UM, THE OCTOBER WELLNESS PALOOZA WAS DESIGNED TO ENCOURAGE ROCKWALL COUNTY EMPLOYEES TO TAKE CHARGE OF THEIR HEALTH THROUGH A RANGE OF WELLNESS ACTIVITIES. FOR EVERY EVENT ATTENDED EMPLOYEES EARNED A WELLNESS TICKET, WHICH AFFORDS THEM THE ELIGIBILITY TO TAKE PART IN A DRAWING FUNDED BY THE UNITED HEALTHCARE. ALSO, ON TUESDAY, NOVEMBER 19TH, A RANDOM PRIZE DRAWING TOOK PLACE, AND FIVE FORTUNATE PARTICIPANTS FROM THE WELLNESS PALOOZA, UM, WON A $100 AMAZON GIFT CARD. SO, PARTICIPATING IN THESE ACTIVITIES CAME OFF SOME OF THE EVENTS DURING THE OCTOBER AS WELLNESS PALOOZA ARE COOKING DEMONSTRATIONS, UH, FOCUSING ON HEALTHY FOODS, UH, WHICH IN TURN GIVE YOU A HEALTHY NIGHT'S SLEEP. UM, MEDITATION AND RELAXATION SESSIONS, UH, EXA BREAST EXAMS. THEY CAME INTO THE HR SUITE AND WERE ABLE TO PERFORM EXAMS ON 41 OF THE FEMALES, UM, WHO WERE EITHER EMPLOYED WITH ROCKWALL COUNTY OR MEMBERS OF OUR HEALTHCARE PLAN. UM, CHAIR MASSAGES, WHICH WERE WONDERFUL. THE COUNTY PARTNERED WAS HELPING HANDS TO HOST, UM, ONE DAY WHERE THEY DEDICATED THEIR TIME TO DOING ANNUAL PHYSICALS FOR OUR EMPLOYEES. UH, WE HAD A COMPANY COME IN TO DO BIOMETRIC SCREENING, WHICH, UH, CHECKS BLOOD PRESSURE, CHOLESTEROL, UM, GLUCOSE, AND 35 OF OUR EMPLOYEES PARTICIPATED IN THAT. WE ALSO HOSTED A FLU SHOT CLINIC, SO WE HAD OVER 200 PARTICIPANTS IN OUR WELLNESS PALOOZA, WHICH WE'RE VERY PROUD [00:05:01] OF. I APPRECIATE YOUR TIME THIS MORNING, ESPECIALLY WITH THE HOLIDAYS APPROACHING. AT THE LAST COMMISSIONER COURT MEETING, THERE WAS, UH, UH, 16 ITEMS THAT WERE ADDED AS COUNTY FEES ONTO A NEWLY PLATTED LOT WITHIN THE COUNTY. AND SO WHAT I'VE HANDED YOU TODAY WITH THE HELP OF MY, MY YOUNGEST SON HERE IS, UH, YOU KNOW, WE'RE, WE'RE DEVELOPERS. WE, WE OWN A DEVELOPMENT COMPANY JUST FOR, FOR FULL DISCLOSURE. AND WE'VE LOOKED AT PROPERTY OUT IN THE COUNTY BEFORE FOR DEVELOPMENT, FOR DEVELOPMENT PURPOSES. AND SO OUR CLIENTS AND, AND THE PEOPLE THAT WE SELL LOTS TO HAVE SAID, HEY, IF, IF YOU DEVELOP A ONE ACRE OR AN ACRE AND A HALF LOT IN THE COUNTY, IT'S GONNA BE WORTH $250,000. WE'LL BUY IT FROM YOU FOR $250,000. SO ALL THROUGHOUT THIS COUNTY, YOU HAVE LANDOWNERS JUST LIKE MY FATHER-IN-LAW, WHO HAVE PUT YEARS AND YEARS WORTH OF THEIR BLOOD, SWEAT, AND TEARS AND SACRIFICES INTO THEIR PROPERTY. AND SO THEN THE DEVELOPER COMES ALONG AND SAYS, HEY, I WANNA BUY THAT PROPERTY. WE HAVE SOME CLIENTS THAT ARE INTERESTED IN PURCHASING THESE LOTS, SO I'M GONNA SELL YOU MY PROPERTY. SO IF WE TAKE THAT $108,000 PER LOT AND WE DIVIDE IT BY 1.95, WE'RE LEFT WITH A PER ACRE VALUE FOR THE LAND OF $55,000 PER ACRE. THAT'S WHAT WE CAN PAY THE LANDOWNER. NOW, THE LOWER BOX. WE CAN'T JUST SUDDENLY SAY, WELL, NOW A LOT'S WORTH MORE THAN IT WAS YESTERDAY. WE STILL TAKE OUT OUR 20% MARGIN. WE STILL TAKE OUT OUR A HUNDRED THOUSAND DOLLARS DEVELOPMENT COST. THE FEES THAT WERE ADDED BY OUR CALCULATION ARE GONNA ADD ABOUT $60,000 PER LOT. MAYBE MAYBE WE END UP WITH FIVE OR 6% OF THAT AT THE END OF THE DAY, AND WE'RE TALKING ABOUT RISKING MILLIONS OF DOLLARS TO EARN FIVE OR FIVE OR 6%. AT THE END OF THE DAY, I URGE YOU AS A COURT TO TAKE A LOOK AT WHAT YOU DID AT THE LAST COMMISSIONER'S, COMMISSIONER'S HEARING, AND ALSO WHAT YOU'RE PLANNING TO DO TODAY. I DON'T LIKE THAT PLAN 'CAUSE IT PUTS IT ON US. WHY SHOULD WE GIVE UP OUR HIGH QUALITY OF LIFE FOR TRAFFIC? THAT'S NOT US? LET'S PUT ALL OF OUR MONEY THAT WE PAY AS CITIZENS INTO IMPROVING LITTLE COUNTY ROADS, WHICH REALLY NEED IT. ADE ROAD REALLY NEEDS IT. RED VALLEY RUN COULD USE A LITTLE BIT, BUT LET'S DO US BEFORE WE ACCOMMODATE THEM, ESPECIALLY WHEN IT COMES TO OUR ANIMALS, BECAUSE IF YOU PUT A ROAD THROUGH, YOU'RE GONNA KILL THE ANIMALS. SO THE FIRST LETTER GOES SOMETHING LIKE THIS, DEAR TAXPAYER, HEY, YOU PROBABLY JUST OVERLOOK THIS, BUT YOUR TAXES ARE DELINQUENT AND YOU MIGHT WANNA PAY 'EM. UH, THE LETTERS INCREASE IN SEVERITY THROUGHOUT THE YEAR TO THE POINT WHERE FINAL, ON THE FINAL LETTER, AND I BELIEVE WE DO SIX TO SIX TO EIGHT LETTERS A YEAR, IN ADDITION TO WHAT THE TAX THE APPRAISAL DISTRICT SENDS OUT. UH, THE FINAL LETTER BASICALLY SAYS, YOU NEVER PAID YOUR TAXES, WE'RE ABOUT TO TAKE YOUR PROPERTY. UH, IF THEY HAVEN'T FIGURED IT OUT BY THEN, THEN ODDS ARE THEY'RE NOT LIKELY TO PAY IT. NOW, THROUGHOUT THIS WHOLE PROCESS, WE MAKE EVERY EFFORT TO ENTER INTO PAYMENT AGREEMENTS THAT ARE ACCEPTABLE TO BOTH THE TAXING AUTHORITIES AND THE TAXPAYER SO THAT PEOPLE ARE ABLE TO KEEP THEIR PROPERTY. BECAUSE THE LAST THING WE OR THE COUNTY, OR THE SCHOOL OR THE CITY WANNA DO IS TAKE AWAY SOMEBODY'S PROPERTY. BUT THAT'S A MEASURE THAT'S NECESSARY WHENEVER THE, THE TAXES DON'T GET PAID, BECAUSE ALL THE OTHER TAXPAYERS THAT ARE PAYING THEIR TAXES HAVE TO MAKE UP THE DIFFERENCE FOR THE ONES THAT AREN'T. UH, SO DURING THE TIME THAT WE'RE TRYING TO NEGOTIATE PAYMENT AGREEMENTS, OBVIOUSLY WE WOULD LOVE FOR THE ACCOUNT TO BE PAID IN FULL, BUT THAT DOESN'T ALWAYS HAPPEN. SO WE DO COME UP WITH PAYMENT AGREEMENTS THAT ALLOW THE TAXPAYERS TO PAY OFF THEIR DELINQUENT AMOUNTS, UH, WHILE AT THE SAME TIME PRESERVING THEIR, THEIR PROPERTY. GOING INTO SECOND PAGE, THIS IS WHERE KIND OF WE GET TO THE NITTY GRITTY. SO THE TIME PERIOD THAT WE'RE REPORTING ON TODAY IS JULY 1ST, 2023 TO JUNE 30TH, 2024. THIS IS THE ONE YEAR PERIOD AFTER WE WERE PROVIDED THE DELINQUENT ACCOUNTS FOR THE 2022 TAXES. SO THE MONEY THAT WE'RE TALKING ABOUT IN THIS REPORT WHILE BEING COLLECTED OVER THE LAST YEAR, IS ACTUALLY THE 2022 TAX YEAR THAT HAVE BECOME DELINQUENT 2022 AND PRIOR. SO DURING THAT YEAR, UH, WE FILED 53 LAWSUITS, [00:20:01] UH, AGAINST 76 DIFFERENT ACCOUNTS. HOW DO YOU COME UP WITH THOSE SO MUCH DIFFERENT, UH, ACCOUNT NUMBERS VERSUS LAWSUITS? WELL, IT'S WHEN YOU HAVE PROPERTY OWNERS THAT OWN MORE THAN ONE PROPERTY, AND THEY'RE DELINQUENT ON SEVERAL, SO WE'LL INCLUDE THEM ALL IN THE SAME LAWSUIT. SO YOU HAVE A 56 LAWSUIT, OR 53 LAWSUITS ON 76 ACCOUNTS, UH, FOR A TOTAL REPRESENTING A TOTAL AMOUNT DUE TO THE COUNTY OF 168,000 CHANGE. UM, I TOLD YOU THERE WAS AN EXCEPTION WHEN WE TAKE THE ACCOUNTS BEFORE JULY 1ST, UH, HERE IN ROCKWELL COUNTY, THAT ALL OF THE ENTITIES HAVE IMPLEMENTED, UH, EARLY COLLECTIONS ON PERSONAL PROPERTY ACCOUNTS, UH, UNDER SECTION 33 11 OF THE TAX CODE. WHAT THAT MEANS IS ON PERSONAL PROPERTY, AND IT GENERALLY TENDS TO BE BUSINESS PERSONAL PROPERTY, UH, WE ARE ABLE TO INITIATE THE COLLECTIONS PROCESS ON APRIL 1ST RATHER THAN JULY 1ST. AND THE RATIONALE FOR THAT IS PERSONAL PROPERTY, PARTICULARLY IN BUSINESS, IT HAS THE PROPENSITY TO LEAVE THE COUNTY WHEN IT'S WHEN, WHEN THERE'S A GOING OUTTA BUSINESS, WHEN THERE'S A CLOSING OF A BUSINESS, WHEN THERE'S A DELIBERATE EVASION OF PAYING TAXES. SO THE LAW ALLOWS THE ENTITIES TO PROCEED WITH TAX WARRANTS, UH, THREE MONTHS EARLY IN ORDER TO PROTECT THE PROPERTY THAT SECURES THE TAXES, BECAUSE ON PERSONAL PROPERTY, ONCE THAT PROPERTY IS GONE, SO ARE THE TAXES. UH, SO THIS IS A MEASURE THAT WE TAKE. WE DID THAT SIX TIMES LAST YEAR. UH, THE AMOUNT WAS FAIRLY LOW, UH, COMPARATIVELY SPEAKING FOR ABOUT $5,200, WE DID, UH, DISMISS 41 LAWSUITS OVER 66 ACCOUNTS, UH, FOR A VALUE OF ABOUT $130,000. SO THE DISMISSALS ARE GENERALLY GONNA COME WHEN SOMEONE EITHER PAYS IN FULL OR COMES UP WITH A PAYMENT AGREEMENT THAT RESULTS IN US DISMISSING THE CASE. WE DID TAKE 13 SUITS TO JUDGMENT ON 15 DIFFERENT ACCOUNTS FOR ABOUT $45,000. WE RELEASED ONE OF THOSE JUDGMENTS. NOW, IT MIGHT OR MIGHT NOT HAVE BEEN ONE OF THOSE, IT COULD HAVE BEEN A JUDGMENT FROM A PRIOR YEAR, BUT IT WAS RELEASED AFTER HAVING BEEN PAID. AND THERE'S CURRENTLY 35 SUITS, UH, PENDING FOR ABOUT $106,000. SO WHAT HAPPENS NEXT? UH, BY THE WAY, I WAS READING OFF THE CHART, THE PARAGRAPHS THAT FOLLOW, GIVE A LITTLE MORE EXPLANATION OF WHAT I JUST TALKED ABOUT. WHAT HAPPENS AFTER THE JUDGMENT? WELL, WHENEVER THE LETTERS FAIL, WHENEVER THE PHONE CALLS FAIL, WHENEVER THE PERSONAL VISITS FAIL, WHENEVER THE LAWSUITS FAIL, WE GET A JUDGMENT FROM THE DISTRICT COURT IN ROCKWALL COUNTY TO DO TWO THINGS. IT'S A MONEY JUDGMENT AGAINST THE TAXPAYER, AND IT'S A FORECLOSURE JUDGMENT THAT AUTHORIZES US, UH, TO, TO, UH, PROVIDE FOR THE SHERIFF TO SELL THE PROPERTY AND PAY THE TAXES. SO WHEN THAT HAPPENS, UH, WE POST IT FOR SALE. UH, THIS HAPPENS A COUPLE, THREE TIMES A YEAR. UH, IT'S ACTUALLY ROCKWELL COUNTY HAS A VERY GOOD, UH, TAX BASE AND RESPONSIBLE TAX PAYER. SO WE DON'T HAVE TO SELL AS MANY PROPERTIES HERE AS WE DO IN SOME OTHER COUNTIES, BUT NONETHELESS, SOMETIMES IT COMES UP. WE DID THAT, UH, ON 10 TRACKS OF PROPERTY LAST YEAR FOR ALMOST $200,000. ONE THING THAT I WANTED TO POINT OUT IS HALF OF THE TOP 50 ACCOUNTS, ONE HALF OF THE TOP 50 ACCOUNTS ARE CURRENTLY IN DEFERRAL, MEANING THAT THEY'RE UNCOLLECTIBLE TO US RIGHT NOW, THEY'RE IN DEFERRAL BECAUSE THE CITIZENS ARE, UH, AUTHORIZED BY THE LAW IF THEY'RE OVER 65 OR DISABLED, TO HAVE THEIR TAXES DEFERRED UNTIL THE DEFERRAL, UNTIL THE DISABILITY OR THEIR, UH, 65 OR OVER STATUS CEASES. OBVIOUSLY, THERE'S ONLY ONE WAY THAT HAPPENS. UH, AND SO SOMETIMES THESE ACCOUNTS CAN REMAIN ON THE TAX ROLL FOR YEARS BEFORE THEY ACTUALLY BECOME COLLECTIBLE. AND I DID WANNA POINT OUT THOSE ARE INDICATED IN THE RED THERE ON THE, UH, CURRENT STATUS COLUMN. UH, BUT IT, BUT IT IS IMPORTANT TO NOTE THAT HALF OF THOSE TOP 50 ACCOUNTS ARE ESSENTIALLY SITTING THERE UNCOLLECTIBLE, UH, THE [00:25:01] REMAINING ONES, YOU CAN SEE THE GREEN, UH, PAID. THAT MEANS THAT WE WERE ABLE TO RECEIVE FULL PAYMENT ON THOSE ACCOUNTS. THERE ARE A FEW THAT WENT INTO PAYMENT AGREEMENTS. THERE ARE A COUPLE THAT THE APPRAISAL DISTRICT AFTER RESEARCH HAS CHANGED THE CLASSIFICATION AND EITHER DELETED THE ACCOUNTS OR RECLASSIFIED THEM AS EXEMPT ACCOUNTS OR, UH, OR SOMEHOW OTHERWISE DEFECTIVE AND DELETED THEM FROM THE TAX RULE. OKAY, STARTING PAGE SEVEN. UH, THIS IS THE SUMMARY OF THE ACTUAL DELINQUENT COLLECTION. SO, UH, IN THE LA IN THIS TIMEFRAME, WE COLLECTED ALMOST $600,000 IN DELINQUENT TAXES, PENALTIES AND INTEREST FOR THE COUNTY. THIS IS JUST THE COUNTY. THE OTHER ENTITIES ARE IN ADDITION TO THAT, UM, THE BREAKDOWN THERE OF 2019 THROUGH 2022, THAT REPRESENTS THE TAX YEAR FOR THE TAXES THAT WERE COLLECTED. NATURALLY, THAT PERCENTAGE ON THE RIGHT HAND, AS THE EACH YEAR PASSES, IT WILL GO UP FOR EACH YEAR. SO WE'VE COLLECTED OVER 103% OF THE 2019 TAXES, PENALTIES, AND INTERESTS. UM, A HUNDRED, A LITTLE OVER A HUNDRED PERCENT OF THE TWO 2020S, WE'RE AT 95% ON THE 2021 DELINQUENCIES, AND 94.5% ON THE 2022. SO NEXT YEAR WHEN I COME HERE, I WOULD EXPECT THE 2020 ONES TO BE CLOSE TO A HUNDRED PERCENT, AND THE 2020S TWOS TO BE IN THE 97 90 8% RANGE. UH, BELOW THAT IS THE STATUS OF ACCOUNTS CHART. THIS BREAKS DOWN THE DELINQUENT TAX ROLE FOR ROCKWALL COUNTY. UH, AND YOU CAN SEE THERE THE DEFERRAL, WHILE HALF OF THE TOP 50 ACCOUNTS ARE IN DEFERRAL, THAT THAT AMOUNTS TO, UH, UH, ALMOST 22% OF ALL THE DELINQUENT DOLLARS THAT ARE OWED TO THE COUNTY ARE CURRENTLY UNCOLLECTIBLE. BECAUSE THEY'RE IN THE DEFERRALS, ABOUT 13% OF THE DELINQUENT ACCOUNTS ARE ALREADY IN SUIT. YOU HAVE A RELATIVELY HIGH PERCENTAGE OF BANKRUPTCY ACCOUNTS. WHAT THAT MEANS IS THAT THE TAXPAYERS WERE DELINQUENT, THEY FILED BANKRUPTCY, AND WERE WAITING FOR THE BANKRUPTCY TO COME OFF BEFORE WE CAN PURSUE FURTHER, UH, COLLECTIONS EFFORTS. THOSE ACCOUNTS LIKE THE DEFERRALS ARE TEMPORARILY UNCOLLECTIBLE. UH, AND THEN THE, THE LEFT TWO CATEGORIES, UH, ACTIVE COLLECTIONS IN YELLOW ADDRESS RESEARCH AND BLUE, THEY'RE ESSENTIALLY IN THE SAME CATEGORY. THAT JUST MEANS WE'RE WORKING ON THEM. UH, MOST OF THE TIME. THE, THE DELINQUENT TAX CASES, THE REASON THAT THEY MIGHT LAST LONGER THAN THEY SHOULD IS BECAUSE TYPICALLY WE HAVE TO IDENTIFY, LOCATE, AND SERVE ANY RELEVANT OR INTERESTED PARTY IN THE, IN THE PROPERTY. A LOT, A HIGH PERCENTAGE OF THE DELINQUENT ACCOUNTS, UH, ARE OWNED BY ESTATES OR DECEASED PERSONS. SO THEN WE HAVE TO GO AND LOCATE ALL THE HEIRS, ESSENTIALLY DO, UH, A BASIC PROBATE EFFORT, UH, INDEPENDENTLY OF WHAT'S HAPPENING IN THE COURTS, JUST TO IDENTIFY AND SERVE CITATION ON THE PEOPLE THAT HAVE A POTENTIAL INTEREST. AND SO THAT'S WHAT MOST OF THE, UH, ACTIVE COLLECTIONS ARE, THAT ARE NOT IN LITIGATION YET. ONCE WE IDENTIFY ALL THE PEOPLE, WE PROVIDE THEM AN OPPORTUNITY TO SECURE THE DEFECT OR PAY THE TAXES. AND IF THEY DON'T, THEN WE'LL FILE LAWSUIT AND PROCEED THE, THE TYPICAL COURSE OF ACTION. SO THAT'S BASICALLY WHAT WE HAVE DONE OVER THE LAST YEAR. SE 7% BANKRUPTCY SEEMS PRETTY HIGH IN MY MIND, BUT IT'S, IT IS HIGH COMPARED TO OTHER JURISDICTIONS. IT'S BEEN FAIRLY CONSISTENT. NOW IT IS A LITTLE BIT ON THE SPOT. I COULD GET THE DATA AND TELL YOU WHAT, WHAT THE PERCENTAGES HAVE BEEN IN PRIOR YEARS, UM, AND WE COULD DETERMINE IF THERE'S A TREND OR NOT A TREND. I CAN TELL YOU THAT THERE'S PROBABLY, JUST BECAUSE I KNOW HOW THIS, THE TAX SYSTEM WORKS AND HOW THE DEMOGRAPHICS ARE IN ROCKWALL COUNTY, I CAN TELL YOU THERE'S PROBABLY A HIGHER PERCENTAGE OF PEOPLE IN BANKRUPTCY BECAUSE THIS GENERAL PROPOSITION, YOU HAVE A RELATIVELY, UH, HIGH INCOME LEVEL HERE COMPARED TO SOME OF THE SURROUNDING COUNTIES. AND TYPICALLY THE PEOPLE THAT ARE GONNA FILE BANKRUPTCY TEND TO BE IN THAT HIGHER INCOME LEVEL. YEAH. ACTUALLY HAVE ASSETS TO PROTECT. RIGHT, EXACTLY. SO THAT'S MY EXPECTATION OF WHY THE, THE BANKRUPTCY PERCENTAGE IS HIGHER THAN, THAN ELSEWHERE. UH, BUT I CAN CONFIRM WHAT THE TREND HAS BEEN PROVIDE YEAH, I I WOULD LIKE TO SURE. LIKE TO SEE ON, ON THAT AND THE DEFERRALS TO SEE IF THAT'S TRENDING PERCENTAGE WISE, HIGHER. UM, AND YOU KNOW, QUITE HONESTLY THAT THAT'S, UH, [00:30:01] UH, TIED TO HOW LONG YOU LIVE. AND SO, RIGHT. THERE'S PART OF ME THAT SAYS, I HOPE THE DEFERRALS ARE GOING UP. THAT MEANS OUR CITIZENS ARE LIVING LONGER. AND, AND, UH, EXACTLY. SO, UH, JUDGE, I CAN TELL YOU THAT THIS DEFERRAL RATE HERE IS, HAS BEEN FAIRLY CONSISTENT AND IT'S FAIRLY CONSISTENT WITH OTHER JURISDICTIONS. AND THE REASON IS BECAUSE NOW I'LL SAY IF YOU LOOK AT A TREND OVER, SAY A 20 YEAR PERIOD OR A 30 YEAR PERIOD, THE DEFERRALS WILL HAVE GONE UP SIGNIFICANTLY. WHY? WELL, BECAUSE MORE PEOPLE QUALIFY FOR 'EM TO BEGIN WITH. TWO, BECAUSE, UH, PEOPLE HAVE BEGUN USING TAX DEFERRALS AS AN ESTATE PLANNING TOOL. SO THEY DELIBERATELY GO INTO DEFERRAL, EVEN IF THEY CAN AFFORD TO PAY THEIR TAXES BECAUSE IT'S, UH, MORE, MORE LUCRATIVE FOR THEM TO USE THEIR INVESTMENTS AND THEIR MONEY TO GENERATE INCOME, EVEN THOUGH THEY'RE, UH, ACCRUING INTEREST ON THE DEFERRED TAX AMOUNT, THEN WHEN THEY PASS AWAY, THE ESTATE WILL BE ABLE TO PAY ALL THE TAXES. BUT IN THE MEANTIME, THEY'VE BEEN ABLE TO USE THAT CAPITAL LEVERAGE TO MAKE MORE MONEY. AND SO I KNOW THAT THAT TREND HAS GENERALLY INCREASED THE DEFERRAL PERCENTAGES UPWARD. AND I AM SEEKING AN OPINION FROM THE COURT'S GENERAL COUNSEL ON WHETHER BOND MONIES MAY BE USED ON PROJECTS THAT WERE NOT ENUMERATED IN THE ANTICIPATED PROJECT LIST GIVEN TO THE VOTERS ON NOVEMBER 12TH. THE COUNTY JUDGE USED THE WORDS ILLEGAL AND IMMORAL WHEN HE SPOKE OF ROAD PROJECTS THAT WERE NOT SPECIFICALLY ITEMIZED IN THE ANTICIPATED PROJECT LIST FOR THE TRIP 21 100 $50 MILLION BOND AUTHORIZATION. I HAVE, I HAVE SINCE SPOKEN WITH THE COUNTY JUDGE AND TOLD THEM THAT I DISAGREE WITH THIS BELIEF OF ILLEGALITY, BUT THAT I WOULD NEED SOME DIRECTION ON WHAT THE COURT PLANS TO DO IN THE FUTURE. FOR EXAMPLE, THE COUNTY CURRENTLY HAS AN INTERLOCAL AGREEMENT WITH THE CITY OF FATE FOR THE MS. MAY PROJECT. THAT PROJECT WAS NOT AN ITEMIZED OR LISTED ON THE ANTICIPATED PROJECT LISTING, ALTHOUGH IN THE ANTICIPATED PROJECT LIST IT WAS, IT WAS, UH, SLATED UNDER, UH, PRECINCT FOUR STRATEGIC PROJECTS. THERE'S ALSO AN AREA SLATED FOR, TO BE DETERMINED IN PRECINCT THREE ON YOUR ANTICIPATED PROJECT LIST. I HAVE NOT MADE A PAYMENT FOR THE MS. MAY PROJECT AS YET BECAUSE I WANT, I I NEED LEGAL DIRECTION TO OFFER TO EXPLAIN, BECAUSE IF THIS IS DEEMED ILLEGAL, THEN I AM NOT ABLE TO MAKE ANY PAYMENTS REGARDLESS OF AN AGREEMENT THAT WE WOULD HAVE IN PLACE WITH ANY ENTITY. UM, BASED ON THE COUNTY'S BOND ADVICE THROUGH THE YEARS, WE HAVE USED TRIP 2008 BOND FUNDS FOR EVERY CURRENT PROJECT IN OUR COUNTY, 2008 MONIES TO 2020 TO 2024. THAT'S 16 YEARS OF ROAD PROJECTS. THERE ARE ROUGHLY 23 PROJECTS CONTRACTED FOR ROADS THAT HAVE COME UP IN THOSE 16 YEARS THAT WERE PROBABLY NOT DISCUSSED BACK IN 2008 EITHER. SO LASTLY, I I, I WANT TO OFFER ALSO TO THE COURT THAT I DO NOT AGREE THAT THE AUTHORIZATION DOES NOT ALLOW FOR FLEXIBILITY. BUT, AND I ALSO WANNA MENTION THAT ONE OF THE PROJECTS THAT WAS, THAT WAS THE CONCERN FOR THE COUNTY JUDGE WAS THE OUTER LOOP. BUT THE COUNTY ITSELF, ROCKWELL COUNTY, HAS BUDGETED FOR THE OUTER LOOP IN FOUR CONSECUTIVE, FOUR CONSECUTIVE ANNUAL BUDGETS. AND WE'VE BUDGETED FOR THE MS. MAY PROJECT AS WELL. SO THE OUTER LOOP HAS BEEN BUDGETED AND, AND EVEN IN THE BUDGET THAT YOU JUST ADOPTED IN SEPTEMBER. SO I I I, I UNDERSTAND THAT IT IS COMPLETELY THE COURT'S DECISION AND IS NOT THE COUNTY AUDITOR'S DECISION. BUT IF IT COMES TO THE POINT OF WHERE THERE'S PAYMENTS TO BE MADE, AND IF IT IS DEEMED WHAT THE COUNTY JUDGE IS REFERRING TO, THEN I NEED DIRECTION WHETHER TO MAKE PAYMENT OR NOT. SO THAT'S HOW IT HAS INVOLVED ME, AND THAT'S WHERE I SIT NOW. THANK YOU, JUDGE. SO YOU, YOU HAVE ASKED FOR COUNSEL'S OPINION IS I BELIEVE WHAT, WHAT YOU'VE ASKED FOR. SO IN, IN MY MIND, IT, IT WOULDN'T, UH, WHAT WHAT I WAS TALKING ABOUT, AND JUST FOR CLARIFICATION, I, I SAID MOST LIKELY ILLEGAL AND, AND I BELIEVE TO BE ILLEGAL, I DIDN'T SAY 100% IS ILLEGAL. UM, UH, AND I DID SAY IMMORAL. UH, THE MS. MAY VERNON DRIVE IS 2008 BONDS. I I DIDN'T ISSUE THOSE. WHAT I'M TALKING ABOUT IS ISSUING DEBT WHERE WE CAME UP WITH THE LIST AND NOW WE'RE GOING TO ISSUE THE DEBT. I, I, I'M NOT ON BOARD WITH THAT AND I DON'T BELIEVE MY FUTURE COURT IS GOING TO BE ON BOARD WITH THAT. 2008 BONDS HAVE ALREADY BEEN ISSUED. SO WE, WE'VE ALREADY GOT THE MONEY. AS LONG AS YOU CAN SPEND ISSUE THE DEBT INSIDE THE PARAMETERS OF THAT BALLOT LANGUAGE, YOU CAN DO WHATEVER YOU WANT. SO THAT DRAWS A LINE IN THE SAND AND SAYS, YOU CAN ONLY LOOK FORWARD. I TAKE THAT SAME POINT AND I LOOK BACKWARDS. HOW DID WE GET TO THE DOLLAR AMOUNT THAT'S ON THE BALLOT? AND IF WE'VE DONE THAT IN A DECEPTIVE MANNER, THE BALLOT ITSELF, OR AT LEAST THE DOLLAR AMOUNT ON THE BALLOT, I I, IS DECEPTIVE. IS DECEPTIVE. SO I UNDERSTAND WHERE THE LEGALITY COMES IN, WHERE YOU START FROM, WHAT THE VOTERS APPROVED GOING FORWARD. BUT I HAVE TO TAKE THE STANCE, HOW DID WE GET TO WHAT THE VOTERS APPROVED? WHAT DID WE TELL THE VOTERS TO GET THEM TO APPROVE IT? AND, AND, AND THE FACT THAT WE'RE, WE'RE HANDS OFF WITH THAT. I, I, I CAN'T ACCEPT THAT. I HAVE TO LOOK AT THE WHOLE SCOPE. WHAT DID WE TELL 'EM? WHAT DOLLAR AMOUNT DID WE COME TO? WHAT DID THEY APPROVE? THOSE ARE CONNECTED. AND I UNDERSTAND THE SYSTEM HAS IT DISCONNECTED TO WHERE THE COUNTY CAN SIT HERE AND WE CAN BE BLAMELESS. WE CAN SAY THE VOTERS APPROVED IT AND, AND, AND WE DISCARD ALL THE INFORMATION THAT WE GAVE THE VOTERS. RIGHT? NOW, YOU, YOU GO TO THE WEBSITES, GO TO THE INTERNET, YOU CAN'T FIND THE INFORMATION. IT'S GONE. IT'S GONE. SO RIGHT NOW, THE ONLY THING THAT EXISTS AS A HISTORICAL DOCUMENT IS THE BALLOT LANGUAGE. AND, AND, AND I'M NOT OKAY WITH THAT.
