MEETING OF THE COMMISSIONER'S COURT, A REQUEST MUST BE FILLED AND APPROVED BY AT LEAST ONE MEMBER OF THE COMMISSIONER'S COURT BY NOON ON THE TUESDAY IMMEDIATELY PROCEEDING THE REGULAR MEETING OF THE COMMISSIONER'S COURT. SO THE THREE ITEMS I WANT TO ADD, AND BEFORE I READ THOSE, LEMME TELL YOU MY, MY INTENT IS, UH, FELICIA MORRIS, THE COURT COORDINATOR, SPENDS AN AN AMAZING AMOUNT OF TIME TRACKING DOWN BACKUP DOCUMENTS, JUST WORKING ON, HEY, I WANT TO, HERE'S A PLACEHOLDER. I WANT TO BE ON THE AGENDA. AND IT JUST NEVER, NEVER COMES. AND IT KEEPS US FROM FINALIZING THE AGENDA, WHICH KEEPS US FROM GETTING IT OUT TO THE COMMISSIONERS, WHICH KEEPS THEM FROM HAVING ADEQUATE TIME TO ACTUALLY GO OVER WHAT'S GOING TO BE ON THE AGENDA. SO, UH, OF THE THREE, THE, THE FIRST, UH, EDIT THAT I WOULD LIKE TO MAKE IS ALL BACKUP INFORMATION MUST BE RECEIVED BY 3:00 PM THE WEDNESDAY BEFORE COMMISSIONER'S COURT. SO YOU NEED TO HAVE THE AGENDA ITEM ON TUESDAY. YOU NEED TO HAVE THE BACKUP BY THE FOLLOWING DAY 3:00 PM THE SE IS THIS FOR EVERYBODY? EVERYBODY, EVERYBODY. AUDITOR INCLUDED? WELL, SO THERE'S SOME INFORMATION THAT THE AUDITOR WON'T GET BY 3:00 PM OF THE FOLLOWING WEDNESDAY. AND, AND CORRECT ME IF I'M WRONG, LISA, IT'S MAINLY PAYROLLS, BILLS CLAIMS, THI THINGS OF THAT NATURE MAY NOT COME IN RIGHT. BUT TYPICALLY THAT'S ON THE CONSENT AGENDA AND IS NOT A, A STANDALONE AGENDA ITEM. AND, AND THIS, WHILE I DON'T SAY IT, IT'S INTENDED FOR STANDALONE AGENDA ITEMS. IF YOU'RE ASKING TO PUT SOMETHING ON THAT'S NOT JUST A ROUTINE MINISTERIAL DUTY, THEN HAVE IT, DID YOU JUST USE THE WORD MINISTERIAL? I, I DID. OKAY. I DID. AND I, I, I THOUGHT LIGHTNING WAS, WAS STRIKING SOMEWHERE AS I SAID IT, AND I DID IT ON PURPOSE. UM, SO CLARIFY FOR, I JUST, YEAH, BECAUSE THERE'S ALWAYS THE EXCEPTION ALWAYS BECAUSE OF THAT. YEP. WHAT I WAS CALLING TO GET AT. YES, SIR. YEAH. AND, AND, AND THERE IS, AND, AND AS LONG AS THE EXCEPTION DOESN'T BECOME [02:00:01] THE RULE, UH, YOU KNOW, I'M, I'M NOT UNREASONABLE. UM, JUDGE THE AUDITOR'S, UH, TIME TO GET OUR AGENDA, JUST THE AGENDA WORDING TO THE COURT COORDINATOR HAS BEEN WEDNESDAY AT NOON, UH, FOR AS LONG AS I'VE BEEN COUNTY AUDITOR. SO THAT WOULD BE CHANGING TO NOW TUESDAY AT NOON, AND THEN HAVE MY BACKUP TO HER BY WEDNESDAY. SO AS, AS IT'S WRITTEN RIGHT NOW, IT, IT IS TUESDAY. RIGHT. BUT, BUT WE, WE, WE HAVE WE HAVE ALWAYS KINDA LET THAT SLIDE, BUT MOST OF YOUR STUFF, LISA GOES ON CONSENT AGENDA AND, AND WELL, AND WE WERE PLANNING ON MAKING CHANGES ANYWAYS, SO YEAH, WE, WE, WE ARE, AND THAT'S WHAT'S DRIVING THIS IS WE'RE, WE'RE ABOUT TO, UM, HAVE FELICIA TAKE ON SOME MORE DUTIES. SO NOT GONNA HAVE TIME TO BE, BE CHASING THIS DOWN, BUT YOUR, YOUR YOURS IS KIND OF JUST BY STANDARD, THE EXCEPTION. AND I KNOW THAT THAT DOESN'T MAKE SENSE, BUT YOUR YOURS, WE, WE, WE KNOW WHERE YOU'RE AT. WE KNOW THE CONSENT AGENDA AND WE KNOW WE'RE JUST WAITING FOR THE NUMBERS TO COME IN. WELL, AND MOST OF OUR STUFF COMES STRAIGHT AS A WORD DOCUMENT STRAIGHT TO JUST CUT AND PASTE IT ONTO THE AGENDA. Y YES, IT DOES. ALL THE WORK'S BEEN DONE ALREADY. SO, UH, WE'RE, WE'RE HAPPY TO ACCOMMODATE. BUT YEAH, NO, I, I, I HAVE NO ISSUES WITH THAT. I'M JUST O OTHER STANDALONE ISSUES. YOU WANT IT ON THE AGENDA, YOU'RE GONNA HAVE TO LET US KNOW A WEEK IN ADVANCE AND THEN, UH, BY THE TUESDAY PROCEEDING, AND THEN YOU'RE GONNA NEED TO GET US THE BACKUP BY WEDNESDAY. UH, IF, IF NOT, I'M GONNA BECOME MORE STERN AND, AND I'VE LET THIS SLIDE, UH, IS WHAT I'VE DONE. I'M GONNA BECOME MORE STERN OF, HEY, YOU'RE NOT READY. SO WE'RE GONNA KICK IT, KICK IT TO THE NEXT AGENDA. UM, SO IN, IN THE SECOND ITEM, UH, THE AGENDA WILL LIST THE COURT MEMBER APPROVING THE AGENDA ITEM AND THE DEPARTMENT HEAD OR ELECTED OFFICIAL THAT REQUESTED THE ITEM BE PLACED ON THE AGENDA. AND THE EXAMPLE I GIVE, IT'S WILL BE JUDGE NEW AND BARRY COMPTON. SO IF BARRY WANTS SOMETHING PUT ON THE AGENDA, MEMBER OF THE COURT'S GONNA HAVE TO APPROVE IT. AND IF I SAY, YES, I'LL DO IT. I NEED BARRY'S NAME ON THERE AS WELL. UH, AND, AND WHAT THAT IS MEANT TO, UM, TO, YEAH, IT'S THE WAY, IT'S THE WAY IT SHOULD BE. 'CAUSE IF NOT, I END UP BEING THE DEFAULT. LISA ENDS UP BEING THE DEFAULT AND WE LOOK AT EACH OTHER LIKE, I THOUGHT THIS WAS YOU. NO, THIS, THIS IS NOT YOU. IT'S NOT ME. UH, SO THAT WAY WE, WE HAVE RESPONSIBLE PARTIES. UM, AND SO WHAT THIS SAYS IS A COMMISSIONER CAN PUT SOMETHING ON THE COURT BY THEMSELVES, CORRECT? CORRECT. CORRECT. OKAY. AND, AND DOES NOT HAVE TO HAVE SLASH NO, NO, NO. YOU CAN JUST, IT'LL BE JUDGE NEW AND, AND THEN, OR COMMISSIONER M**K AND, AND GOT IT. YOU, YOU DON'T, YOU DON'T NEED A BACKUP DEPARTMENT HEAD. BUT WHEN THE DEPARTMENT HEADS COME TO YOU, IF YOU'RE THE CONTACT, RIGHT. IT'S YOUR NAME AND THEIR NAME. YEAH. UM, SO, AND IT'S AN ATTEMPT TO MAKE THEM AS RESPONSIBLE FOR THE ITEM AS THE SPONSORING COMMISSIONER IS. UH, AND, AND THE THIRD ITEM IS, UM, IF A DEPARTMENT OR ELECTED OFFICIAL, OR THEIR DESIGNEE WANTS TO ADDRESS THE COURT REGARDING AN ITEM THEY PLACED ON THE AGENDA, THEY WILL NOTIFY THE COURT COORDINATOR AT THE TIME THEY MAKE THE REQUEST APPROXIMATELY HOW LONG THEY NEED TO ADDRESS THE COURT. THIS IS NOT INTENDED TO LIMIT THE TIME ADDRESSING THE COURT, BUT TO ALLOW THE COORDINATOR AND COUNTY JUDGE THE OPPORTUNITY TO PLACE THE ITEM IN THE APPROPRIATE ORDER IN THE AGENDA. UH, SO WHEN, WHEN THINGS ARE COMING IN FAST AND FURIOUS AND EVERYTHING'S LATE, AND WE'RE TRYING TO GET THE BACKUP INFORMATION, IT, IT MAKES IT HARD TO SIT DOWN WITH THE AGENDA AND PUT 'EM IN A LOGICAL ORDER. UM, SO THAT THIS IS, UM, AGAIN, JUST NEED, NEED YOU TO TELL US HOW LONG, HOW LONG YOU'RE GONNA NEED TO PRESENT TO THE COURT. AND I JUST WANNA ASK, JUDGE, I MEAN, UH, I THINK THE AUDITOR ALLUDED TO IT THAT THERE'S, THERE COULD BE A SECOND PROCESS THAT WE'RE TRYING TO WORK THROUGH, AND SO THAT MIGHT BE A BETTER TIME TO DO IT, BUT I DON'T LIKE THE LACK OF CLARITY THAT DEPARTMENT HEADS HAVE OF ADDING THINGS TO THE AGENDA. YEAH. THEY, THEY'RE JUST, WHO DO I TALK TO? WHO, WHO, WHO DO I SAY? AND I WAS TALKING TO A DEPARTMENT HEAD THE OTHER DAY AND THEY SAID, WELL, I'M NOT SURE IF I'M SUPPOSED TO TALK TO YOU. I DON'T. THERE'S JUST A LOT OF UNCERTAINTY OF, OF WHICH COMMISSIONER? I MEAN, AN ELECTED OFFICIAL. YEAH. JUST SEND 'EM TO THE JUDGE, OR, OR, YOU KNOW, YOUR PRECINCT. IF A CONSTABLE OR A JP, THEY COME TO ME AND I, AND I PUT IT ON THE AGENDA. I, I WOULD, I WOULD LIKE, AT SOME POINT, MAYBE NOT TODAY, BUT LET US THINK ABOUT WHAT, WHAT WOULD BE THE BEST WAY THAT WE COULD GO BACK TO THE DEPARTMENT HEADS AND SAY, THIS IS, THIS IS YOUR PROCESS FOR PUTTING SOMETHING ON THE AGENDA. SO THEY'RE NOT JUST CHASING AND E AND EI MEAN, THERE'S A FEW TIMES I JUST PUT SOMETHING, THEY'RE LIKE, I'VE BEEN TRYING TO, TO, YOU [02:05:01] KNOW, TALK TO CLIFF OR SOMETHING, AND THEN CAN I GET THIS ON THE AGENDA? AND I'M LIKE, SURE. AND IT, IT WOULD JUST BE BETTER IF WE HAD A PROCESS. AND IF WE'RE GOING TO TRY TO MAKE A PROCESS THAT SHOULD BE SOMETHING WE SHOULD AT LEAST CONSIDER. SO I DON'T KNOW IF WE WANNA TAKE THE KNIFE TO THIS A COUPLE OF TIMES, OR JUST, I, I WOULD SAY, LET'S WAIT. 'CAUSE I GOTTA TELL YOU, AND AGAIN, MY APOLOGIES, I, MY NOTES DIDN'T GET OUT WHEN I FORWARDED IT TO FELICIA AND SAY, HEY, SEND THIS TO THE COMMISSIONERS, YOU KNOW, WITH THE INSTRUCTIONS OF, HEY, I'M GONNA BRING FORTH SOME EDITS. NOW'S A GOOD TIME IF YOU GUYS WANNA BRING FORTH SOME EDITS. I, I WAS SHOCKED THAT I DIDN'T HEAR ANYTHING. AND I THOUGHT, WELL, OKAY, THERE, THERE, EVERYBODY'S GOOD. IT'S JUST ME, AND, AND THEN DIDN'T REALIZE UNTIL YESTERDAY THEY, THEY DIDN'T GET MY NOTES. I I, YEAH, I, I SENT IT OUT. SO I WOULD, I WOULD BE HAPPY TO WAIT AND LET, LET LET THE, UH, LET THE COURT REVIEW IT. AND BECAUSE I RATHER DO WANT, SO MY THOUGHT PROCESS IS, IS LOOK AT THE ORG CHART, IS MY THOUGHT PROCESS IS, IS WHEN WHEN YOU LOOK AT THE COURT, YOU, YOU HAVE, UH, CAMIE WITH PEOPLE THAT REPORT TO HER. SO I THINK IT WOULD BE NATURAL FOR CAMIE TO BRING THOSE TO THE JUDGE. I THINK THAT IT WOULD BE NATURAL FOR BARRY TO BRING HIS TO THE JUDGE BECAUSE HE DIRECTS DIRECTLY TO THE COURT. THAT'S, THAT WAS MY THOUGHT PROCESS. IF YOU JUST LOOK TO THE ORG CHART, IT JUST MAKES SENSE TO JUST ROLL IT UP. UM, AND, AND THAT WOULD HELP KIND OF CLEAN UP, YOU KNOW, SOME OF THESE ASPECTS OF, WELL, WHAT IS IT AND, AND WHAT DO YOU NEED TO TALK ABOUT AND HOW DOES IT NEED TO WORK? AND, AND, UH, AND THEN IF, IF FOR SOME REASON, YOU KNOW, THEN, THEN IT'S IN THE HANDS OF PEOPLE THAT DI DIRECTLY REPORT TO US, 100% THAT WE WORK WITH ON A DAILY BASIS. UH, THAT, THAT WAS JUST MY INITIAL THOUGHT. SO THAT WAY IT'S NOT CONFUSING. NO, I'M, I'M OKAY WITH THAT. LET, LET'S, IF, IF THE COMMISSIONERS ARE OKAY, LET'S TAKE ANOTHER BITE AT IT. HAVE EVERYBODY REREAD IT AND WE'LL BRING IT BACK AND TRY TO CLEAN IT UP ALL, ALL AT ONCE. YEAH. THE ONLY THING IS, LIKE THE BARRY EXAMPLE YOU USED, I, I CAN SEE THAT. BUT IF IT'S SOMETHING THAT I'M WANTING TO BRING AND I WANT BARRY TO BE A PART OF, WELL, THEN IT'S YOURS SUCH AS THE LI OKAY, GOT IT. YEAH. I MEAN, WE, WE CAN SELF INITIATE. THERE'S ALSO THINGS THAT THEY NEED TO INITIATE. CORRECT. CORRECT. AND, AND THAT'S WHERE I THINK THAT'S WHERE SOMETIMES THE CONFUSION COMES, IS, WHO DO I TALK TO ABOUT THIS ITEM? I HAVE THIS ISSUE THAT I, I WANNA TALK TO THE COURT ABOUT. I'M GOOD. I'M, YEAH. SO LET, LET, LET'S GO AHEAD. LET ME, UH, GET SOMETHING IN HERE. UM, I THINK THAT WE SHOULD ACT ON THIS TODAY BE BECAUSE, UM, OF THE, THE ITEM THAT I WANT TO AMEND WOULD BE THAT ONLY THE COMMISSIONER CAN REMOVE AN ITEM FROM THE AGENDA. IF YOU PUT IT ON. IF YOU PUT IT ON PERSON, PUT IT ON. SO WE CAN TAKE THAT ONE MOTION, UH, TODAY. UM, SO I, I WOULD LIKE TO AMEND THAT TO SAY IF IT'S LEGAL. I, I, AND HERE WE GO. I, I, I'M NOT GONNA AGREE TO THAT. WHY YOU TRYING TO DO ILLEGAL THINGS? WHY WOULDN'T YOU AGREE TO THAT ? WHO DETERMINES THAT IT'S ILLEGAL WHEN YOU PUT IT ON THAT? UH, WELL, GENERAL COUNSEL, WE, WE DON'T DIS WE DON'T, I'M NOT DISAGREEING WITH THE LEGAL PART, BUT I THINK WHAT IT DOES IS IT, IT JUST, THE LEGALITY OF THE ISSUE THAT'S BROUGHT ON THE AGENDA CAN BE DISCUSSED WITH GENERAL COUNSEL. IT CERTAINLY CAN. SO DO IT, DO IT BEFOREHAND, BUT AMEND THAT TO SAY ONCE APPROVED BY LEGAL. NO, I'M, I'M NOT WILLING TO DO THAT. WHY NOT? BECAUSE I, THAT'S NOT MY MOTION. . I, I'M, I'M, I'M TELLING YOU GUYS, WE'RE, WE'RE, UH, WE'RE, WE'RE EXPOSING A LOT TODAY. WE ARE EXPOSING A LOT. SO, UH, I, I'M, I'M NOT FOR THAT. UM, AND, AND, AND WON'T VOTE FOR THAT. OKAY. UM, AND, AND RECOMMEND OTHERS DON'T AS WELL. UM, OKAY. SO MY, MY MOTION IS TO AMEND THE, UM, RULES AND PROCEDURES AND CONDUCT OF DECORUM AT THE MEETING OF THE COMMISSIONER'S COURT, ROCKWALL COUNTY, TO ADD A SECTION THAT SAYS ONLY THE COMMISSIONER THAT MAKES THE MO OR THAT THAT, UM, THAT PUTS THE AGENDA ITEM ON ITEM CAN REMOVE THE AGENDA ITEM. IS THAT, YEAH. ALL RIGHT. SO YOU GOT A MOTION BY COMMISSIONER BAILEY SECOND. SECOND BY COMMISSIONER S SEVERE. [02:10:01] UH, AND I DO HAVE A QUESTION. SO I MEAN, THOSE, THOSE CAN COME BACK UP LATER. SO I JUST WANNA TRY TO GET UP THE VOTE FOR TODAY. MY, MY, MY QUESTION IS, SO NOW WE'RE GONNA HAVE THE, THE SPONSORING COMMISSIONER AND THE DEPARTMENT HEAD, CAN THE DEPARTMENT HEAD NOT PULL THINGS OFF AS WELL? IF THEY SAY, I WANNA BRING IT, THIS SPECIFICALLY SAYS THE COMMISSIONER THAT PLACES THE ITEM ON THE AGENDA. WHAT, WHAT IS THE ONLY PERSON THAT JUDGE PLACES THE ITEM ON THE AGENDA OR THE AUDIT? THEN YOU TAKE IT OFF. BUT IT DOESN'T SAY THAT. IT SAYS COMMISSIONER SLASH COMMISSIONER. JUDGE, THEN I THINK COMMISSIONER'S COURT. YEAH. ANY, ANY MEMBER ON THE COMMISSIONER'S COURT? YEAH. WHAT ABOUT THE AUDITOR? SHE'S NOT ON THE COMMISSIONER'S COURT, I UNDERSTAND THAT. BUT SHE HAS THE, THE RIGHT TO PUT THINGS ON THE AGENDA. IF YOU AGREE TO PUT IT ON. SHE HAS TO COME TO ONE OF US TO HAVE IT PUT ON IT. THERE'S A COURT ORDER THAT SAYS SHE CAN PUT IT ON THERE. THAT WAS SIGNED IN 2002, I BELIEVE. UM, BY JUDGE BELL, CORRECT. OKAY. SORRY. SO TRYING TO, TRYING TO LIMIT NO, THE AUDITORS, NO, THAT'S BEEN, IT'S BEEN, I DON'T THINK THAT'S THE POINT. I THINK MY COMMENT IS, I BELIEVE IN THE SPIRIT OF WHAT YOU'RE TRYING TO DO. COMMISSIONER BAILEY, I JUST FEEL LIKE WE NEED TO VET SOME OF THIS OUT. SO I, I'M, I'M NOT NECESSARILY SUPPORTING YOUR ITEM AS YOU PRESENT IT, BUT I 100% AGREE IN THE SPIRIT. WE NEED TO MAKE SURE THAT IT'S FELT, SPELLED OUT VERY CLEAR THAT IF WE DECIDE AS A COMMISSIONER, I DECIDE I WANT SOMETHING HEARD IN THIS COURT, IT'S GOING TO BE HEARD. CORRECT. AND I'M, AND I'M 100% IN FAVOR OF THAT. I JUST DON'T WANT TO GET TO WHERE WE'RE CUTTING AND, AND WE'RE, WE'RE JUST AMENDING THIS THING FIVE OR SIX TIMES IN THE, IN THE NEXT THREE OR FOUR MEETINGS. I, I, I WANT ONE CUT. AND THAT'S MY, MY, I I THINK THAT THAT'S IMPORTANT. BUT MY COMMENT IS, I'M, I'M, I'M NOT IN FAVOR OF YOUR MOTION, BUT NOT BECAUSE I DON'T LIKE THE SPIRIT. I JUST THINK THAT I WANT ONE CUT OF ABOUT FOUR OR FIVE AMENDMENTS. THAT, THAT'S JUST MY OPINION. AND, AND I CAN BE OUTVOTED. THAT'S JUST MY OPINION. SO I, I'M ASSUMING THE MOTION STANDS, WE HAD A MOTION BY COMMISSIONER BAILEY THAT AS, AS, AS IT STATED, AS A MEMBER, WILL ESSENTIALLY BE IN CONFLICT AND, AND NOT ALLOW THE AUDITOR TO TAKE SOMETHING OFF. UH, AND WE HAVE A SECOND BY COMMISSIONER S. SEVERE. NO, I'M NOT. I'M NOT, NO. NOT THE AUDITOR. NO. SO WE ARE GOING TO REGISTER OUR VOTES. UH, REGISTER YOUR VOTES NOW. VOTE. AMEND YOUR, AMEND YOUR MOTION. WE ARE, WE'RE IN THE MIDDLE OF VOTING RIGHT NOW. LET'S, I I'M, I'M GONNA VOTE NO FOR THAT THEN YOU'RE, AND YOU'RE FREE TO MAKE ANOTHER MOTION. SO AND SO NOW I'M FREE TO MAKE ANOTHER MOTION. ITS FOUR TO ZERO WITH ONE ABSTENTION. CORRECT. THAT MOTION. YEAH. SUSTAIN ME. SORRY. I, I TOLD JENNIFER I WOULD DO A BETTER JOB. IT DID SAY . OKAY. SO MY MOTION NOW IS THAT ANY MEMBER OF THE COMMISSIONER'S COURT CAN PLACE AN ITEM ON THE AGENDA. TIME OUT. YEAH. SHE'S NOT ON THE COURT. HUH? SHE'S NOT ON COURT. BE CAREFUL. HE HAS OBJECT. I I I WANT TO ELIMINATE THE AUDITOR TO BE ABLE TO PLACE THAT. YOU MEAN INCLUDE, NOT ELIMINATE? YEAH. OKAY. DO YOU WANT TO INCLUDE THAT? SHE CAN PLACE ITEMS. ARE YOU SURE YOU DON'T WANNA RUN THIS BY LEGAL TO GET SOME CLEAR, CONCISE LANGUAGE AND BRING IT BACK? I MEAN, IT SEEMS WE'RE RUSHING FORWARD OFF AWFULLY QUICKLY INTO A COMPLEX, COMPLICATED ISSUE. UM, I REMOVE MY MOTION. . THANK YOU. THAT JUST MADE, YEAH. YEAH. ALRIGHT. GET, GET WITH LEGAL AND LET'S COME BACK AND TAKE A, TAKE A BIG BITE OUT OF THIS AND GET, GET THIS STUFF DONE. SO ARE WE VOTING ON YOURS? SO, SO THEN TO, TO COMMISSIONER STACEY'S, ARE WE JUST GONNA HOLD OFF ON YOURS? 'CAUSE HE JUST WANTS TO DO IT ONE TIME AND GET IT RIGHT. I I I THINK SO. OKAY. I HOPE SO. JUST BRING, BRING IT, BRING IT ALL BACK AND LET'S, WE'LL, THE NEXT AGENDA, IT SHOULD BE, I, I DON'T SEE ANY REASON WHY IT WOULDN'T BE. I, IIII THINK THAT WE SHOULD JUST, UM, KIND OF COLLECT YOU, YOU HAVE YOUR MOTION AND I, AND I THINK, UM, THAT THE COURT UNDERSTANDS THE SPIRIT OF WHAT YOU'RE TRYING TO DO. UH, I THINK THEY UNDERSTAND THE SPIRIT OF WHAT I'M TRYING TO DO, MAKE IT CLEAR TO DEPARTMENT HEADS. AND I THINK FROM THE DISCUSSION STANDPOINT, I DON'T HAVE ANY ISSUE WITH WHAT FRANK LAID OUT. THE ONLY OTHER THING I WOULD ASK IS IF YOU'RE GOING TO DO THE AUDITOR BY RULE TO BE [02:15:01] NOT THE RULE, CAN YOU JUST SINGLE THE AUDITOR OUT OR SINGLE OUT OTHER COURT ORDERS PASSED BY THE COURT? UM, SO THAT, THAT WAY WE DON'T HAVE, WE DON'T TRY TO SET A RULE AND THEN IMMEDIATELY HAVE A DEPARTMENT ACTING OUTSIDE THE RULE. AND, AND, BUT I I, I THINK WE COULD, I THINK WE COULD GET THERE, BUT THOSE ARE THE, THE SIX THAT I WOULD HAVE. OKAY. [22. Discuss/ Acton amendingthe Rockwall County Subdivision and Land Development Regulations, and all related issues; (Judge New)] ALRIGHT. WE ARE GOING TO MOVE ON TO AGENDA NUMBER 22, DISCUSS AND ACT ON AMENDING THE ROCKWALL COUNTY SUBDIVISION AND LAND DEVELOPMENT REGULATIONS AND ALL RELATED ISSUES. SO WHAT I'M BRINGING FORWARD TODAY IS THE 2 3 2 1 1 0 INFRASTRUCTURE CALCULATION METHODOLOGY. SO BEEN WORKING, UH, QUITE A BIT ON THIS ONE TO TRY TO GET SOMETHING, AS I MENTIONED WITH THE MEETING WITH, UH, DR. HORTON AND THE RIVER ROCK ENGINEERS, I'M TRYING TO GET, SOMETHING CAN BE A PART OF OUR APPLICATION PROCESS THAT WE CAN HAND TO DEVELOPERS AND SAY, HERE'S HOW WE'RE GOING TO CALCULATE YOUR INFRASTRUCTURE APPORTIONMENT, UH, SO THAT THEY CAN CALCULATE IT THEMSELVES, UH, WHEN, WHEN THEY'RE FACTORING IN THEIR COST. UH, SO YOU SEE THE 16 ITEMS HERE. SOME OF THEM, UH, YOU, YOU JUST AREN'T CALCULATIONS. IT'S LITERALLY A TOGGLE SWITCH OF DO YOU HAVE IT, CHECK YES OR NO, GIVE US DOCUMENTATIONS THAT PROVE YOU HAVE IT. IT, UH, OTHERS ARE REQUIRED BY STATE LAW TO BE, UH, CALCULATED BY ENGINEERS. UH, SO THAT, THAT, UH, IS LAID OUT IN HERE. UH, THE FIRST ONE IS SCHOOLS. UH, YOU TAKE THE NUMBER OF HOMES CALCULATING ONE HALF A STUDENT PER HOME, AND I GOT THAT FROM BOTH SCHOOL DISTRICTS, MULTIPLIED BY $75,591 PER STUDENT EQUALS THE PROPORTIONATE COST OF INFRASTRUCTURE FOR SCHOOLS. AND JUST SO YOU KNOW, THAT'S NOT MAINTENANCE AND OPERATIONS. THAT IS BUILDINGS AND HARD COSTS THAT ARE ATTACHED TO EACH STUDENT. UH, FOR FOR NEW DEVELOPMENT. FOR NEW DEVELOPMENT, CORRECT? CORRECT. UH, YOU'VE GOT RHODES COUNTY ENGINEER. AGAIN, THIS IS ONE BY STATE MANDATE COUNTY ENGINEER TO DETERMINE DEVELOPMENTS PROPORTIONATE COST. UH, IT MAY REQUIRE DEVELOPMENT TO COMPLETE VARIOUS TRAFFIC STUDIES. UH, NUMBER THREE, ESC AND EMT CALCULATED BY EMERGENCY MANAGEMENT COORDINATOR, MAINTAINING CURRENT LEVEL OF SERVICE FIRE. UH, NUMBER FOUR, FIRE CALCULATED BY FIRE MARSHAL TO MAINTAIN CURRENT LEVEL OF SERVICE. URBAN CALCULATED BY RESPONSE TIME. NUMBER FIVE, POLICE CALCULATED BY SHERIFF, MAINTAINING CURRENT CITIZEN TO DE DEPUTY RATIO. WHAT? AND, AND THAT'S, YOU KNOW, IT, IT, IT IS WHATEVER IT IS. BUT THAT'S ROUGHLY WHERE, OKAY, WHERE, WHERE WE'RE AT IS 1000 TO ONE. UM, NUMBER SIX, WATER CALCULATED BY WATER PROVIDER, UH, NORTH TEXAS MUNICIPAL WATER DISTRICT OR COMPARABLE, MAINTAINING CURRENT AVAILABILITY. NUMBER SEVEN, SEWER PROOF OF PROFESSIONALLY OPERATED SEWER FACILITY AGREEMENT OR RETAINAGE POND SUFFICIENT TO KEEP ALL DISCHARGE ON THE DEVELOPMENT OR TCEQ APPROVED PACKAGE PLANT WITH ACCEPTABLE HYDROLOGIC IMPACT ANALYSIS SHOWING NO NEGATIVE IMPACT TO SURROUNDING LANDOWNERS OR OTHERS DOWNSTREAM WITH AN ENVIRONMENTAL IMPACT ANALYSIS AND TREE MITIGATION PLAN. NUMBER EIGHT, BROADBAND PROOF OF BROADBAND PROVIDER IN THE DEVELOPMENT. UH, NUMBER NINE, ELECTRIC PROOF OF ELECTRIC PROVIDER IN THE DEVELOPMENT. 10 NATURAL GAS PROOF OF NATURAL GAS IN THE DEVELOPMENT. 11 OPEN SPACE APPROVAL BY OPEN SPACE ALLIANCE SHOWING COMPLIANCE WITH OPEN SPACE PLAN. UH, NUMBER 12, DRAINAGE RETAINAGE POND SUFFICIENT TO KEEP ALL DRAINAGE ON THE DEVELOPMENT WITH ACCEPTABLE HYDROLOGIC IMPACT ANALYSIS SHOWING NO NEGATIVE IMPACT TO SURROUNDING LAND OWNERS OR OTHERS DOWNSTREAM WITH AN ENVIRONMENTAL IMPACT ANALYSIS AND TREE MITIGATION PLAN. 13 ANIMAL CONTROL PROOF OF SEVEN DAYS A WEEK. ANIMAL CONTROL 14, DISPATCH 9 1 1 GIS SERVICES CALCULATED BY SHERIFF TO MAINTAIN THE CURRENT DISPATCH TO CITIZEN RATIO. 15 TRASH REFUSE PROOF OF CITY LEVEL TRASH AND BULK TRASH SERVICE. NUMBER 16, RADIO COMMUNICATIONS CALCULATED BY SHERIFF TO MAINTAIN THE CURRENT LEVEL OF RADIO COVERAGE. SO THAT IS MY, UH, AFTER A LITTLE BIT OF EFFORT. THAT'S MY, I I I HAVE ONE COMMENT BEFORE WE, WE DIVE INTO THIS. WHEN I WAS SEEING THIS AGENDA ITEM, I THOUGHT THAT ENVIRONMENTAL HEALTH HAD A COUPLE OF ITEMS. IS THIS THE ONLY THING THAT WE'RE GONNA BE DISCUSSING TODAY? SO I, I THINK IT IS. AND, AND, AND CARISSA TELL ME WE'VE GOT SOME THINGS WE'RE WORKING ON THAT I DON'T THINK ARE READY FOR THIS COURT WILL BE READY FOR THE NEXT COURT. AND IF WE WANT TO TAKE THIS BITE THE NEXT COURT AS WELL. I'M, I'M, IT IS JUST FINE. I JUST WANTED TO MAKE SURE THAT THIS WAS ALL WE'RE [02:20:01] TALKING ABOUT BEFORE WE JUST GOT INTO A DETAILED DISCUSSION. YEAH. SO CARISSA ENVIRONMENTAL HEALTH FOR THE RECORD, , UH, THIS IS, UH, HAS BEEN PART OF THE CHANGES THAT WE'RE GOING TO PROPOSE OR HOPING TO PROPOSE AT NEXT COURT. SO IT, IT WILL IMPACT THE SUBDIVISION RULES AND REGULATIONS. SO TODAY WE REALLY NEED THE CHECKLIST FINALIZED SO THEN THAT WAY I CAN GET IT TO CONNOR. 'CAUSE WE'VE GOT SOME PLACEHOLDERS IN THE SUB REGS THAT IT CAN GO INTO. AND SO WE JUST, WE NEED THIS FINALIZED SO THAT WAY WE CAN GET THAT ADDED TO THE VERBIAGE THAT WILL HOPEFULLY BE APPROVED ON THE, THE 26TH. SO DOES THAT ANSWER YOUR QUESTION? YES. OKAY. THANK YOU. YOU'RE WELCOME. ALRIGHT. SO WE, WE NEED TO GET THIS APPROVED TODAY TO GET IT TO THEM TO BE PART OF THE UPDATES THAT'S COMING. OKAY. NUMBER FIVE. CAN WE TAKE OUT 1000 TO ONE AND JUST SAY CALCULATED BY SHERIFF MAINTAINING CURRENT CITIZEN TO DEPUTY RATIO Y YEP. I AGREE AS WELL. UM, OKAY. I KNOW BROADBAND'S A BUZZWORD. YES. CAN WE NOT SAY BROADBAND OR INTERNET? I MEAN, I, I, I DON'T KNOW THE RIGHT THING TO DO THERE, BUT, OR COULD WE JUST ASK FRIESA NICHOLS THEIR PREFERENCE AND JUST SAY, SH I BROADBAND IS, IS, IS A, IS A THING, BUT WHAT, WHAT HAPPENS IF IT CHANGES AND THEN WE'VE GOTTA REWRITE OUR SUBDIVISION REGULATIONS? 'CAUSE NOW THE INTERNET PROVIDERS ARE DIFFERENT. I, I, I AGREE WITH THAT. IF YOU'LL REMEMBER THE REASON WE, WE THAT LANDED HERE IS A CRITICAL INFRASTRUCTURE IS 'CAUSE THE FEDERAL GOVERNMENT SAYS IT'S CRITICAL INFRASTRUCTURE AND YOU CAN EXPEND ALL THE ARPA FUND RUNNING BROADBAND. BUT YES, YOU CAN. THE, THE INTENT I, AND I TAKE THE INTENT THE SAME WAY OF INTERNET. YOU, YOU GOTTA HAVE INTERNET. UM, SO IF WE WANT TO BROADEN THAT TO BROADBAND SLASH I OR EQUIVALENT, UH, I, I DON'T KNOW. I DON'T KNOW THE BEST LANGUAGE, BUT THAT, THAT, THAT'S SOMETHING, UM, LET THEM, YEAH, LET, LET THEM, LET THEM COME BACK. ALL RIGHT. AND, AND, AND THAT'S ALL I HAD ON YOUR, ON YOUR ROUGH LIST, BUT YOU LOOK LIKE YOU WANNA SAY SOMETHING BUT YOUR MICROPHONE'S NOT ON. I GOT SCHOOL. OH, IT WASN'T ON. I DON'T REALLY HAVE ANYTHING. I DON'T KNOW. ALSO, UM, SINCE WE'RE GOING TO TAKE THE 1000 TO ONE OFF OF THE SHERIFF'S, I, I GUESS THIS NUMBER AS FAR AS THE SCHOOLS IS ALSO GOING TO BE ONE THAT COULD BE CHANGING ALSO. AND, AND IT COULD BE GOING UP AND, AND THEY SAID THAT'S A VERY CONSERVATIVE ESTIMATE. OKAY. AND, AND VERY LIKELY WE WILL, WE'LL GO ON. SO WE, WE WOULD BE CHANGING IT WHEN THAT HAPPENS. MM-HMM. . OKAY. MM-HMM, . OKAY. NO OTHER QUESTIONS OR COMMENTS? OKAY. ALL RIGHT. WELL, SO I'M GONNA MAKE THE MOTION THAT WE ADOPT THE INFRASTRUCTURE CALCULATION METHODOLOGY AS EDITED. I WILL SECOND GOT MY MOTION AND GOT A SECOND IF EVERYBODY WILL REGISTER YOUR VOTES. WE GOT ONE PERSON STILL YET TO VOTE, ONE STILL YET TO VOTE, AND IT PASSES FIVE TO ZERO. ALL RIGHT. [23. Discuss/Act on adding the Boys & Girl's Club to the Rockwall County Juror Donation Request form pursuant to Texas Government Code 61.003, and all related issues; (Judge New - District Clerk)] SO THAT BRINGS US TO AGENDA ITEM 23, DISCUSS AND ACT ON APPROVING VISUAL R AND B VERSION LEVEL 11.09 SOFTWARE FROM COMP LINK LIMITED FOR THE ROAD AND BRIDGE DEPARTMENT AND ALL RELATED ISSUES. MS. SPEARMAN, I SAW YOU HERE. COME ON UP AND WHILE, WHILE, WHILE YOU COME UP, UH, WHILE THE AMOUNT IS NOT BUDGETED, IT'S A $1,558 IMPACT. YES. BUT WE DO HAVE ROOM IN THE BUDGET UNDER THE CONTRACT SERVICES LINE ITEM. UM, SO WHAT HAPPENED WAS WE DID HAVE A VERY SIMILAR SOFTWARE PACKAGE A FEW YEARS AGO. THE LADY PASSED AWAY AND IT ALL WENT OBSOLETE. SO WHEN I GOT A NEW COMPUTER, EVERYTHING WENT AWAY JUST THE WAY IT WAS. SO WE'VE BEEN KIND OF MUDDLING AROUND DOING IT THE OLD SCHOOL WAY, I GUESS YOU COULD CALL IT, AS FAR AS HANDWRITING AND KEEPING TRACK OF EVERYTHING. AND IT REALLY CAME BACK TO A HEAD A WHILE BACK BECAUSE EVERY YEAR WHEN I'M DOING AUDITOR REPORTS FOR LISA, IT TAKES LONGER. DENNIS CALLED ONE MORNING NEEDING SOMETHING QUICKLY. I COULDN'T GET IT TO HIM QUICKLY ANYMORE. SO WE STARTED REVISITING IT AND WE CAME ACROSS THAT THERE INDEED WAS A SIMILAR SOFTWARE COMPANY. 'CAUSE THE ONES WE'D RESEARCHED BEFORE WERE HUGE, TENS OF THOUSANDS OF DOLLARS SUITED GREAT FOR DALLAS AND METROPLEXES, NOT [02:25:01] FOR US. SO I'M COMING TO YOU TODAY TO ASK THAT WE CAN GET BACK ONLINE WITH A ROAD MANAGEMENT SYSTEM, WHICH WE'LL INPUT THE ROADS, WE'LL PUT, ABLE TO THEN PUT IN THE EMPLOYEES, UM, PAY RATES, THE MACHINE COST AND ALL OF THAT. AND THEN VERY QUICKLY BE ABLE TO EITHER GIVE A WORK ESTIMATE OR GIVE A WORK FINAL, UM, TO PROVIDE THE INFORMATION NEEDED SO THEN WE KNOW EXACTLY WHAT WE'RE DOING AT ALL TIMES. IT IS GOOD TO KNOW EXACTLY WHAT YOU'RE DOING AT ALL TIMES. YEAH, I CAN'T WAIT. IT STILL PROBABLY WON'T HAPPEN, BUT, YOU KNOW, WE'LL TRY . THAT IS GOOD. DOES ANYBODY HAVE ANY QUESTIONS? NO. I'LL MAKE A MOTION IF ANYBODY DOESN'T HAVE ANY QUESTIONS, I'LL MAKE A MOTION THAT WE APPROVE, UM, THE VISUAL R AND B VERSION, LEVEL ONE 1.09 SOFTWARE FROM COPY LINK LIMITED FOR THE ROAD AND BRIDGE DEPARTMENT. SECOND, GOT A MOTION BY COMMISSIONER M**K, A SECOND BY COMMISSIONER, SEVER. ANY FURTHER QUESTIONS OR COMMENTS? IF WHOOPS, BEAR WITH ME IF YOU'LL REGISTER YOUR VOTES PASSES. FIVE TO ZERO. THANK YOU, MA'AM. THANK YOU. [24. Discuss/Act on approving Visual R&B Version Level 11.09 software from CompuLink, Ltd., for the Road & Bridge department, and all related issues; (Judge New - Auditor - Shelly Spearman)] ALL RIGHT, THIS BRINGS US TO AGENDA ITEM 24, DISCUSS AND ACT ON APPROVING A COPIER LEASE WITH CPI FOR THE SHERIFF'S OFFICE AT A MONTHLY COST OF $174, INCLUDING ALL MAINTENANCE AND SUPPLIES AND ALL RELATED ISSUES. THAT, THAT IS CHEAP THAT APPROVE, BUT IS IT A MOTION? DID YOU MOVE TO APPROVE? I'LL SECOND. GOT A MOTION BY COMMISSIONER S SEVERE, A SECOND BY COMMISSIONER STACEY, ARE THERE ANY FURTHER QUESTIONS? I JUST HAVE A QUESTION. IS IT IN THE BUDGET? WAS THIS AMOUNT IN THE BUDGET? IT CAN BE ABSORBED BY THE BUDGET COMMISSIONER. IT, IT WAS NOT SPECIFICALLY BUDGETED, BUT IT'S A, A MINIMAL AMOUNT TO COMPARED TO THE OVERALL SHERIFF'S BUDGET. OKAY. SO IT WILL BE ABSORBED. OKAY. ANY FURTHER QUESTIONS OR COMMENTS? IF NOT, IF YOU'LL REGISTER YOUR VOTES. IT PASSES FIVE TO ZERO. [25. Discuss/Acton approvinga copier lease with CPI for the Sheriffs office at a monthly cost of $174.00 including all maintenance and supplies, and all related issues; (Judge New - Auditor)] ALL RIGHT. THAT BRINGS US TO AGENDA ITEM 25, DISCUSS AND ACT ON APPROVING A CONTRACT WITH RENEE BATES AUCTIONEERS INCORPORATED TO UTILIZE THEIR ONLINE AUCTION SERVICES TO SELL THE COUNTY'S SURPLUS ITEMS IN ALL RELATED ISSUES. UH, WE WOULD JUST LIKE TO EXPAND THE AUDITOR'S ABILITY TO USE DIFFERENT AUCTION COMPANIES. AND THIS IS ONE THAT WE ARE ASKING YOUR APPROVAL TO BE ALLOWED TO DO WITH YOUR SURPLUS. SO HAS THIS GONE THROUGH A LEGAL REVIEW AND OR WILL IT GO THROUGH A LEGAL RE? CRAIG'S GIVEN ME THE THUMBS UP SO I WITHDRAW THE QUESTION. THANK YOU, CRAIG. UH, SO DOES ANYBODY HAVE ANY QUESTIONS? ARE THERE COSTS INVOLVED WITH THIS? LISA? UH, THE, THE BUYER NORMALLY, YOU KNOW, ABSORBS THE COST. IT'S 10% FEE THAT THEY, THEY COLLECT FROM THE BUYER. OKAY. UM, ALL RIGHT, WELL, I'LL MAKE A MOTION. WE APPROVE A CONTRACT WITH RENEE BATES AUCTIONEERS INCORPORATED TO UTILIZE THEIR ONLINE AUCTION SERVICES TO SELL COUNTY SURPLUS ITEMS. SECOND, GOT A MOTION BY COMMISSIONER STACEY, SECOND BY COMMISSIONER SEVER. IF YOU'LL REGISTER YOUR VOTES NOW, IT PASSES FIVE TO ZERO. [26. Discuss/Acton approvinga contract with Rene Bates Auctioneers, Inc. to utilize their online auction services to sell the County's surplus items, and all related issues; (Judge New - Auditor)] OKAY. THAT BRINGS US TO AGENDA ITEM 26. DISCUSS AN ACT ON APPROVING A QUOTE WITH VISTA COM FOR AN IDE DX RECORDER UPGRADE FOR THE SHERIFF'S OFFICE AND ALL RELATED ISSUES. SHERIFF, DO YOU WANT TO TALK ABOUT THIS? NO, I, I JUST, THE, THE EXCITEMENT IS JUST, AND, AND, AND OVERWHELMING. THE, THE ONLY REASON I ASK, I'M, I CAN DO IT. WELL, NOT THE AMOUNT OF MONEY I'VE READ THROUGH THIS THING. I DON'T KNOW HOW MANY TIMES, AND MAYBE I'M A LITTLE REMEDIAL, BUT WHAT ARE WE, WE RECORDING? WE RECORD EVERY CALL THAT COMES INTO THE SHERIFF'S OFFICE. OKAY. TH TH THANK YOU BECAUSE I, I'M LIKE, THIS HAS RADIOS IN IT. WHAT, WHAT IT'S GOT, BUT THERE'S ONLY, IT RECORDS ALL FOUR OF THEM AND RECORDS. WELL, IT RECORDS ALL THE CHANNELS ON THE RADIO. OKAY. AND RECORDS ALL THE 9 1 1 CALLS AND ANY ADMINISTRATIVE CALLS COMING IN TO THE DISPATCH CENTER. NOT ONCE IT'S OUT TO AN OFFICE. OKAY. THA THANK YOU. THANK YOU. AND JUDGE, THIS WAS, UH, SUBMITTED AT BUDGET TIME TO, AND WAS RE APPROVED. UH, THE REASON IT'S BROUGHT IN FRONT OF THE COURT IS THAT THERE'S TERMS AND CONDITIONS THAT, THAT WHEN WE ARE, WHEN WE RECEIVE THOSE, WE HAVE TO BRING THEM THROUGH LEGAL AND THROUGH YOU ALL TO ACKNOWLEDGE AND APPROVE, UM, PER A COURT ORDER. NO, I'M KIDDING. YEAH, YEAH, TOTALLY KIDDING. SO, UH, THE ONE THING THAT LEGAL DID COMMENT ON THAT, UM, THAT JUST TO BE A AWARE THAT IT, UH, THERE IS A 35% RESTOCKING FEE. SO IF SOMETHING OF THIS HAD TO BE RETURNED, UH, IT WOULD BE AN EXPENSE TO THE COUNTY. BUT I, I BELIEVE THAT THIS IS JUST AN UPGRADE TO A SERVICE THAT THE SHERIFF ALREADY USES. SO I DON'T, I [02:30:01] DON'T FORESEE A PROBLEM, UH, WITH THIS. IT JUST UPGRADES OUR CURRENT SYSTEM. I SEE. GOT IT. GOT IT, GOT IT, GOT IT. WELL, I WILL MOVE THAT WE APPROVE A QUOTE WITH VISTA COM FOR THE EVEN TIE DX RECORDER UPGRADE AT THE SHERIFF'S OFFICE. GOT A MOTION BY COMMISSIONER STACEY. I'LL SECOND THAT SECOND BY COMMISSIONER M**K, IF YOU'LL REGISTER YOUR VOTES, IT PASSES FIVE TO ZERO. [27. Discuss/Act on approving a Quote with VistaCom for an Eventide DX Recorder Upgrade for the Sheriff's Office, and all related issues; (Judge New - Auditor)] ALL RIGHT. THAT BRINGS US, I BELIEVE, TO AGENDA ITEM 27, DISCUSS AN ACT ON APPROVING A QUOTE WITH LINE V SYSTEMS TO PURCHASE AN X-RAY INSPECTION SYSTEM AT THE NEW COURTHOUSE. IN ALL RELATED ISSUES, UH, I CAN TAKE THIS ONE JUDGE IF YOU'D LIKE . THANK YOU. UH, THIS WAS ANOTHER ONE THAT WAS APPROVED AT BUDGET TIME FOR AN X X-RAY MACHINE AT THE, AT THE BIG COURTHOUSE OR THE MAIN COURTHOUSE. AND, UM, BECAUSE OF THE TERMS AND CONDITIONS WE FELT, LIKE I SAID ON THE LAST AGREEMENT, THIS IS WHY IT'S BEING BROUGHT TO YOUR ATTENTION AT THE TIME. YEAH, IF YOU'LL REMEMBER THAT OUR, OUR CURRENT SYSTEM IS NO LONGER, UH, SUPPORTED, WHICH IS STANDARD BUSINESS. YEP. STANDARD BUSINESS PRACTICE FOR ANY VENDOR DEALING WITH A COUNTY IS STOP SUPPORTING AND WE'LL WRITE YOU A NEW PO. UM, SO, UH, IT, IT IS BUDGETED IS AND IS NEEDED. SO I'LL ENTERTAIN A MOTION. MOVE TO APPROVE. GOT A MOTION BY COMMISSIONER SEVER. SECOND. SECOND BY COMMISSIONER M**K, IF YOU'LL REGISTER YOUR VOTES NOW PASSES FIVE TO ZERO. [28. CONSENT AGENDA: ] AND THAT BRINGS US TO AGENDA ITEM NUMBER 28, CONSENT AGENDA. I'LL MOVE TO APPROVE THE CONSENT AGENDA AS PRESENTED 28 A THROUGH F. GOT A MOTION BY COMMISSIONER STACEY SECOND. SECOND BY COMMISSIONER S SEVERE. ARE THERE ANY FURTHER QUESTIONS OR COMMENTS? IF YOU'LL REGISTER YOUR VOTES PASSES FIVE TO ZERO. [29. PROPERTY ACQUISITIONS/DISPOSITIONS: ] THAT BRINGS US TO AGENDA ITEM 29, PROPERTY ACQUISITIONS AND DISPOSITIONS. WE'RE GONNA DISCUSS AND ACT ON APPROVING THE FOLLOWING PROPERTY ACQUISITIONS AND DISPOSITIONS OF FIXED ASSETS. AND THERE ARE THREE ITEMS. UH, PURCHASING A HONDA GENERATOR AT A COST OF $4,499 TRANSFERRED TO SURPLUS, APPROXIMATELY FOUR BOXES OF MISCELLANEOUS OBSOLETE LAW BOOKS AND THE SHERIFF'S TRANSFERRING OFFICE CHAIRS AND TO SURPLUS, MOVE TO APPROVE. GOT A MOTION BY COMMISSIONER BAILEY. IT'S SECOND BY COMMISSIONER SEVER. IF YOU'LL REGISTER YOUR VOTES, IT PASSES FIVE TO ZERO. [30. NON-EMERGENCY BUDGET TRANSFER(S): ] SO THAT BRINGS US TO AGENDA ITEM 30, NON-EMERGENCY BUDGET TRANSFERS. I MOVE, WE APPROVE NON-EMERGENCY BUDGET TRANSFER 2025 DASH OH ONE. GOT A MOTION BY COMMISSIONER STACEY. I'LL SECOND IT SECOND BY SECOND IT SECOND BY COMMISSIONER M**K, IF YOU'LL REGISTER YOUR VOTES, IT PASSES FIVE TO ZERO. ALL RIGHT. [31. APPROVAL OF ACCOUNTS, BILLS, CLAIMS, AND PAYROLL(S): ] THAT BRINGS US TO AGENDA ITEM 31. APPROVAL OF ACCOUNTS, BILLS, CLAIMS AND PAYROLL. YES, SIR. I'M SUBMITTING TO THE COURT THE PAID CLAIMS, THE AMOUNT OF $603,771 AND 6 CENTS. AND I ASK FOR THE COURT'S APPROVAL. MOVE TO APPROVE. GOT A MOTION BY COMMISSIONER STACY. SECOND. SECOND BY COMMISSIONER BAILEY, IF YOU'LL REGISTER, YOUR VOTES PASSES FIVE TO ZERO. I'M ALSO SUBMITTING TO THE COURT UNPAID CLAIMS IN THE AMOUNT OF $2,144,853 AND 88 CENTS.
